Objecte</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament d'Artà posa en marxa la campanya “RegalArtà, sempre al meu equip” per incentivar que les compres de Nadal es duguin a terme al municipi d'Artà.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La campanya es desenvolupa mitjançant el lliurament de cupons “Rasca i guanya”, una part dels quals conté premis consistents en descomptes de 10&nbsp;€ a bescanviar, exclusivament, a l'establiment que figura en el cupó.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">2. Import i crèdit pressupostari</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per a les subvencions que regulen aquestes bases es destina un import màxim de 4.000 €, amb càrrec a la partida 01 4301 48031 01<strong><span style="background-color:null"> </span></strong>del pressupost municipal de 2025. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La quantia total s'ha de repartir en forma de cupons premiats i de manera proporcional entre tots els establiments participants que s'adhereixin a la campanya, amb un màxim de 200&nbsp;€ cada un (20 bons premiats per establiment). </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament d'Artà ha d'efectuar el pagament de forma anticipada dins aquest any als establiments que s'hagin adherit a la campanya. Posteriorment, els beneficiaris han de justificar els cupons premiats canviats efectivament dins el període de validesa. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">3. Participants</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Hi poden participar les persones físiques i jurídiques privades amb establiment comercial a Artà o a la Colònia de Sant Pere oberts els mesos de novembre, desembre i gener, i que es dediquin al sector del comerç com a activitat econòmica principal.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Queden exclosos de participar-hi, els establiments següents:</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els que tenguin aquestes activitats com a principals: construcció, ferreteria, farmàcia, alimentació, benzineres, cases d'apostes, estancs i administracions de loteria. </span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les grans superfícies i supermercats.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les franquícies.</span></span></span></span></li> </ul> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per poder adherir-s'hi, els establiments han de presentar una declaració responsable (annex&nbsp;3) on manifestin el següent:</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Que es troben al corrent de les seves obligacions tributàries amb les administracions públiques i amb la Seguretat Social.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Que no es troben incursos en cap de les prohibicions per obtenir la condició de beneficiari que estableix l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Que disposen d'establiment obert al públic al municipi i compleixen els requisits de participació.</span></span></span></span></li> </ul> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">4. Terminis i funcionament</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El termini per adherir-se a la campanya és de 10 dies hàbils comptadors des de l'endemà de la publicació d'aquestes bases en el </span><em><span style="background-color:null">Butlletí Oficial de les Illes Balears</span></em><span style="background-color:null"> (BOIB).</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">Els establiments interessats han de presentar les sol·licituds en el Registre General de l'Ajuntament d'Artà o a través de la Seu Electrònica (https://seu.arta.cat), mitjançant l'annex 1 (sol·licitud d'adhesió a la campanya “RegalArtà, sempre al meu equip”), que estarà disponible a l'Ajuntament i a la web municipal.</span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Una vegada acceptada la sol·licitud, l'Ajuntament ha d'abonar de manera anticipada l'import de la subvenció corresponent als cupons premiats que atorgarà a cada establiment, així com el material propi de la campanya: </span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Cartelleria pròpia.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Adhesius per tancar bosses.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Cupons “Rasca i guanya”. </span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Cintes per a mòbil amb el distintiu de l'Ajuntament, que els establiments regalaran a la seva clientela com a obsequi promocional vinculat a la campanya. </span></span></span></span></li> </ul> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La cartelleria, els adhesius i els cupons “Rasca i guanya” seran lliurats gratuïtament a l'Ajuntament d'Artà per la Cambra de Comerç.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El comerç adherit a la campanya ha d'entregar un cupó “Rasca i guanya” a cada client que efectuï una compra superior a 30&nbsp;€, i ho ha de fer de forma correlativa sense discriminació alguna.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els cupons premiats només es poden bescanviar en l'establiment indicat i dins del període de validesa, que és del 10 de desembre de 2025 al 10 de gener de 2026. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el termini d'un mes, comptador a partir de l'endemà de finalització de la campanya, els establiments han de justificar els cupons premiats canviats. Un cop revisada la documentació justificativa presentada, en el cas que l'informe tècnic sigui desfavorable, total o parcialment (per presentació fora de termini o per no haver bescanviat la totalitat dels cupons premiats), l'Ajuntament d'Artà ha de revocar la subvenció i l'entitat ha de reintegrar els fons lliurats mitjançant la tramitació del procediment de reintegrament corresponent. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">5. Documentació específica a presentar</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Juntament amb la sol·licitud d'adhesió (annex 1), s'ha de presentar la documentació següent:</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Fotocòpia del DNI de la persona sol·licitant o representant legal.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Fotocòpia del CIF de l'establiment o empresa (si escau).</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Document acreditatiu de la representació legal (si escau).</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Certificat de titularitat del compte bancari on s'ha d'ingressar l'import de la subvenció (o annex 2).</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Declaració responsable amb la qual es manifesta que l'establiment compleix els requisits de l'article 13 de la Llei&nbsp;38/2003 i està al corrent de les seves obligacions tributàries i amb la Seguretat Social (annex 3).</span></span></span></span></li> </ul> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">6. Procediment de concessió</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El procediment és de concurrència no competitiva, segons l'article 22.2.