<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">En data 8 de febrer de 2025 es va publicar en el BOIB núm. 18 la convocatòria d'ajudes de desplaçament per a alumnes de les Illes Balears, empadronats a l'illa de Mallorca, que cursen estudis universitaris a la Unió Europea (UE-27) durant l'any acadèmic 2024-2025.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El dia 9 de juliol de 2025, a les 13:00 hores, va finalitzar el termini de presentació de sol·licituds de les ajudes d'acord amb allò que disposa el punt 7.3 de la convocatòria.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El dia 6 d'agost de 2025 es va publicar l'informe en què es notifiquen els possibles defectes de les sol·licituds o la manca de documentació. Els sol·licitants podien aportar la documentació per esmenar la sol·licitud fins a les 13:00 hores del 19 de setembre de 2025.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La Comissió Avaluadora, reunida el 10 d'octubre de 2025, va motivar l'avaluació i la qualificació de les sol·licituds que preveu l'apartat onzè de la convocatòria, d'acord amb els requisits i els criteris de preferència establerts en la convocatòria. D'aquesta reunió se n'ha estès una acta, que consta a l'expedient. </span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El dia 21 d'octubre de 2025 es va publicar a la pàgina web d'ajudes universitàries de la Direcció General d'Universitats, Recerca i Ensenyaments Artístics Superiors (http://dguni.caib.es) la proposta de resolució del director general d'Universitats, Recerca i Ensenyaments Artístics Superiors per la qual es concedeixen o s'exclouen ajudes de desplaçament per a alumnes de les Illes Balears empadronats a l'illa de Mallorca que cursen estudis universitaris a la Unió Europea (UE-27) durant l'any acadèmic 2024-2025, així com d'autorització i disposició de la despesa, reconeixement de l'obligació i proposta de pagament, relativa a les sol·licituds presentades a la convocatòria, i es va obrir el termini per renunciar i presentar-hi al·legacions.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Una vegada transcorregut el termini de deu dies naturals, i sense haver rebut renúncia expressa, s'entén que s'accepta la proposta de concessió de la subvenció.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El dia 11 de novembre de 2025 es va emetre l'informe amb relació a les al·legacions presentades. Aquest informe consta a l'expedient.</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Les quantitats de les ajudes, així com la determinació de les persones beneficiàries, s'ha fet d'acord amb els criteris establerts en el punt desè de la resolució de la convocatòria.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Les persones beneficiàries es troben al corrent de les obligacions tributàries davant la hisenda estatal i autonòmica, així com de les obligacions amb la Seguretat Social, d'acord amb les declaracions responsables realitzades en les sol·licituds d'ajudes.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">D'acord amb l'apartat catorzè de la convocatòria, en el marc del que preveu l'article 39.7 de la Llei de subvencions, aprovada pel Decret legislatiu 2/2005, de 28 de desembre, la justificació d'aquestes ajudes es produeix pel fet de reunir els requisits per beneficiar-se'n.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">D'acord amb el que estableix l'apartat quinzè de la convocatòria l'import de les ajudes concedides s'ha d'abonar a les persones beneficiàries mitjançant transferència bancària. Aquest pagament s'ha de dur a terme una vegada que s'hagi publicat en el Butlletí Oficial de les Illes Balears la resolució del conseller d'Educació i Universitats de concessió.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Els ajuts que es concedeixin a l'empara d'aquesta convocatòria no es consideren ajuts d'Estat atès que, d'acord amb la Comunicació de la Comissió relativa al concepte d'ajut estatal conformement al que es disposa a l'article 107.1 del Tractat de funcionament de la Unió Europea, les normes sobre ajudes estatals només són d'aplicació quan el beneficiari de la mesura d'ajuda és una empresa. En el cas d'aquesta convocatòria els beneficiaris són els estudiants universitaris.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Figuren a l'annex 2, d'Abril Morey a Zarraga Echevarria, els expedients que no compleixen els requisits de les ajudes de desplaçament per a alumnes de les Illes Balears que han cursat estudis universitaris a la Unió Europea (UE-27) durant l'any acadèmic 2024-2025. Els motius d'exclusió s'indiquen a l'annex 3.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Fonaments de dret</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre (BOIB núm. 196, de 31 de desembre).</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Concedir als sol·licitants que figuren a l'annex 1, d'Abio Buendia a Zapata Mariano, ajudes de desplaçament per a alumnes de les Illes Balears empadronats a l'illa de Mallorca que han cursat estudis universitaris a la Unió Europea (UE-27) durant l'any acadèmic 2024-2025. </span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Les sol·licituds d'aquestes persones compleixen els requisits establerts i presenten completa la documentació exigida en la convocatòria. </span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Autoritzar i disposar una despesa de 1.600,00 €, en concepte d'ajuda de desplaçament per a alumnes de les Illes Balears empadronats a l'illa de Mallorca que han cursat estudis universitaris a la Unió Europea (UE-27) durant l'any acadèmic 2024-2025, a favor de cadascun dels beneficiaris que figuren a l'annex 1 d'aquesta resolució (d'Abio Buendia a Zapata Mariano), amb la distribució per partides pressupostàries dels pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2025 següent:</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Reconèixer l'obligació de l'Administració de la Comunitat Autònoma i proposar el pagament de 1.600,00 €, en concepte d'ajuda de desplaçament per a alumnes de les Illes Balears empadronats a l'illa de Mallorca que han cursat estudis universitaris a la Unió Europea (UE-27) durant l'any acadèmic 2024-2025, a favor de cadascun dels beneficiaris que figuren a l'annex 1 d'aquesta resolució (d'Abio Buendia a Zapata Mariano), amb la distribució per partides pressupostàries dels pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2025 següent:</span></span></span></p>

Els motius d'exclusió s'indiquen a l'annex 3.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears i a la pàgina web d'ajudes universitàries de la Direcció General d'Universitats, Recerca i Ensenyaments Artístics Superiors (http://dguni.caib.es).</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Interposició de recursos</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Universitats en el termini d'un mes comptador des de l'endemà d'haver-se publicat, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El recurs potestatiu de reposició s'entén desestimat si no s'ha resolt i no se n'ha notificat la resolució en el termini d'un mes comptador des de l'endemà d'haver-lo interposat. En aquest cas, resta expedita la via jurisdiccional contenciosa administrativa en els termes que estableix l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Contra aquesta Resolució, també s'hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà d'haver-se publicat, d'acord amb l'article 46 de la Llei 29/1998.</span></span></span></p>
