OBJECTE</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'objecte d'aquestes bases és regular el funcionament i el procediment per a l'explotació de les casetes al Mercat de Nadal 2025-2026 de de Sant Josep de sa Talaia, Sant Jordi de ses Salines i Cala de Bou.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquests mercats de nadal es celebraran als nuclis urbans de Sant Josep i Sant Jordi, del 19 de desembre de 2025 fins al 6 de gener de 2026, amb motiu de les festes de Nadal. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les següents bases estableixen els requisits que han de complir els sol·licitants, la documentació necessària que cal presentar, el procediment i termini de presentació de les sol·licituds, els criteris per a la concessió, així com les obligacions de les persones concessionàries. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2. CASETES, INSTAL·LACIONS</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els mercats de Nadal del municipi de Sant Josep de sa Talaia constaran d'un màxim de 8 casetes de fusta, distribuïdes als diversos nuclis urbans del municipi. S'adjudicaran les parades de la següent manera: </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Mercat de Nadal de Sant Jordi de ses Salines comptarà amb:</strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- 4 casetes de modalitat 1</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- 2 casetes de modalitat 2</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Mercat de Nadal de Sant Josep de sa Talaia comptarà amb 1 caseta.</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Mercat de Nadal de l'Auditori Caló de s'Oli (Cala de Bou) comptarà amb 1 caseta. </strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La distribució de les parades es farà des de l'Ajuntament atenent al que millor convengui per al bon funcionament dels mercats.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Ajuntament s'encarregarà: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Instal·lació elèctrica per al funcionament de les casetes (potència màxima de 2.300 W). </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- 1 taula de pícnic de fusta per a cada caseta adjudicada. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Banys públics i accessibles. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- El manteniment i neteja de la zona de mercat. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La vigilància durant els dies de muntatge i desmuntatge i durant l'horari de desenvolupament de l'activitat serà responsabilitat dels adjudicataris. L'Ajuntament no es farà càrrec ni assumirà cap responsabilitat per possibles pèrdues, danys o robatoris que puguin produir-se durant el període de mercat.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les persones adjudicatàries no podran reclamar cap indemnització a l'Ajuntament per danys o pèrdues que es puguin produir com a conseqüència de les inclemències meteorològiques durant el desenvolupament del Mercat de Nadal. L'adjudicatari és responsable de protegir la seva caseta i els productes objecte de venda davant de possibles fenòmens meteorològics adversos.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3. PERIODICITAT</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els mercats de Nadal ubicats als nuclis urbans de Sant Josep, Sant Jordi i Cala de Bou, es desenvoluparan des del 19 de desembre de 2025 fins al 6 de gener de 2026 amb el següent horari de funcionament serà: </span></span></span></p> <p style="margin-left:40px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- De dilluns a dijous: <strong>horari opcional</strong>, els adjudicataris tendran l'opció d'obrir durant el matí en horari lliure i en horari de tarda de 17.00 a 22.00 hores. </span></span></span></p> <p style="margin-left:40px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Divendres: horari opcional de matí i <strong>horari obligatori de tarda</strong> de 17.00 a 22.00 hores. </span></span></span></p> <p style="margin-left:40px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- De dissabte a diumenge: <strong>horari obligatori </strong>de 12.00 a 22.00 hores. </span></span></span></p> <p style="margin-left:40px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Dates específiques:</span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- 31 de desembre: <strong>horari obligatori </strong>d'11.00 a 16.00 hores, i horari opcional d'obertura fins a les 18.00 hores. </span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Festius 25 i 26 de desembre i1 i 6 de gener: <strong>horari flexible</strong> a voluntat del titular dins franja horària de caps de setmana. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Responsabilitat del titular: els adjudicataris hauran de complir rigorosament els horaris. En cas d'absència o tancament temporal, ho hauran de notificar a l'Ajuntament amb antelació i justificar-ne adequadament el motiu.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els horaris podran ser objecte de modificacions en funció de les necessitats de cobertura del servei o per motius d'interès general. Qualsevol canvi horari haurà de ser comunicat i prèviament aprovat per part de l'Ajuntament.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4. MODALITATS I REQUISITS DELS PARTICIPANTS</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Poden participar-hi: </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Modalitat 1: </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Comerços del municipi de Sant Josep de sa Talaia. