&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PROPOSTA D'ACORD&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMER.- Aprovar &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;el nou &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Conveni d'encomana de gestió de la Conselleria de Salut del Govern de les Illes Balears al Consell Insular de Formentera de determinades funcions del control oficial d'escorxadors, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;que consta com Annex..&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGON.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Procedir a la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; signatura &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;del present conveni&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; entre la persona titular de la Conselleria de la Salut del Govern de les Illes Balears i el president del Consell Insular de Formentera.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCER.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La formalització del nou conveni així com l'extinció de l'anterior s'han de&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; publicar en el Butlletí Oficial de les Illes Balears i a la pàgina web institucional del Consell Insular de Formentera.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUART.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Procedir a la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; designació&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; de dos representants del Consell Insular de Formentera, i dos representants de la Conselleria de Salut del Govern de les Illes Balears, com a &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;membres de la Comissió de seguiment, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;tot d'acord a la clàusula cinquena del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CINQUÈ.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Instar al Govern de les Illes Balears a inscriure el conveni en el&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Registre electrònic estatal d'òrgans i instruments de cooperació del sector públic estatal, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;i que estigui disponible en el&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Registre de convenis i acords de l'Administració de la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SISÈ.- Donar compte al Ple &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;de la Corporació a la propera sessió que tingui lloc del present acord als efectes oportuns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Parts &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Manuela García Romero, consellera de Salut del Govern de les Illes Balears, en virtut del Decret 9/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual es nomena membres del Govern dels Illes Balears, actuant en representació de l'Administració de la Comunitat de les Illes Balears, en l'exercici de les competències que li atribueix el Decret 25/2003, de 24 de novembre, del president de les Illes Balears, pel qual es delega en els titulars de les conselleries la signatura de determinats convenis de col·laboració i acords de cooperació, en relació amb l'article 80 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Oscar Portas Juan, president del Consell Insular de Formentera qui actua en nom i representació del Consell Insular de Formentera de data 27 de desembre de 2024 (BOIB núm. 19, 11 de febrer de 2025), en ús de les facultats que li atribueixen els articles 20.1 i 21.1.k de la Llei 4/2022, de 28 de juny, de consells insulars, autoritzada la signatura del present conveni per la Junta de Govern de data 05 de desembre de 2025, en exercici estricte de les competències municipals de la institució administrativa, sense perjudici de les competències insulars i autonòmiques, segons el règim juridicoadministratiu especial de Formentera. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ANTECEDENTS &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. L'article 31.4 de l'Estatut d'autonomia de les Illes Balears, confereix a la Comunitat Autònoma la competència del desplegament legislatiu i l'execució en matèria de salut i sanitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'article 30.48 de l'Estatut d'autonomia de les Illes Balears atribueix a la Comunitat Autònoma la competència exclusiva ─ entre d'altres─ en matèria de promoció de la salut en tots els àmbits, en el marc de les bases i la coordinació general de la sanitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. D'acord amb el Decret 10/2025, de 14 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, correspon a la Direcció General de Salut Pública de la Conselleria de Salut, entre altres, la competència en matèria de seguretat alimentària i nutrició i control oficial i registres en matèria de salut pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Llei 16/2010, de 28 de desembre, de salut pública de les Illes Balears, inclou l'avaluació, la gestió i la comunicació del risc i dels beneficis per a la salut derivats dels aliments i productes alimentaris, incloses les accions de vigilància, de promoció, de protecció i de control sanitari que pertoquin entre les prestacions en matèria de salut pública adreçades a protegir la salut de les persones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. D'acord amb l'article 70.12 de l'Estatut d'Autonomia de les Illes Balears el Consell Insular de Formentera té competència en agricultura, ramaderia i pesca, qualitat, traçabilitat i condicions de productes agrícoles i ramaders i dels productes alimentaris que se'n deriven. Així mateix, té funcions executives i de gestió en matèria de sanitat de conformitat amb l'article 71.