    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Notificació de resolució de revocació total als beneficiaris de les ajudes exp: 2023_015, 085, 105 de data 29 de gener de 2026 , a l'empara de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), per la qual es convoquen ajudes destinades a la creació d'empreses de joves agricultors i agricultores, per a l' any 2024&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 29 de gener de 2026, va signar la &lt;span style="background-color:#ffffff"&gt;següent resolució,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;1. El 19 de desembre de 2023 es va publicar al Butlletí Oficial de les Illes Balears (BOIB), núm. 171, la Resolució per la qual es convoquen, mitjançant el procediment anticipat de despesa i per als anys 2023 i 2024, subvencions per a la creació d'empreses de joves agricultors i agricultores.&lt;/p&gt;

&lt;p&gt;2. El 26 de novembre de 2024 es va publicar al Butlletí Oficial de les Illes Balears (BOIB), núm. 154, una Resolució de concessió d'ajudes per a la creació d'empreses de joves agricultors, en la qual hi figurava una concessió a favor dels beneficiaris especificats a l'annex adjunt.&lt;/p&gt;

&lt;p&gt;3. L'article 70.3 del Reglament de la Llei de subvencions, aprovat pel Reial decret 887/2006, de 21 de juliol, estableix que transcorregut el termini establert de justificació sense que aquesta s'hagi presentat davant l'òrgan competent, aquest ha de requerir el beneficiari perquè en el termini improrrogable de 15 dies la presenti.&lt;/p&gt;

&lt;p&gt;4. El 2 de setembre de 2025, es va publicar en el Butlletí Oficial de les Illes Balears (núm. 116), la notificació de requeriment de sol·licitud de pagament als benificiaris de les ajudes per a la creació d'empreses de joves agricultors (convocatòria 2023).&lt;/p&gt;

&lt;p&gt;5. Una vegada transcorregut el termini per esmenar les deficiències els beneficiaris que s'especifiquen a l'annex adjunt, que són un total de 3 i que comença amb ALEJANDRO PACHO CARRILLO i que acaba amb JAUME BARCELO PICORNELL, no han presentat la documentació requerida i es dona per desistida l'ajuda, la qual cosa suposa dur a terme la revocació total de l'ajuda concedida.&lt;/p&gt;

&lt;p&gt;6. L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.&lt;/p&gt;

&lt;p&gt;7. L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/p&gt;

&lt;p&gt;8. Atès tot això, es proposa fer la revocació total a causa de l'incompliment de l'obligació de posar en marxa el pla empresarial com a màxim durant els nou mesos següents de la data de concessió de l'ajuda.&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 14 de desembre de 2023, publicada al BOIB núm. 171 de 19 de desembre de 2023, per la qual es convoquen, mitjançant el procediment anticipat de despesa i per als anys 2023 i 2024, subvencions per a la creació d'empreses de joves agricultors i agricultores.&lt;/p&gt;

&lt;p&gt;2. Ordre 10/2023 de la consellera d'Agricultura, Pesca i Alimentació, de 5 d'abril de 2023, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc de les intervencions per al desenvolupament rural de les Illes Balears 2023-2027.&lt;/p&gt;

&lt;p&gt;3. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Proposta de resolució &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Per tot això, s'informa favorablement i es proposa al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;1. Donar per desistida l'ajuda concedida per la Resolució del vicepresident del FOGAIBA de dia 26 de novembre de 2024, als beneficiaris que s'especifiquen a l'annex d'aquesta resolució, que són un total de 3 i que comença amb ALEJANDRO PACHO CARRILLO i que acaba amb JAUME BARCELO PICORNELL.&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;2. Revocar l'ajuda concedida en la resolució del vicepresident del FOGAIBA de dia de dia 26 de novembre de 2024, corresponent als interessats assenyalats a l'annex adjunt i per l'import indicat en l'annex d'aquesta resolució.&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;3. Declarar conclòs el procediment i arxivar els expedients.&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;4&lt;/span&gt;&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;span style="color:#000000"&gt;Publicar aquesta resolució &lt;/span&gt;&lt;span style="color:#000000"&gt;en e&lt;/span&gt;&lt;span style="color:#000000"&gt;l &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller d'Agricultura, pesca i Medi Natural, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
