Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per a les inversions no productives vinculades a la realització de compromisos d'agroambient i clima, corresponents a l'any 2024 </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.&nbsp;Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA, va resoldre favorablement la concessió de l'ajuda a favor de BODEGA SON ANTEM SL, entre d'altres, que figuren en l'annex de la Resolució de concessió, R7 de data 19 de maig de 2025, a l'empara (BOIB núm. 66, de 24 de maig de 2025) amb les dades i els imports corresponents (amb un import concedit de 12.000,00 euros).</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. L' apartat desè de la Resolució de la convocatòria estableix les obligacions del beneficiari.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Dins el termini legalment establert, en data 04 d'agost de 2025, l'interessat presenta sol·licitud del pagament total així com la documentació exigida. Un cop analitzada aquesta, i amb la inspecció final de data 01 de setembre de 2025, es comprova que no realitzar tots els metres concedits.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En data 17 de setembre de 2025, l'interessat presenta una memòria justificativa, on explica una modificació a la selecció de marges a rehabilitar.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Atès tot això, es proposa fer la revocació parcial ja que no s'han rehabilitat tot els metres concedits i no s'admet canvis a trams no aprovats inicialment.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. En data 04 de desembre de 2025 el Servei d'Ajudes al Desenvolupament Rural va emetre l'informe proposta provisional de resolució de revocació parcial.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. En data 09 de desembre de 2025 es notifica, mitjançant publicació al BOIB núm. 162, l'esmentada proposta provisional de revocació parcial al interessat, concedint-li un termini de 10 dies per presentar les al·legacions escaients.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. A dia d'avui, i una vegada finalitzat el termini, els interessats relacionats a l'annex I adjunt no han presentat al·legacions.</span></span></span></p> <p><strong><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fonaments de dret</span></span></span></strong></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;En data 17 de novembre de 2015 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 169, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per a les inversions no productives vinculades a la realització de compromisos d'agroambient i clima, corresponents a l'any 2015 a 2019.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></span></p> <p style="text-align:center"><strong><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Informe-Proposta de resolució de revocació parcial</span></span></span></strong></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, s'informa favorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Revocar parcialment l'ajuda concedida al beneficiari, mitjançant la Resolució del vicepresident del FOGAIBA de dia 19 de maig de 2025, per l'import i amb les dades detallades en l'annex d'aquesta resolució, que és un total d'1 expedient i que comença amb BODEGA SON ANTEM SL i acaba amb BODEGA SON ANTEM SL, que suma un import de 969,30 euros (finançat per la CAIB en un 100,00%), relativa a la línia d'ajudes «inversions no productives», atès que no ha realitzat tots els metres concedits, i que no s'admet canvis a trams no aprovats.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Procedir amb el pagament de la resta de l'ajuda d'acord amb l'annex.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.
