&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. En el BOIB núm. 86, de 5 de juliol de 2025, es va publicar la Resolució del director general del Servei de Salut per la qual es va convocar un procés simplificat d'accés o progressió en la carrera professional del personal estatutari dependent del Servei de Salut corresponent als anys 2023, 2024 i 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. En data 22 d'agost de 2025, es van publicar en la web de Carrera Professional les llistes provisionals d'admesos i exclosos d'aquest procés simplificat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;3. Van presentar al·legacions contra l'exclusió de la llista provisional, per no haver pogut finalitzar i enregistrar la sol·licitud, les persones següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;4. Els aspirants fonamentaven les al·legacions en el fet que van iniciar el procediment electrònic de sol·licitud de carrera però no van formalitzar i enregistrar la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;5. Aquestes al·legacions es varen desestimar i es va dictar la Resolució del director general del Servei de Salut de les Illes Balears per la qual s'aproven les llistes definitives d'admesos i exclosos del procés simplificat d'accés o progressió en la carrera professional del personal estatutari dependent del Servei de Salut corresponent als anys 2023, 2024 i 2025 (BOIB núm. 122, de 13 de setembre de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;6. En data 14 d'octubre de 2025, el Jutjat Contenciós Administratiu núm. 4 de Palma va dictar una sentència estimatòria sobre les pretensions de la recurrent en un procediment idèntic a l'actual en el qual se l'havia exclòs de la llista definitiva dels aspirants admesos i exclosos de l'anterior convocatòria extraordinària de carrera professional pel mateix motiu. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Fonaments jurídics&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. L'article 109 de Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (LPAC), estableix que les administracions públiques poden revocar, mentre no hagi transcorregut el termini de prescripció, els seus actes de gravamen o desfavorables, sempre que aquesta revocació no constitueixi dispensa o exempció no permesa per les lleis i no sigui contrària al principi d'igualtat, a l'interès públic o a l'ordenament jurídic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. L'article 110 LPAC estableix els límits a aquesta revisió, que no es pot exercir quan, per prescripció d'accions, pel temps transcorregut o per altres circumstàncies, això sigui contrari a l'equitat, a la bona fe, al dret dels particulars o a les lleis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;3. L'article 69 LPAC estableix que si la sol·licitud d'iniciació no reuneix els requisits que assenyala l'article 66, i, si escau, els que assenyala l'article 67 o altres d'exigits per la legislació específica aplicable, s'ha de requerir a l'interessat perquè repari la falta o adjunti els documents preceptius en un termini de deu dies, amb indicació que, si no ho fa, es considera que desisteix de la seva petició, amb la resolució prèvia que s'ha de dictar en els termes que preveu l'article 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;En virtut d'aquest article, s'hauria d'haver requerit a les persones interessades perquè esmenassin la sol·licitud, cosa que no es va fer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;4. L'article 35.1 LPAC disposa que els actes que es dictin en l'exercici de potestats discrecionals han de ser motivats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;5. La Sentència 102/2025 dictada pel Jutjat Contenciós Administratiu 4 en les actuacions del procediment abreujat núm. 178/2025 estima les pretensions de la recurrent perquè, encara que accepta que no va finalitzar ni signar la sol·licitud, i, per tant, no va finalitzar el procés, considera que aplicant la jurisprudència del Tribunal Suprem, se li hauria d'haver donat la possibilitat d'esmena per mitjà del tràmit previst en l'article 68 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;6. La Sentència 954/2022, de 7 de juliol, del Tribunal Suprem, citada en el fonament jurídic segon, va establir el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Sería sumamente difícil —por no decir imposible— argumentar que la previsión legal del carácter subsanable de la omisión de firma en las solicitudes no es aplicable a las solicitudes presentadas por vía electrónica. Ello vale igualmente para aquellas omisiones que, sin referirse a la firma electrónica propiamente dicha, afectan a la «acreditación de la autenticidad de la voluntad» del solicitante, como podría ser el paso final de validar lo formulado y enviado por vía electrónica.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;7. L'article 51 LPAC preveu que l'òrgan que anul·li les actuacions ha de disposar sempre la conservació dels actes i tràmits el contingut dels quals s'hauria mantingut igual si no s'hagués comès la infracció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. Revocar parcialment la llista definitiva dels aspirants admesos i exclosos del procés simplificat d'accés o progressió en la carrera professional del personal estatutari dependent del Servei de Salut corresponent als anys 2023, 2024 i 2025 (BOIB núm. 122, de 13 de setembre de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. Retrotreure el procediment simplificat convocat per la Resolució del director general del Servei de Salut de les Illes Balears al tràmit d'al·legacions a la llista provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;3. Estimar les al·legacions presentades pels aspirants que s'indiquen a continuació i, en conseqüència, requerir-los que en un termini de deu dies esmenin la sol·licitud manifestant la voluntat expressa de signar i finalitzar el procés: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Conservar la resta d'actes i de tràmits del procediment, de conformitat amb l'article 51 LPAC.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;5. Notificar aquesta resolució a les persones interessades i als serveis administratius que n'han de donar compliment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Contra aquesta resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant l'òrgan que la dicta en el termini d'un mes comptador de l'endemà de la publicació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