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Reglament (UE) 2017/625 del Parlament Europeu i del Consell, de 15 de març de 2017, relatiu als controls i altres activitats oficials realitzades per garantir l'aplicació de la legislació sobre aliments i pinsos i de les normes sobre salut i benestar dels animals, sanitat vegetal i productes fitosanitaris, estableix que les autoritats competents han de disposar de personal suficient amb la qualificació i experiència adequades per poder efectuar amb eficiència i eficàcia els controls oficials i altres activitats oficials, o bé tenir accés a aquest personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. L'article 28 del Reglament (UE) 2017/625 permet la delegació de determinades funcions de control oficial de conformitat amb les condicions establertes en els articles 29 i 30.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El Reglament d'execució (UE) 2019/627 de la comissió de 15 de març 2019 pel qual s'estableixen disposicions pràctiques uniformes per a la realització de controls oficials dels productes d'origen animal destinats al consum humà, de conformitat amb el Reglament (UE) 2017/625 del Parlament Europeu i del Consell, i pel qual es modifica el Reglament (CE) núm. 2074/2005 de la Comissió pel que fa als controls oficials regula a la secció 2 la Inspecció &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;ante mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; i a la secció 3 estableix els requisits de la inspecció &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;post mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. L'històric de sacrificis de ramat a l'escorxador de Formentera indica que els animals sacrificats a l'escorxador han estat criats a l'illa i no consta que ni en el decurs de la inspecció &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;ante mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; ni &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;post mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; s'hagin declarat troballes que puguin afectar la salut humana o la sanitat animal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. El Consell Insular de Formentera ─ateses les competències que te atribuïdes i que s'han descrit en els antecedents &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; i 6 ─ disposa de personal funcionari veterinari, que es troba qualificat per dur a terme les tasques de control descrites en els antecedents &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;7&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; a &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;9&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Per altra banda, el nombre d'animals sacrificats a l'Escorxador de Formentera, no suposa un nivell d'activitat que justifiqui la creació de places de personal veterinari d'escorxadors de la comunitat autònoma de les Illes Balears amb destinació permanent a Formentera, per la qual cosa aquesta tasca s'ha dut a terme mitjançant el desplaçament de personal del Servei de Seguretat Alimentària de la Conselleria de Salut, amb destinació a Eivissa, el qual es desplaçava ocasionalment a Formentera per dur a terme les tasques de Control Oficial abans descrites. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. Aquests circumstàncies varen conduir a establir un sistema de col·laboració mitjançant el qual seria el personal funcionari veterinari del Consell Insular de Formentera, a qui se li encomanaria la tasca de dur a terme el control oficial de l'activitat de l'escorxador de l'illa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13. Diverses circumstàncies, com la doble insularitat de Formentera, les condicions del transport entre Eivissa i Formentera que determinen que tant les comunicacions marítimes en ple estiu ─per potencials saturacions─ com en èpoques de mal temps poden ser dificultoses i el fet de que el personal funcionari públic del Consell Insular de Formentera tengui la titulació i coneixements adients per dur a terme no només les tasques pròpies d'acord ambles seves ordes de funcions, sinó també les pròpies d'altre personal funcionari veterinari d'altres administració com seria el control oficial d'animals a escorxadors, els successius estats d'alarma arran de la pandèmia de COVID 19 ─amb les restriccions addicionals de mobilitat que aquesta va implicar per si mateixa, com també les que es derivaren d eles mesures de prevenció i control de la transmissió de la malaltia que s'establiren─ a més d'altres imponderables, varen posar de manifest que era indispensable disposar de personal qualificat que pugui dur a terme activitats relatives als controls oficials en tots els casos en què es trobava greument afectada la seva capacitat de desplaçar d'una illa a l'altra el personal adequat per fer les activitats de control oficial que exigeix el Reglament 2017/625, i d'aquesta manera no destorbar el funcionament normal de l'escorxador. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14. Per donar resposta a aquesta problemàtica, el dia 22 de novembre de 2021 es va signar un conveni de col·laboració entre la Conselleria de Salut i Consum i el Consell Insular de Formentera per a l'execució de determinades funcions del control oficial d'escorxadors amb vigència fins el 15 de setembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15. Transcorreguts quasi quatre anys des de la signatura de l'esmentat conveni, s'ha comprovat que l'execució per part dels serveis veterinaris oficials del Consell Insular de Formentera ha permès garantir tant l'activitat de servei públic de l'escorxador com la protecció de la salut de la població.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;16. L'Article 11 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic estableix que la realització d'activitats de caràcter material o tècnic de la competència dels òrgans administratius es pot encarregar a altres òrgans de la mateixa Administració o d'una altra, sempre que entre les seves competències estiguin aquestes activitats, per raons d'eficàcia o quan no es posseeixin els mitjans tècnics idonis per exercir-les. L'encomana de gestió no suposa la cessió de la titularitat de la competència ni dels elements substantius del seu exercici, i és responsabilitat de l'òrgan o entitat que l'encarrega dictar tots els actes o resolucions de caràcter jurídic que donin suport o en els quals s'integri l'activitat material concreta objecte d'encàrrec. L'encomana es formalitza mitjançant conveni. