&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 15 de desembre de 2025, va signar el següent, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1. Els beneficiaris que figuren a l&amp;apos; annex I se&amp;apos;ls va concedir una ajuda en el marc de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per a les inversions no productives vinculades a la realització de compromisos d&amp;apos;agroambient i clima, corresponents a l&amp;apos;any 2024. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;2. Amb les dates que figuren en els esmentats annex els beneficiaris dins termini presenten la corresponent sol·licitud de pagament.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;3. Amb les dates que figuren en els esmentats annex els beneficiaris van presentar un escrit en el que renunciaven a la sol·licitud de pagament presentada i a la corresponent ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;4. L&amp;apos;article 21.1 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques estableix l&amp;apos;obligació de l&amp;apos;Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l&amp;apos;objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;5. L&amp;apos;article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l&amp;apos;eficàcia de l&amp;apos;acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l&amp;apos;acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;6. Atès tot això, es proposa fer la revocació total a causa de la renuncia de la sol·licitud de pagament i la corresponent ajuda sol·licitada pels beneficiaris .&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per a les inversions no productives vinculades a la realització de compromisos d&amp;apos;agroambient i clima, corresponents a l&amp;apos;any 2024.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;2. Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, relatiu a l&amp;apos;ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;3.&amp;nbsp;Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;4.&amp;nbsp;Reial decret 887/2006, de 21 de juliol, pel qual s&amp;apos;aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;5.&amp;nbsp;Decret legislatiu 2/2005, de 28 de desembre, pel qual s&amp;apos;aprova el Text refós de la Llei de subvencions. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;6.&amp;nbsp;Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;7. Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Proposta de resolució&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Per tot això, s&amp;apos;informa favorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1. Revocar totalment les resolucions d&amp;apos;ajuda concedides a les persones beneficiàries pels imports i amb els terminis detallats:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;- Annex I (anualitat 2024), que són un total de 1 expedient, que comença per SANTA TERESA SRM i acaba amb SANTA TERESA SRM, que suma un import total de 3.876,00 € i amb la següent distribució:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;- 45,00 %&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;CAIB&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;1.744,20&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;-50,00%&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; FEADER&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;1.938,00&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;-5,00%&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; AGE&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;193,80&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;2. Finalitzar el procediment i arxivar els expedients que figuren en l&amp;apos;annex I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;3. Notificar aquesta resolució als interessats.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;4. Contra aquesta Resolució es podrà interposar recurs d&amp;apos;alçada davant del conseller d&amp;apos; Agricultura, Pesca i Medi Natural, en el termini d&amp;apos;un mes, comptador des de l&amp;apos;endemà de la notificació de la resolució, d&amp;apos;acord amb el que s&amp;apos;estableix en l&amp;apos;article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears, i en els articles 121 i 122 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, de règim jurídic de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
