&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fets&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. El 3 de juliol de 2025, es va publicar la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III 2025)&lt;strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/strong&gt;mitjançant la Resolució del conseller d&amp;apos;Empresa, Ocupació i Energia d&amp;apos;1 de juliol de 2025. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Les persones o entitats que figuren en l&amp;apos;annex d&amp;apos;aquesta Proposta varen presentar una sol·licitud de subvenció en el marc de la convocatòria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Els tècnics de la Direcció General d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic, en aplicació del procediment de concessió que estableix l&amp;apos;apartat novè de la Resolució esmentada, han informat desfavorablement sobre la concessió de les subvencions descrites en l&amp;apos;annex, amb la motivació que també hi figura. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. En data 19 de gener de 2026 es va emetre la Proposta de resolució provisional del director general d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic&amp;nbsp; per la qual es deneguen les subvencions en el marc de la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (programa MOVES III 2025) (BOIB núm. 12, de 24 de gener de 2026). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. En data 28 de gener de 2026, Martín Javier Díaz García, titular de l&amp;apos;expedient MOVESIII25-1766/2025,&amp;nbsp;&amp;nbsp; va presentar un escrit d&amp;apos;al·legacions a la Proposta provisional denegatòria. &amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El motiu de denegació de la subvenció és el següent:&lt;strong&gt; &lt;/strong&gt;&lt;em&gt;«S&amp;apos;ha comprovat que el sol·licitant té concedides ajudes de minimis que no es van declarar a la sol·licitud per la qual cosa no es pot continuar amb el procediment d&amp;apos;acord amb l&amp;apos;article 69. 4 de la Llei 39/2015 del PAC&lt;/em&gt;»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En data 29 de gener de 2026, es va emetre un informe tècnic en que s&amp;apos;informa favorablement a les al·legacions presentades per Martín Javier Díaz García atès que&amp;nbsp; s&amp;apos;ha comprovat que el sol·licitant si havia declarat correctament les ajudes rebudes subjectes a mininis en el moment de la sol·licitud i es va cometre un error per part de l&amp;apos;òrgan administratiu. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. En data 19 de febrer de 2026 , es va publicar en el BOIB núm. 23, Resolució del conseller d&amp;apos;Empresa, Autònoms i Energia, a proposta definitiva del director general d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic,&amp;nbsp; de 13 de febrer de 2026 per la qual es deneguen les subvencions en el marc de la convocatòria pública de subvencions&amp;nbsp; per a actuacions de suport a la mobilitat elèctrica (programa MOVES III 2025). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7. Posteriorment, es va detectar que en data 30 de gener de 2026, Joaquin Martines Guarneri, titular de l&amp;apos;expedient MOVESIII25-1846/2025, havia presentat al·legacions a la Proposta de denegació de l&amp;apos;ajut i no es varen resoldre en la Resolució de denegació de 13 de febrer de 2026 (BOIB núm. 23, de 19 de febrer&amp;nbsp; de 2026). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: white"&gt;8. Pel motiu descrit en l&amp;apos;antecedent anterior, en data 23 de febrer de 2026 es va dictar la Resolució de revocació de la Resolució del conseller d&amp;apos;Empresa, Autònoms i Energia, a propost&lt;/span&gt;a definitiva del director general d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic,&amp;nbsp; de 13 de febrer de 2026 per la qual es deneguen les subvencions en el marc de la convocatòria pública de subvencions&amp;nbsp; per a actuacions de suport a la mobilitat elèctrica (programa MOVES III 2025&lt;span style="background-color: white"&gt;) (BOIB núm. 26, de 26 de febrer de 2026). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;9. En la proposta de resolució es denega la subvenció a Joaquin Martines Guarneri pel següent motiu: &amp;nbsp;«Les actuacions són anteriors a l&amp;apos;1 de gener de 2025, per la qual cosa s&amp;apos;incompleixen els apartat 4. 1. b) i 4. 1. c) de les bases de la convocatòria. »&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En l&amp;apos;escrit d&amp;apos;al·legacions, Joaquin Martines Guarneri ,&amp;nbsp; indica que la convocatòria MOVESIII25 només inclou les actuacions realitzades a partir de l&amp;apos;1 de gener de 2025, sense establir una cobertura per a aquells casos que es van veure afectats pel tancament imprevist de la convocatòria anterior (MOVESIII). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En data 2 de febrer es va emetre un informe tècnic en que s&amp;apos;informa desfavorablement a les al·legacions presentades per&amp;nbsp; &lt;span style="background-color: white"&gt;Joaquin Martines Guarneri atès que la factura d&amp;apos;adquisició del vehicle és anterior a l&amp;apos;1 de gener de 2025, per la qual cosa s&amp;apos;incompleixen les bases de la convocatòria MOVESIII2025 i&amp;nbsp; es recorda que el 9 d&amp;apos;octubre de 2025 es va aprovar la convocatòria MOVES CAIB, per atendre les sol·licituds afectades per la derogació del Reial decret llei 9/2024 i que el Reial decret llei 3/2025 no ha inclòs com a vàlides (BOIB núm. 136, de 14 d&amp;apos;octubre de 2025) . &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. La Llei 38/2003, de 17 de novembre, general de subvencions. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s&amp;apos;aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. El Decret 75/2004, de 27 d&amp;apos;agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm. 122, de 2 de setembre de 2004). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. L&amp;apos;Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s&amp;apos;estableixen les bases reguladores per a la concessió de subvencions en matèria d&amp;apos;energia (BOIB núm. 72, de 24 de maig de 2008). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. La Resolució del conseller d&amp;apos;Empresa, Ocupació i Energia d&amp;apos;1 de juliol de 2025 per la qual s&amp;apos;aprova la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (programa MOVES III 2025) (BOIB núm. 85, de 3 de juliol de 2025). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Proposta de resolució definitiva&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Propòs al conseller d&amp;apos;Empresa, Autònoms i Energia que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Denegar la concessió d&amp;apos;una subvenció per actuacions de suport a la mobilitat elèctrica (Programa MOVESIII 2025) als beneficiaris que figuren en l&amp;apos;annex, d&amp;apos;acord amb la motivació que també hi figura. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d&amp;apos;Empresa, Autònoms i Energia en el termini d&amp;apos;un mes comptador des de l&amp;apos;endemà de la publicació, d&amp;apos;acord amb els articles 123 i 124 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, i l&amp;apos;article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l&amp;apos;endemà de la publicació de la resolució, d&amp;apos;acord amb l&amp;apos;article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