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;17. Per tot això, per raons d'eficàcia, és considera necessari, encomanar l'execució de funcions del control oficial als escorxadors al Consell Insular de Formentera amb la corresponent compensació econòmica. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, ambdues parts formalitzem aquest conveni pel qual s'encomana la gestió de determinades tasques de control oficial de l'escorxador de Formentera, d'acord amb les següents&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CLÁUSULES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primera. Objecte &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'objecte del present conveni és l'encomana per part de la Conselleria de Salut del Govern de les Illes Balears al Consell Insular de Formentera de l'execució de determinades funcions del control oficial sanitari a l'escorxador de Formentera i establir les condicions en les quals s'han d'executar, en els termes que es descriuen en les clàusules següents. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les activitats es duran a terme pel veterinari oficial del Consell Insular en servei actiu, o aquell que el reemplaci per causa de nous ingrés, provisió definitiva del lloc, cobertura temporal de vacant del lloc o cobertura de baixes de llarga durada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segona. Encomana&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A. És objecte d'encomana l'execució ordinària dels següents controls sanitaris:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La inspecció &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;ante mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, que defineix l'article 17 del Reglament 265/2017 com la comprovació, abans de les tasques de sacrifici, de l'acompliment dels requisits de salut humana i de salut i benestar animals, incloent-hi, si escau, l'examen clínic de cada animal, i la comprovació de la informació sobre la cadena agroalimentària a què es refereix l'annex II, secció III, del Reglament (CE) núm. 853/2004.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La inspecció post&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; mortem&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, definida com la comprovació en escorxadors del compliment dels requisits aplicables a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Les canals, tal com tal com es defineixen en l'annex I, punt 1.9, del Reglament CE núm. 853/2004, i les despulles tal com es defineixen en el punt 1.11 de l'annex, als efectes de decidir si la carn és apta per al consum humà L'eliminació segura dels materials especificats de risc La salut i el benestar dels animal&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Altres activitats: comprovar el compliment dels requisits aplicables a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) La higiene de la producció de carn&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) La manipulació i l'eliminació dels subproductes animals&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) La salut i el benestar dels animals&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Només en casos de sospita o quan no es pugui posposar aquesta tasca, la presa de mostres per a la investigació de residus de medicaments veterinaris i de contaminants en els productes d'origen animal destinats a consum humà, detectar la presència d'agents zoonòtics i malalties animals, i comprovar el compliment dels criteris microbiològics que defineix l'article 2.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;del Reglament (CE) núm. 2073/2005 de la Comissió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B. Resten exclosos de l'encomana els controls sanitaris efectuats quan a la jornada exclusivament és sacrifiquin animals per autoconsum. Aquests controls, si n'és el cas, es duran a terme, sota la responsabilitat directa i pel personal qualificat del propi Consell insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercera. Obligacions del Consell Insular de Formentera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Correspon al Consell Insular de Formentera, mitjançant els serveis veterinaris que tinguin adscrits el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Executar les actuacions de control oficial descrits a la clàusula segona del present conveni d'acord amb els requisits establerts al Reglament 627/2019 i altres requisits que siguin d'aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. D'acord amb l'article 32 del Reglament UE 625/2017:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Comunicar al Servei de Seguretat Alimentària els resultats de les activitats que hagin fet.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Informar immediatament al Servei de Seguretat Alimentària cada vegada que els resultats dels controls oficials indiquin un incompliment o la probabilitat que és produeixi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Cooperar amb el Servei de Seguretat Alimentària i prestar-li assistència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Insular de Formentera ha de garantir que els funcionaris que duguin a terme les funcions encomanades estiguin en possessió de la titulació de llicenciat o graduat en veterinària, que actuïn amb imparcialitat i no han de tenir cap conflicte d'interessos en relació amb les funcions encomanades. