&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Mitjançant Resolució del director gerent del FOGAIBA de 28 de novembre de 2025, publicada al BOIB núm. 159, de 2 de desembre de 2025, es varen aprovar la convocatòria, les bases, els exercicis i el temari, i el barem de mèrits de les proves selectives per a l'ingrés, per al torn lliure i de promoció interna, d'acord amb l'oferta pública d'ocupació dels anys 2023, 2024 i 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Entre aquests procediments selectius es va aprovar el de la categoria tècnic/a superior, especialitat jurídica, corresponent al torn lliure.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. El dia 22 de desembre de 2025 va finalitzar el termini per presentar sol·licituds d'admissió al procés de participació en la convocatòria esmentada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. El dia 19 de gener de 2026, es va publicar la llista provisional de persones admeses i excloses a la convocatòria i es va donar un termini de 10 dies hàbils per presentar al·legacions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. En data 17 de febrer de 2026 es va publicar en el BOIB la Resolució del director gerent del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de 12 de febrer de 2026, per la qual s'aprova la llista definitiva de persones admeses i excloses, amb indicació de les causes d'exclusió, corresponent a la convocatòria de les proves selectives per a l'ingrés, pel torn lliure, d'acord amb l'oferta pública d'ocupació dels anys 2023, 2024 i 2025, de la categoria de tècnic/a superior, especialitat jurídica.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. En data 17 de febrer de 2026 va tenir entrada en el Registre del FOGAIBA l'escrit presentat per una aspirant exclosa, al qual acompanya còpia del títol acadèmic de llicenciada en dret.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;strong&gt;Fonaments de Dret&lt;/strong&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. D'acord amb l'article 13 r del Decret 64/2005, de 10 de juny, de creació del Fons de Garantia Agrària i Pesquera de les Illes Balears, correspon al director gerent del FOGAIBA seleccionar el personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. L'article 73 de la Llei 39/2015, d'1 d'octubre del procediment administratiu común de les Administracions Públiques, disposa el següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;em&gt;&lt;em&gt;“Els tràmits que hagin de ser emplenats pels interessats hauran de realitzar-se en el termini de deu dies a partir del següent al de la notificació del corresponent acte, excepte en el cas que en la norma corresponent es fixi termini distint.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En qualsevol moment del procediment, quan l'Administració consideri que algun dels actes dels interessats no reuneix els requisits necessaris, el posarà en coneixement del seu autor, concedint-li un termini de deu dies per a emplenar-lo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Als interessats que no compleixin el que es disposa en els apartats anteriors, se'ls podrà declarar perduts el dret al tràmit corresponent. No obstant això, s'admetrà l'actuació de l'interessat i produirà els seus efectes legals, si es produís abans o dins del dia que es notifiqui la resolució en la qual es tingui per transcorregut el termini”.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;D'acord amb això, resulta admissible l'actuació de l'aspirant que acredita el requisit dins el termini previst a l'article esmentat.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;strong&gt;Proposta de Resolució&lt;/strong&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atès tot això, propòs al director gerent del FOGAIBA que dicti resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;strong&gt;Primer.&lt;/strong&gt;&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&amp;nbsp;Modificar la resolució, de dia 12 de febrer de 2026, per la qual s'aprova la llista definitiva de persones admeses i excloses, amb indicació de les causes d'exclusió, corresponent a la convocatòria de les proves selectives per a l'ingrés, pel torn lliure, d'acord amb l'oferta pública d'ocupació dels anys 2023, 2024 i 2025, de la categoria de tècnic/a superior, especialitat jurídica, en el sentit següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Conforme amb la proposta de la cap del Servei de gestió de personal i contractació, dicto resolució en els mateixos termes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra aquesta resolució, que no exhaureix la via administrativa, es pot interposar recurs d'alçada davant el president del FOGAIBA en el termini d'un mes a comptar des de l'endemà de la seva publicació, d'acord amb el que estableixen l'article 58.1 de la Llei 3/2003 de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears i els articles 121 i 122 de la Llei 39/2015 d'1 d'octubre, del procediment administratiu comú de les administracions públiques, tot això sense perjudici d'interposar-ne qualsevol altre que s'estimi pertinent en defensa dels interessos propis.&lt;/span&gt;&lt;/p&gt;
