&lt;p&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. En data de 11 d&amp;apos;abril de 2024 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 48, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per a l&amp;apos;any 2024, subvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt; 
&lt;p&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. En data de 25 de maig de 2024 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 69, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es modifica la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 26 de març de 2024, per la qual es convoquen, per a l&amp;apos;any 2024, subvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt; 
&lt;p&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l&amp;apos;ajuda a favor de FUNDACIO ROTGER VILLALONGA, entre altres, que figuren en l&amp;apos;annex de la Resolució de concessió RES6 de data 13 de febrer de 2025, (BOIB núm. 23, de 20 de febrer de 2025) amb les dades i els imports corresponents (amb un import concedit de 25.492,99 €).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt; 
&lt;p&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. Atesa la Resolució de concessió de l&amp;apos;ajuda esmentada, i d&amp;apos;acord amb el que estableix l&amp;apos;apartat desè de la convocatòria abans esmentada, els beneficiaris s&amp;apos;obliguen, entre altres, a realitzar les actuacions auxiliades dins del termini establert i mantenir els requisits i les condicions exigibles a què fa referència l&amp;apos;apartat tercer d&amp;apos;aquesta resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt; 
&lt;p&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. Dins el termini legalment establert per a la justificació de les inversions aprovades, les persones interessades presenten la sol·licitud de pagament com també la documentació exigida, però, una vegada examinada aquesta sol·licitud de pagament, i d&amp;apos;acord amb la resolució de la directora general de Medi Natural i Gestió Forestal per la qual s&amp;apos;aprova l&amp;apos;IG055-25, Projecte Tècnic de Gestió de Monts de la finca de Cala Murta, al terme municipal de Pollença, de 27 d&amp;apos;octubre del 2025, es comprova que el total de la superfície sol·licitada pel pagament no és la totalitat de la superfície concedida, atès que la superfície forestal és de 119,07 ha. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

D&amp;apos;acord amb l&amp;apos;apartat onzè de la Resolució de convocatòria abans esmentada, referent a subvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes en els casos en els quals es produeixin desviacions entre la inversió realitzada i l&amp;apos;aprovada, s&amp;apos;ajustarà l&amp;apos;ajuda total concedida a l&amp;apos;import de la inversió realitzada, sempre que la finalitat de la subvenció, atesa la seva naturalesa, sigui susceptible de satisfacció parcial, i sempre que s&amp;apos;acostin de manera significativa al compliment total dels objectius prevists i suposin almenys un 50 % d&amp;apos;execució de la quantitat total d&amp;apos;inversió aprovada a la resolució de concessió inicial. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Aquest ajustament es farà aplicant el percentatge de subvenció que pertoqui a la inversió total justificada. No es reduirà l&amp;apos;import de la subvenció concedida sempre que la inversió executada sigui igual o superior a la màxima auxiliable.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;7. L&amp;apos;article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l&amp;apos;eficàcia de l&amp;apos;acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l&amp;apos;acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Revocar parcialment la resolució d&amp;apos;ajuda concedides a les persones beneficiàries per l&amp;apos;import i amb els terminis detallats que és un total d&amp;apos;1 expedient i que comença i acaba amb FUNDACIO ROTGER VILLALONGA, que suma un import total de 1.678,75 € euros, relativa a la línia d&amp;apos;ajuda “Inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes”, ja que la justificació de la despesa ha estat inferior a l&amp;apos;aprovada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;2. Notificar aquesta proposta provisional de resolució a la persona interessada, mitjançant la publicació en el Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