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quarta. Obligacions de la Conselleria de Salut&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Correspon a la Conselleria de Salut, mitjançant el Servei de Seguretat Alimentària de la Direcció General de salut Pública:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Dirigir mitjançant l'elaboració i posada a disposició dels serveis veterinaris del Consell Insular dels procediments normalitzats per dur a terme el control oficial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Donar suport tècnic i incloure als grups de treball i activitats formatives en matèria de control oficial als escorxadors organitzats per la Direcció General de Salut Pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Proporcionar els mitjans necessaris per a la presa de mostres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Mantenir informat el veterinari de les tendències i novetats que, relacionades amb el sacrifici dels animals, es discuteixen en el si de la Comissió Europea o d'altres administracions competents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Executar la potestat sancionadora, inclòs l'aplicació de mesures cautelars, en cas de detecció d'infraccions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La realització dels controls oficials en situacions de sacrificis extraordinaris conseqüència de la detecció d'una epizoòtia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Donar compliment a les obligacions financeres establertes a la clàusula setena en els termes que aquesta disposa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cinquena. Comissió de seguiment&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es crea una comissió de seguiment, formada per dos representants de la Conselleria de Salut i dos representant del Consell Insular de Formentera, d'acord amb l'article 49.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;de la Llei 40/2015, la qual ha d'estar integrada pels membres següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Per part de la Conselleria de Salut&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. La persona titular de la Direcció General de Salut Pública o aquella en qui delegui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. La persona titular del Servei de Seguretat Alimentària o aquella en qui delegui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Per part del Consell Insular de Formentera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. La consellera d'Igualtat, Participació Ciutadana i Sector Primari o la persona en que delegui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. La persona veterinària del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les funcions de la comissió de seguiment són les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Vetllar pel compliment d'aquest conveni. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Avaluar-ne el desenvolupament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Resoldre els problemes d'interpretació i compliment que es puguin plantejar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sisena. Durada i modificació de l'encomana&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La vigència d'aquest Conveni serà des de la data de la seva publicació en el Butlletí Oficial de les Illes Balears fins el 28 de febrer de 2028 en què s'ha de justificar les actuacions de 2027. Les actuacions encomanades es realitzaran des de la seva signatura fins el 31 de desembre de 2027. El conveni es pot prorrogar, si així ho manifesten les parts signants, per dos anys més.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els termes del present Conveni podran ser modificats d'acord mutu i per escrit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Setena. Finançament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El cost de les activitats objecte d'encomana és calcularà a partir de l'import per hora de les retribucions que en cada moment resultin d'aplicació al lloc de treball del funcionari veterinari del Consell Insular de Formentera que desenvoluparà les tasques objecte de l'encomana (amb inclusió de les que puguin correspondre per treball en horari nocturn o en festius), considerant una jornada màxima de 7,5 hores per control oficial desenvolupat a l'Escorxador que es trobin compresos dins de l'objecte de l'encomana. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Conselleria de Salut aportarà per a l'execució d'aquesta encomana una quantia màxima total de 21.666,66&amp;nbsp;euros total a raó d'un màxim de 10.000,00 euros anuals per compensar les activitats descrites en aquest conveni i efectivament realitzades amb càrrec a la partida pressupostària 18101.411A01.46400.40, dels Pressuposts Generals de la Comunitat Autònoma de les Illes Balears, amb la distribució per anualitats, imports i partides pressupostàries següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 25.3&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;d &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;del Decret 75/2004, de 27 d'agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals, el pagament es farà per bestreta, i se n'exceptua la garantia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Abans del 28 de febrer de 2026, 2027 i 2028, el Consell Insular de Formentera haurà de justificar el numero de controls efectivament realitzats l'anualitat anterior mitjançant un certificat emès per la consellera d'Igualtat, Participació Ciutadana i Sector Primari del Consell Insular de Formentera. Al certificat hi constarà el nombre de dies i d'hores de control oficial realment efectuats, i l'import per hora de les retribucions del veterinari oficial del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vegada presentada la justificació de l'anualitat anterior, la Conselleria de Salut abonarà com a màxim l'import màxim de 10.000&amp;nbsp;euros &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;(12 mesos&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) per l'anualitat següent. En cas que el Consell Insular de Formentera hagi de retornar part de l'import abonat per haver-se justificat un import inferior al prèviament transferit, es compensarà amb l'anualitat en curs pendent d'abonament, excepte el darrer any de vigència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si n'és el cas, presentada la justificació corresponent a l'exercici de 2027, la liquidació que se‘n derivi, generés un resultat inferior a l'import de la suma transferida per la Conselleria de Salut al Consell Insular de Formentera, després de haver-se realitzat la justificació i liquidació de l'activitat corresponent a 2026, el Consell Insular de Formentera haurà de reintegrar l'excés percebut.