Amb l'import concedit i amb les obligacions i compromisos que havien de complir.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.L' apartat desè de la Resolució de la convocatòria estableix les obligacions del beneficiari.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.L'apartat dotzè de la Resolució de la convocatòria estableix que han de realitzar almenys el 50% de la inversió aprovada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.A data d'avui, les persones beneficiàries que figuren a l'annex I no han justificat les inversions objecte de la subvenció pel motiu que es reflexa a l'esmentat annex, per la qual cosa la inversió no pot ser objecte de subvenció.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.Atès tot això, es proposa fer la revocació total a causa de l'incompliment del compromís de realitzar i justificar l'execució de la inversió mínima.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.En relació a les dates de l'Annex I es va notificar, mitjançant publicació al BOIB( BOIB núm. 166 de 18/12/2025), la proposta provisional de revocació total, per incomplir el compromís de realitzar i justificar l'execució de la inversió mínima, concedint-los un termini de 10 dies hàbils per presentar les al·legacions escaients.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:#ffffff">11.A dia d'avui, i una vegada finalitzat el termini, els interessats relacionats a l'annex I adjunt no han presentat al·legacions.</span></span></span></p> <p style="text-align:left"><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fonaments de dret</span></strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="background-color:#ffffff">1.Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per a les inversions no productives vinculades a la realització de compromisos d'agroambient i clima, corresponents a l'any 2024 &nbsp;</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="background-color:#ffffff">2.
