&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 15 de desembre de 2025, va signar el següent, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per a les inversions no productives vinculades a la realització de compromisos d&amp;apos;agroambient i clima, corresponents a l&amp;apos;any 2024 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;2. De conformitat amb l&amp;apos;apartat sisè de l&amp;apos;esmentada Resolució, el termini de presentació de sol·licituds va acabar el di&lt;em&gt; &lt;/em&gt;a 31/05/2024 , i&lt;em&gt; &lt;/em&gt;varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 465 sol·licituds d&amp;apos;ajuda.&lt;em&gt; &lt;/em&gt;&lt;em&gt; &lt;/em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;3. Amb les dates que figuren a l&amp;apos;annex I es varen notificar les Resolucions de concessió als distints beneficiaries que figuren a l&amp;apos;esmentat annex. Amb l&amp;apos;import concedit i amb les obligacions i compromisos que havien de complir.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;4. L&amp;apos; apartat desè de la Resolució de la convocatòria estableix les obligacions del beneficiari.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;5. A data d&amp;apos;avui, les persones beneficiàries que figuren a l&amp;apos;annex I no han justificat les inversions objecte de la subvenció pel motiu que es reflexa a l&amp;apos;esmentat annex, per la qual cosa la inversió no pot ser objecte de subvenció.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;6. L&amp;apos;article 21.1 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques estableix l&amp;apos;obligació de l&amp;apos;Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l&amp;apos;objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;7. L&amp;apos;article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l&amp;apos;eficàcia de l&amp;apos;acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l&amp;apos;acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;8. Atès tot això, es proposa fer la revocació total a causa de l&amp;apos;incompliment de l&amp;apos;obligació de realitzar i justificar les inversions concedides en el termini establert.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;9. En relació a les dates de l&amp;apos;Annex I es va notificar, mitjançant publicació al BOIB( BOIB núm. 136 de 14/10/2025), la proposta provisional de revocació total, per presentar la sol·licitud de pagament fora de termini, i per no acreditar de manera fefaent que la inversió estava efectuada dins el termini establert, concedint-los un termini de 10 dies hàbils per presentar les al·legacions escaients.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;10. A dia d&amp;apos;avui, i una vegada finalitzat el termini, els interessats relacionats a l&amp;apos;annex I adjunt no han presentat al·legacions, o les al·legacions presentades es consideren no admissibles.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1. Ordre del conseller d&amp;apos;Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s&amp;apos;estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;3. Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Informe-Proposta de resolució de revocació total&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Per tot això, s&amp;apos;informa desfavorablement i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1. Procedir a &lt;span style="background-color: rgb(255, 255, 255)"&gt;revocar&lt;/span&gt; totalment les resolucions d&amp;apos;ajuda concedides a les persones beneficiàries pels imports i amb els terminis al annex següent:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;- Annex I (anualitat 2024), que són un total de 3 expedients, que comença per GUSTAVO BLANCO CUBILLAS i acaba amb SON APARETS DE SA TORRE SRM, que suma un import total de 26.070,00&lt;em&gt; &lt;/em&gt;€ i amb la següent distribució:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-left: 40px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;- 100,00 %&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;CAIB&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;&amp;nbsp;&lt;span style="background-color: rgb(255, 255, 255)"&gt;26.070,00&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. Deixar sense efecte les esmentades resolucions de concessió i procedir a arxivar els expedients que figuren a l&amp;apos;annex I.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;3. Notificar aquesta resolució als interessats.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;4. Contra aquesta Resolució es podrà interposar recurs d&amp;apos;alçada davant del conseller d&amp;apos; Agricultura, Pesca i Medi Natural, en el termini d&amp;apos;un mes, comptador des de l&amp;apos;endemà de la notificació de la resolució, d&amp;apos;acord amb el que s&amp;apos;estableix en l&amp;apos;article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears, i en els articles 121 i 122 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, de règim jurídic de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