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 25.3 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;del Decret 75/2004, el pagament d'aquest import es farà per bestreta, i se n'exceptua la garantia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Vuitena&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Causes de resolució del conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Són causes de resolució del conveni d'encomana, a més de la impossibilitat sobrevinguda, legal o material, de poder dur a terme l'objecte del conveni, les que preveu l'article 51 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) La falta d'execució per part del Consell Insular de Formentera dels controls objecte d'encomana encomanades per un espai de temps superior a un mes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) El transcurs del termini de vigència del conveni sense que se n'hagi acordat la pròrroga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) L'acord unànime dels signants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) L'incompliment de les obligacions i els compromisos assumits per part d'algun dels signants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Per decisió judicial declaratòria de la nul·litat del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supòsit que es produeixin les causes de resolució i hi hagi actuacions en curs d'execució, la comissió establerta a la clàusula cinquena acordarà com han de continuar i acabar les actuacions en curs d'execució de conformitat amb el que preveu l'article 52.3 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La resolució del conveni per incompliment per alguna de les dues parts de les obligacions i compromisos assumits no dona lloc a cap indemnització per a l'altra part.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Novena. Eficàcia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest conveni tindrà efectes des de la seva publicació en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Com a mostra de conformitat, signem aquest conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Signatura”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'ha esmenat, d'ofici, pel secretari general, la referència que hi havia en el text del Conveni a l'actuació del president, quan s'esmentava la Llei de consells insulars de 27 d'octubre de 2000, quan el que pertoca, és, sense dubte, la Llei vigent, de consells insulars, de 28 de juny de 2022. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Junta de Govern, en exercici de les seues competències [articles 130.2, 132 (en relació a l'article 28) i 134 de la Llei 4/2022, 28 de juny, de consells insulars], sobre la base d'allò proposat (que conforme als articles 35 i 88.3 i 6 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions publiques suposa la motivació d'aquest acte), i el que ha informat el secretari general, una volta introduït l'assumpte present en l'ordre del dia -per urgència justificada, que s'ha aprovat per unanimitat, com a qüestió adjectiva, adopta, per unanimitat, pel que fa al fons de l'assumpte -o qüestió substantiva- el següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGON.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Procedir a la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; signatura &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;del present conveni&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; entre la persona titular de la Conselleria de la Salut del Govern de les Illes Balears i el president del Consell Insular de Formentera.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCER.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La formalització del nou conveni així com l'extinció de l'anterior s'han de&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; publicar en el Butlletí Oficial de les Illes Balears i a la pàgina web institucional del Consell Insular de Formentera.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUART.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Procedir a la&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; designació&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; de dos representants del Consell Insular de Formentera, i dos representants de la Conselleria de Salut del Govern de les Illes Balears, com a &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;membres de la Comissió de seguiment, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;tot d'acord a la clàusula cinquena del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CINQUÈ.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Instar al Govern de les Illes Balears a inscriure el conveni en el&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Registre electrònic estatal d'òrgans i instruments de cooperació del sector públic estatal, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;i que estigui disponible en el&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; Registre de convenis i acords de l'Administració de la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SISÈ.- Donar compte al Ple &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;de la Corporació a la propera sessió que tingui lloc del present acord als efectes oportuns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Annex.- Es dona per reproduït el text del Conveni transcrit més amunt. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La qual cosa es fa públic per a general coneixement&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
