    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per acord de Ple de 9 d'octubre de 2025 el Ple del Consell Insular de Mallorca va aprovar definitivament el reglament pel qual es regula l'ús de la marca de garantia "Moda Artesana de Mallorca", que fou publicat al BOIB núm. 138, de 18 d'octubre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquesta marca té com a objectiu principal promoure i protegir la producció artesana del sector de la moda a Mallorca, reforçar-ne alhora la qualitat, l'origen i l'autenticitat, i també permetre que qualsevol persona o empresa que compleixi amb els requisits tècnics i de procedència pugui adherir-s'hi, sense que es reservi l'ús de la marca a determinats productors, per garantir-ne la diferenciació respecte de productes industrials o forans. Aquesta marca també cerca consolidar la identitat cultural de Mallorca i promoure el desenvolupament sostenible del sector.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'article 7 del reglament estableix que la sol·licitud d'autorització d'ús s'ha de presentar al departament competent en matèria d'artesania a través del Registre electrònic del Consell Insular de Mallorca, en els termes que regula la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'apartat quart de l'article 66 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, disposa que les administracions públiques han d'establir models i sistemes de presentació massiva que permetin als interessats presentar les seves sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquests models estaran a disposició dels interessats a les corresponents seus electròniques i a les oficines d'assistència en matèria de registres de les administracions públiques. Per la seva banda, l'apartat 6 estableix que quan l'Administració en un procediment concret estableixi expressament models específics de presentació de sol· licituds, aquests seran d'ús obligatori pels interessats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;D'acord amb les competències que li són pròpies en matèria d'artesania, segons es disposa al decret de presidència pel qual s'estableixen les competències dels departaments del Consell Insular de Mallorca (BOIB núm. 106, de 29 de juliol de 2023; BOIB núm. 136, de 5 d'octubre de 2023; BOIB núm. 128, de 28 de setembre de 2024; BOIB núm. 131, de 5 d'octubre de 2024, BOIB núm.25, de 25 de febrer de 2025; BOIB núm. 94, de 17 de juliol de 2025; BOIB núm. 97, de 24 de juliol de 2025), així com a l'article 33 de la Llei 4/2022, de 28 de juny, de consells insulars, la vicepresidenta primera i consellera executiva de Cultura i Patrimoni dicta la següent &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;RESOLUCIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Aprovar el model de sol·licitud d'ús de la marca Moda Artesana de Mallorca que s'inclou a l'annex d'aquesta resolució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;3&amp;nbsp; &amp;nbsp;Que adjunt els documents que s'hi requereixen i que es relacionen al final d'aquest imprès.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Que, una vegada comprovats els requisits establerts a la normativa, se m'atorgui l'ús de la marca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;INFORMACIÓ SOBRE PROTECCIÓ DE DADES PERSONALS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;1. Les dades que contingui la sol·licitud d'admissió, la documentació que s'hi adjunti o la documentació que es generi a partir d'aquest tràmit, s'incorporen en un fitxer de dades personals, inscrit en l'Agència Espanyola de Protecció de Dades, del qual és responsable el Consell Insular de Mallorca. Aquest fitxer serveix, per una banda, per concedir l'autorització d'us prevista, per tal d'assolir els objectius i les finalitats recollits en el reglament corresponent, i si n'és el cas, per dur a terme la tramitació de la resta d'actuacions indicades al reglament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;2. Cessions de les dades previstes: les publicacions previstes (BOIB, tauler d'anuncis del Centre Cultural la Misericòrdia, pàgina web del Consell de Mallorca,&lt;span style="color:null"&gt; www.conselldemallorca.net); &lt;/span&gt;segons el que preveu en relació amb la publicació dels actes administratius l'article 45.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1 Els subjectes als quals fan referència els apartats 2 i 3 de l'article 14 de la Llei 39/2015, d'1 d'octubre, estan obligats a relacionar-se a través de mitjans electrònics amb les administracions, per la qual cosa, de conformitat amb el que estableix l'article 68.4 de la Llei esmentada, si algun d'aquests subjectes presenta la sol·licitud presencialment, l'Administració Pública ha de requerir-li que ho faci mitjançant el Registre Electrònic del Consell Insular de Mallorca o de l'organisme dependent que correspongui. A aquest efecte, ha de considerar-se que la sol·licitud s'ha presentat en la data de la seva presentació electrònica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Els requisits necessaris per obtenir l'autorització d'ús de la marca són:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1. Disposar de la carta d'artesà o artesana (CA), la carta de mestre artesà o mestra artesana (CMA) o el document de qualificació artesanal (DQA), que hagi expedit el Consell Insular de Mallorca, en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. Desenvolupar la producció majoritàriament a Mallorca, garantint que com a mínim un 75 % del procés productiu, incloent-hi el disseny, tingui lloc a l'illa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;3.&amp;nbsp; Elaborar productes amb el seu nom o amb una marca de la seva titularitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;4. Crear productes que compleixin els estàndards de qualitat i autenticitat especificats en aquest Reglament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;5. Els productes han de ser manufacturats pels artesans o artesanes sol·licitants o en tallers dirigits pels artesans o artesanes sol·licitants, sense poder subcontractar el gruix de la producció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;6. Operar sota una estructura legal i estar degudament registrat o registrada en les activitats econòmiques corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

La memòria ha de mostrar el procés i tècniques artesanals que es segueixen per produir al manco una de les peces, que acrediti que es compleix amb els requisits indicats al reglament pel que fa a representativitat, diferenciació, ús dels materials, sostenibilitat i tècniques artesanals. A més és important acreditar gràficament l'espai on es desenvolupa l'activitat pel que fa a ser visitable i a complir amb la resta de normativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;Llistat amb fotografies dels productes pels que es sol·licita l'ús de la marca. El llistat ha d'acreditar quins són els productes que es volen deixar subjectes a la marca. Si bé el caràcter artesà fa que cap peça sigui igual, sí que el llistat ha de servir de referència per controlar l'ús que es fa de la marca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Complir els estàndards de qualitat i autenticitat indicats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- No subcontractar més del 25 % de la producció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Estar donat/da d'alta als registres fiscals i complir amb la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;3.Que els productes objecte de la marca compleixen amb els criteris de l'article 6 del Reglament: representativitat, coherència, diferenciació, ús de materials sostenibles, tècniques artesanals, innovació, sostenibilitat i disposar d'un espai visitable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;4.&amp;nbsp;Que conec i accept els drets i obligacions establerts als articles 12 i 13, i en particular esm compromet a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Garantir el compliment permanent dels requisits tècnics i de qualitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Permetre inspeccions o controls per part del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Estar al corrent de les obligacions tributàries, laborals i amb la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Informar qualsevol canvi en els processos productius o en la titularitat de l'empresa en el termini establert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Mantenir la coherència i l'ús correcte del distintiu segons el Manual d'Identitat de la marca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;5.Que accept el règim de control i seguiment establert a l'article 14 del Reglament, i em compromet a facilitar tota la informació, documentació i visites d'inspecció que se'm puguin requerir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;6.&amp;nbsp;Que soc conscient que l'incompliment de les obligacions pot comportar la suspensió o revocació de l'autorització d'ús de la marca, d'acord amb el que estableix l'article 16 del Reglament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;7.&amp;nbsp; Que em compromet a mantenir el compliment de totes les condicions i requisits durant tota la vigència de l'autorització d'ús de la marca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