</span><em><span style="background-color:null">c)</span></em><span style="background-color:null"> de la Llei general de subvencions, atès que l'ordre d'adhesió no altera la quantia assignada i tots els comerços que compleixin els requisits rebran els mateixos materials i condicions.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La concessió es fa mitjançant acord de la Junta de Govern Local, després de comprovar que es compleixen els requisits.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">7. Justificació</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els establiments participants han de justificar la seva participació en la campanya i els cupons premiats canviats mitjançant la presentació de la documentació següent:</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Annex 4 emplenat degudament, amb la relació detallada dels cupons premiats canviats durant el període de validesa de la campanya (del 10 de desembre de 2025 al 10 de gener de 2026).</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Còpia o fotografia llegible de cada cupó premiat, acompanyada del tiquet de compra corresponent en què consti l'aplicació del descompte.</span></span></span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">La documentació justificativa s'ha de presentar en el Registre General de l'Ajuntament d'Artà o a través de la Seu Electrònica (https://seu.arta.cat) en el termini màxim d'un mes comptador des de l'endemà de la finalització de la campanya.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La presentació de la justificació implica que l'establiment declara que els cupons i tiquets presentats corresponen a compres reals realitzades dins el període de vigència de la campanya i que no han estat objecte de cap altra subvenció o ajuda pública.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament d'Artà pot efectuar comprovacions o verificacions per assegurar la veracitat de la documentació presentada i requerir esmenes o aclariments, si escau.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La manca de presentació de la justificació en el termini establert comporta la pèrdua del dret al cobrament de la subvenció.</span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">8. Pagament de la subvenció</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El pagament s'ha d'efectuar de manera anticipada per transferència bancària, un cop l'òrgan competent ha acordat la concessió de la subvenció als establiments adherits a la campanya.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">9. Obligacions dels establiments participants</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones o entitats adherides es comprometen a:</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Exhibir la cartelleria i els adhesius oficials de la campanya.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Regalar les cintes per a mòbil facilitades a la clientela que participi en la campanya.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Fer una publicació a les seves xarxes socials per informar que hi participen, etiquetant @artacelobert.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Col·laborar en les actuacions de comprovació que pugui efectuar l'Ajuntament.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Presentar la declaració responsable (annex 3) com a prova suficient del compliment dels requisits d'idoneïtat i obligacions legals.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Presentar l'annex 4 per a la justificació i el pagament.</span></span></span></span></li> </ul> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">10. Compatibilitat amb altres ajudes</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La participació en aquesta campanya és compatible amb altres programes municipals o subvencions, sempre que no es financi dues vegades la mateixa despesa o actuació.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">11. Drets d'imatge</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones propietàries dels establiments comercials han de cedir els drets d'imatge a l'Ajuntament d'Artà per poder fer difusió de la campanya en el format que l'Ajuntament cregui oportú.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">12. Normativa d'aplicació</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les subvencions objecte d'aquesta convocatòria es regeixen pel que disposen les bases anteriors; la Llei 38/2003, de 17 de novembre, general de subvencions (BOE núm. 276, de 18/11/2003); el Reglament municipal regulador de subvencions, aprovat pel Ple de l'Ajuntament d'Artà; la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques; i la resta de normativa que hi sigui d'aplicació, així com, en matèria de protecció de dades personals, el Reglament (UE) 2016/679, del Parlament Europeu i del Consell de 27 d'abril de 2016, relatiu a la protecció de les persones físiques pel que fa al tractament de dades personals (RGPD), i la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades i garantia dels drets digitals (LOPDGDD).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">13. Acceptació de les bases</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La presentació de la sol·licitud per participar en la campanya “RegalArtà, sempre al meu equip” implica l'acceptació d'aquestes bases. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Així mateix, qualsevol imprevist ha de ser resolt pel personal tècnic de l'Ajuntament.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per a més informació, s'ha de contactar amb el Departament de Promoció Econòmica (promocioeconomica@arta.cat — 971 82 95 95).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">14. Protecció de dades</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament d'Artà és el responsable del tractament de les dades personals que s'hagin de presentar amb la finalitat de tramitar el procediment de concessió de subvencions per dur a terme la campanya “RegalArtà, sempre al meu equip” corresponent a l'any 2025, així com per la seva gestió, pagament i control. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les dades s'han de conservar mentre puguin presentar-se reclamacions o recursos al procediment esmentat i segons els criteris de política documental i d'arxiu de l'Ajuntament d'Artà. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La base de licitud del tractament és l'article 6.1.</span><em><span style="background-color:null">e</span></em><span style="background-color:null"> del RGPD en compliment d'una missió d'interès públic o l'exercici de potestats públiques, segons el que disposen la Llei&nbsp;7/1985, de 2 d'abril, reguladora de les bases del règim local, la Llei 38/2003, de 17 de novembre, general de subvencions, i la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les dades personals es podran cedir, en acompliment d'una obligació legal, a entitats bancàries per realitzar el pagament, a l'Agència Tributària o organismes de control i fiscalització.
