490 text/html 712452 2026-02-28 CAIB 2026-02-28 152992 CAIB 11133 2026-02-25 11130 ca ![CDATA[Aprovació de la modificació del pla estratègic de subvencions de l’Ajuntament d’Artà per a 2026]] CAIB ca ![CDATA[<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El Ple de l'Ajuntament d'Artà, en sessió ordinària celebrada el dia 24 de novembre de 2025, ha aprovat el Pla Estratègic de Subvencions per a 2026, que ha estat modificat en la sessió de 23 de febrer de 2026, pel que en compliment del dispost a l'article 45 de la Llei 39/2015, d'1 d'octubre, del Procediment administratiu comú de les Administracions Públiques, es fa públic pel seu general coneixement. </span></span></span></span></p> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">“PLA ESTRATÈGIC DE SUBVENCIONS DE L'AJUNTAMENT DE SANTANYÍ PER A L'ANY 2026</span></strong></span></span></span></p> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">PREÀMBUL</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">D'acord amb les previsions de l'article 8 de la Llei 38/2003, de 17 de novembre, general de subvencions, que obliga les administracions que pretenguin concedir subvencions aprovar, prèviament, un Pla estratègic, i d'acord amb l'article 10 i següents del Reial Decret 887/2006 de 21 de juliol que aprova el Reglament de la Llei General de Subvencions, l'Ajuntament d'Artà ha elaborat el present document que pretén ser el Pla estratègic de subvencions per a l'any 2026. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Llei 38/2003, de 17 de novembre, General de Subvencions, suposa un pas més en el procés de perfeccionament i racionalització del sistema econòmic. Un dels principis que regeix la Llei és el de la transparència que, junt amb la gran varietat d'instruments que s'articulen en la Llei, afecta de forma directa en un increment dels nivells d'eficàcia i eficiència en la gestió de la despesa pública subvencional. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En aquest aspecte, una major informació sobre les subvencions farà possible eliminar les distorsions i interferències que puguin afectar al mercat, a més de facilitar la complementarietat i coherència de les actuacions de les diferents Administracions Públiques evitant qualsevol tipus de solapament. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per millorar l'eficàcia, en la legislació es preveu que es procedeixi a elaborar un Pla Estratègic de Subvencions - instrument d'organització de les polítiques públiques que té com a finalitat el foment d'una activitat d'utilitat pública o interès social o de promoció d'una finalitat pública - amb caràcter previ al naixement de les subvencions. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Aquest Pla estratègic, a més de complir amb l'obligació jurídica que estableix l'esmentada Llei General de Subvencions, desenvolupada i concretada com s'ha dit pel Reial Decret 887/2006 que aprova el seu reglament, vol introduir una connexió entre els objectius i els efectes que es pretenen aconseguir, els costos previsibles i els fons de finançament amb l'objecte d'adequar les necessitats públiques que s'han de cobrir via subvencions amb la previsió dels recursos disponibles. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per això, aquest Ajuntament aprova el Pla Estratègic de Subvencions l'articulat del qual figura tot seguit.</span></span></span></span></p> <p> </p> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 1</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les subvencions que concedeixi l'Ajuntament d'Artà durant l'any 2026, s'ajustaran al que preveu aquest Pla.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 2</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per fer efectives les subvencions previstes en aquest Pla, es requerirà la inclusió de les consignacions corresponents en el Pressupost municipal i l'aprovació de les convocatòries reguladores per a la seva concessió, si es tracta de subvencions en concurrència, competitiva o no, o bé del corresponent conveni regulador o resolució de concessió, si es tracta de subvencions nominatives.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 3</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les afectacions financeres que es comprometen en aquest Pla es corresponen principalment amb les previsions pressupostàries del Capítol IV del pressupost de despeses municipal i amb aquelles altres que, eventualment, puguin comprometre les convocatòries pertinents o que l'objecte de la subvenció nominativa prevista determini.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 4</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'establiment de subvencions queda supeditat al compliment dels objectius d'estabilitat pressupostària.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 5</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'aprovació del Pla estratègic de subvencions no suposa la generació de cap tipus de dret en favor dels potencials beneficiaris, que no podran exigir indemnització o compensació en cas que el Pla no arribés a dur-se a terme.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Article 6</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'efectivitat d'aquest Pla queda condicionada a la posada en pràctica de les diferent línies de subvenció, que dependrà, entre altres condicionants bàsicament, a la disponibilitat pressupostaria de l'exercici i a la sol·licitud dels beneficiaris, en el seu cas.</span></span></span></span></p> <p> </p> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament d'Artà concedirà subvencions, mitjançant els procediments prevists a les Bases generals de subvencions, aprovades pel Ple de l'Ajuntament, a favor de persones, associacions o entitats públiques o privades amb la finalitat de fomentar i promoure la realització d'activitats d'utilitat pública o interès social o per promoure la consecució de fins públics atribuïts a la competència local. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra aquest acord, que posa fi a la via administrativa, es pot interposar alternativament recurs de reposició potestatiu davant el Ple d'aquest Ajuntament, en el termini d'un mes a comptar des de l'endemà de la publicación d'aquest anunci, de conformitat amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques; o bé interposar directament recurs contenciós administratiu, davant Jutjat Contenciós Administratiu de Palma en el termini de dos mesos, a comptar des de l'endemà de la seva publicació, de conformitat amb l'article 46 de la Llei 29/1998, de 13 de juliol, de la Jurisdicció Contenciós-Administrativa.
