En data de 11 d'abril de 2024 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 48, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per a l'any 2024, s<span style="color:#000000">ubvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">2. </span>En data de 25 de maig de 2024 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 69, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es modifica la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 26 de març de 2024, per la qual es convoquen, per a l'any 2024, subvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor de CRISTÒFOL BARCELÓ LLULL, entre altres, que figuren en l'annex de la Resolució de concessió RES2 de data 23 de gener de 2025, (BOIB núm. 11, de 23 de gener de 2025) amb les dades i els imports corresponents (amb un import concedit de 18.280,00 €).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, els beneficiaris s'obliguen, entre altres, a realitzar les actuacions auxiliades dins del termini establert i mantenir els requisits i les condicions exigibles a què fa referència l'apartat tercer d'aquesta resolució.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. D'acord amb l'apartat onzè de la Resolució de convocatòria abans esmentada, referent a subvencions per a <span style="color:#000000">inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes</span> en els casos en els quals es produeixin desviacions entre la inversió realitzada i l'aprovada, s'ajustarà l'ajuda total concedida a l'import de la inversió realitzada, sempre que la finalitat de la subvenció, atesa la seva naturalesa, sigui susceptible de satisfacció parcial, i sempre que s'acostin de manera significativa al compliment total dels objectius prevists i suposin almenys un 50 % d'execució de la quantitat total d'inversió aprovada a la resolució de concessió inicial. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%">Aquest ajustament es farà aplicant el percentatge de subvenció que pertoqui a la inversió total justificada. No es reduirà l'import de la subvenció concedida sempre que la inversió executada sigui igual o superior a la màxima auxiliable.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%">7. L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Notificar aquesta proposta provisional de resolució a la persona interessada, mitjançant la publicació en el BOIB, i informar-la que disposa d'un termini màxim de 10 dies hàbils, comptadors des de l'endemà a la publicació d'aquesta proposta per presentar al·legacions.
