    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1&lt;/strong&gt;.&amp;nbsp;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;Arran de l'aprovació &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, la fórmula de l'acció concertada, com a figura de col·laboració entre el sector públic i el privat, es postula com la més adequada als principis que han de regir el sistema de serveis socials. Així doncs, a l'article 2 de l'esmentada Llei, es preveu que les administracions competents de les Illes Balears, per complementar el sistema públic i garantir una adequada equitat i qualitat de les prestacions incloses en la cartera de serveis o del servei d'orientació professional, poden encarregar la prestació d'aquests serveis de la seva competència, mitjançant el sistema d'acció concertada, a entitats sense ànim de lucre del tercer sector social, tal com es defineixen en els articles 3 i 4 de la Llei 3/2018, de 29 de maig, del tercer sector d'acció social, o, si escau, a entitats privades, preferentment del tercer sector social, quan existeixin anàlogues condicions d'eficàcia, qualitat i costs, d'acord amb els requisits que estableix aquesta Llei i amb respecte als principis de publicitat, transparència i no-discriminació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2.&lt;/strong&gt; L'article 4.1 de la Llei 12/2018 estableix que, amb una periodicitat anual, les administracions de les Illes Balears competents en matèria social i d'ocupació, com a part de les competències en planificació, han de fer una previsió de les prestacions i els serveis que pretenen que siguin objecte d'acció concertada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;3. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;En data 17 de febrer de 2026&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;, la cap de Servei d'Acolliments Residencials, per suplència de la cap de Servei d'Infància i Adolescència, amb el vist-i-plau de la directora insular de Serveis Socials, Infància i Família, va emetre proposta per l'aprovació de la previsió dels serveis a concertar per la Direcció Insular de Serveis Socials, Infància i Família per l'any 2026 &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;(Codi CSV:&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; K9AADUFJPNJLZCPRMT4M&lt;span style="background-color:#ffffff"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt; En data 20 de febrer de 2026, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;la cap de Servei d'Acolliments Residencials, amb el vist-i-plau de la directora insular de Centres i Programes d'Atenció Integral a la Infància i Adolescència, va emetre proposta per l'aprovació de la previsió dels serveis a concertar per la Direcció Insular de Centres i Programes d'Atenció Integral a la Infància i Adolescència per l'any 2026 &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;(Codi CSV:&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; K9AADUVWPU2XJ9ALL4FM&lt;span style="background-color:#ffffff"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Pel que fa a la competència,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.&lt;/strong&gt; La Llei orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'Autonomia de les Illes Balears (BOIB núm. 32 ext., d'1 de març de 2007; correcció d'errades BOIB núm. 29, de 28 de febrer de 2008), en concret l'article 70.4 relatiu a la competència pròpia dels consells insulars en matèria de serveis socials i assistència social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; La Llei 14/2001, de 29 d'octubre, d'atribució de competències als consells insulars en matèria de serveis socials i seguretat social, estableix a l'article 14 la potestat reglamentària normativa atribuïda als consells insulars en matèria de serveis socials, dins el marc de la regulació bàsica establerta pel Govern de les Illes Balears (BOIB núm. 135, de 10 de novembre de 2001 i BOE núm. 284, de 27 de novembre de 2001).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;3. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears (BOIB núm. 89 de 18 de juny de 2009 i BOE núm. 163 de 7 de juliol de 2009) preveu a l'article 27 i a la disposició final quarta, que cada Consell Insular, en el marc de les seves competències, ha de definir les prestacions pròpies de serveis socials, complementant la cartera bàsica de serveis socials que aprova el Govern de les Illes Balears, la qual va ser aprovada mitjançant el Decret 32/2023, de 26 de maig, pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2023-2027, s'estableixen principis generals per a les carteres insulars i locals i es modifiquen diverses normatives de l'àmbit social (BOIB núm. 70, de 27 de maig de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt; Els Estatuts de l'Institut Mallorquí d'Afers Socials (BOIB núm. 67, de 18 de maig de 2019) aprovats per acord del Ple del Consell de Mallorca de data 11 d'abril de 2019, en especial l'establert a l'article 2 d'acord amb el qual l'Institut Mallorquí d'Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Benestar Social del Consell de Mallorca, és l'organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i protecció de menors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;5. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;Decret de la Presidència del Consell de Mallorca pel qual es nomenen els membres del Consell Executiu de 10 de juliol de 2023 (&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt; núm. 95, d'11 de juliol de 2023) pel qual es nomena el Sr. Guillermo Sánchez Cifre conseller executiu de Benestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6. &lt;/strong&gt;L'òrgan competent per aprovar aquesta resolució és la Presidència de l'IMAS, d'acord amb l'article 7.2 dels Estatuts de l'IMAS (BOIB núm. 67, de 18 de maig de 2019). No obstant això, i d'acord amb l'article 8.2.1 les Vicepresidències de l'IMAS supliran a la Presidència i assumiran les seves atribucions en cas de vacant, absència, malaltia, impossibilitat física o una altre causa legal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Pel que fa al fons,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7&lt;/strong&gt;. &lt;/span&gt;La Cartera Insular de Serveis Socials i dels Serveis a Menors i Família de Mallorca aprovada definitivament en Ple del Consell de Mallorca de 13 de juliol de 2017 (BOIB núm. 97, de 18 de juliol de 2017 i correcció d'errades materials publicada BOIB núm. 161, de 30 de desembre de 2017) i prorrogada la seva vigència fins a l'entrada en vigor de la nova Cartera Insular de serveis socials de Mallorca, per Acords del Ple en sessions de 8 de juliol de 2021 (BOIB núm. 95, de 17 de juliol de 2021), de 15 de desembre de 2022 (BOIB núm. 168, de 27 de desembre de 2022), Acord del Ple de 14 de desembre de 2023 (BOIB núm. 176, de 30 desembre de 2023) i Acord del Ple de 12 de desembre de 2024 (BOIB núm. 172, de 31 desembre de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;8. &lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Reglament pel qual s'estableix el règim jurídic dels serveis d'acolliment residencial per a persones menors d'edat a Mallorca de l'Institut Mallorquí d'Assumptes Socials (IMAS) aprovat per el Ple del Consell de Mallorca en la sessió celebrada el 13 de maig de 2021 (BOIB núm. 81, de 19 de juny de 2021).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. &lt;/strong&gt;La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears (BOIB núm. 146 de 22 de novembre de 2018), regula al Capítol I el «Règim de col·laboració privada en la gestió de serveis socials per a les persones mitjançant l'acció concertada».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;11.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; &lt;/span&gt;&lt;span style="background-color:#ffffff; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Resolució de la Presidència de l'IMAS, &lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;núm. 25798, de 20 de d'octubre de 2025,&lt;/span&gt;&lt;span style="background-color:#ffffff; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; d'actualització i fixació de preus dels serveis per a persones menors d'edat de la Direcció insular de Serveis Socials, Infància i Família, concertats per l'IMAS, per als anys 2025-2026 (BOIB núm. 146, de 4 de novembre de 2025)&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;12.&lt;/strong&gt; Resolució de la Presidència de l'IMAS, núm. 27871 de 10 de novembre de 2025, rectificada per Resolució núm. 28175 de 12 de novembre de 2025, d'actualització i fixació de preus dels serveis per a persones menors d'edat de la Direcció insular de Centres i Programes d'Atenció integral a la Infància i Adolescència, concertats per l'IMAS, per als anys 2025-2026 &lt;span style="background-color:#ffffff"&gt;(BOIB núm. 157, de 27 de novembre de 2025)&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En virtut de la competència atribuïda legalment,&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESOLC&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;Primer.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt; APROVAR la previsió dels serveis a concertar per la &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Direcció Insular de Serveis Socials, Infància i Família &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;durant l'any 2026, detallats en l'annex I d'aquesta resolució i &lt;/span&gt;FIXAR el preu/plaça dels serveis que s'han de concertar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segon.&lt;/strong&gt; &lt;span style="background-color:#ffffff"&gt;APROVAR la previsió dels serveis a concertar per la Direcció Insular de Centres i Programes d'Atenció Integral a la Infància i Adolescència durant l'any 2026, &lt;/span&gt;que consten especificats a l'annex II d'aquesta resolució&lt;span style="background-color:#ffffff"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercer.&lt;/strong&gt; PUBLICAR aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears, &lt;/em&gt;així com al Tauler d'Anuncis de l'IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quart.&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;COMUNICAR aquesta Resolució a la &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Direcció Insular de Serveis Socials, Infància i Família i a la &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;Direcció Insular de Centres i Programes d'Atenció Integral a la Infància i Adolescència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 28.1 dels Estatuts de l'IMAS aprovats per Acord del Ple del Consell de Mallorca d'11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d'alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d'un mes, a comptar a partir del dia següent al de la notificació de la present resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra la desestimació expressa del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, a comptar a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No obstant l'anterior, es pot exercitar, si n'és el cas, qualsevol altre recurs que s'estimi pertinent. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la Jurisdicció Contenciosa Administrativa, i de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