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Artesans locals o autònoms de venda al detall.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Establiments de restauració del municipi de Sant Josep de sa Talaia. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Modalitat 2:</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Associacions inscrites en el registre d'associacions municipals que sol·liciten caseta fixa al mercat de Nadal. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta modalitat quedarà exempta de taxes i del compliment de requisits següents.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La distribució i/o calendari de les casetes de Nadal podran ser modificats en funció de les necessitats del mercat. El procediment d'adjudicació queda detallat i especificat a l'apartat número 6.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per prendre-hi part, les modalitats de tipus 1 han de complir els següents requisits: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. Posseir un comerç o un establiment de restauració al municipi de Sant Josep de sa Talaia, o bé ser artesà local o autònom de venda al detall. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. Tenir capacitat jurídica i d'obrar, i que no es trobin en cap causa limitadora de la seua capacitat jurídica i d'obrar que inhabiliti el naixement d'una relació jurídica amb l'Administració. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c. Estar d'alta a l'epígraf corresponent de l'impost d'activitats econòmiques i estar al corrent en el pagament de la tarifa o, en cas d'estar exemptes, estar d'alta al cens d'obligats tributaris.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d. Estar al corrent de pagament amb l'AEAT, ATIB, l'Ajuntament i la Seguretat Social, o autorització a l'Ajuntament perquè es puguin fer les comprovacions oportunes. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5.</strong> <strong>PRESENTACIÓ DE SOL·LICITUDS</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les sol·licituds perprendre part en el procés selectiu per formar part dels mercats de Nadal es presentaran, dins el termini de <strong>CINC (5) DIES HÀBILS</strong>, comptadors a partir del dia següent de la publicació de les bases al tauler d'anuncis del web municipal i en el tauler d'anuncis de la seu electrònica de l'Ajuntament. No s'admetran sol·licituds presentades amb posterioritat a la data anteriorment esmentada.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les sol·licituds es podran presentar:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- Amb certificat digital, a través de la seu electrònica: http://santjosep.sedelectronica.es → Catàleg de tràmits → Tràmits generals → Instància General + pujar fitxer (annexos i documents escanejats).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Sense certificat digital, a través de la resta de formes previstes a l'article 16 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cal sol·licitar participar en la convocatòria de concessió de parades de venda temporal als mercats de Nadal 2025-2026 i adjuntar la documentació que s'assenyala a continuació segons modalitat: </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Modalitat 1: </strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. DNI, NIE, CIF del sol·licitant en vigor. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Model de sol·licitud firmat i datat (annex I).</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Acreditació d'estar d'alta a l'epígraf corresponent de l'impost d'activitats econòmiques i estar al corrent en el pagament de la tarifa o, en cas d'estar exemptes, estar d'alta al cens d'obligats tributaris.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Acreditació d'estar al corrent de pagament amb l'AEAT, ATIB, l'Ajuntament i la Seguretat Social, o autorització a l'Ajuntament perquè es puguin fer les comprovacions oportunes. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Declaració responsable (annex III) en què es manifesti:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Que compleix amb els requisits establerts a les bases reguladores del procediment per a obtenir parades de venda temporal de les festes de Nadal de l'any 2025-2026.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Que compleix amb les condicions exigides per la normativa reguladora del producte o productes objecte de venda.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Que tendrà la documentació que així ho acrediti a partir de l'inici de l'activitat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Que tots els productes oferits al mercat compleixen amb totes les normatives sanitàries i d'etiquetatge que marca la legislació vigent.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Memòria detallada i fotografies dels productes objecte de venda. La no descripció detallada dels productes, juntament amb poca claredat i no aportació de fotografies, donarà lloc a l'exclusió a la sol·licitud de participar. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Annex IV (autobaremació), si escau. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Documents acreditatius dels mèrits, d'acord amb el barem establert en el punt 7 i indicat a l'annex IV d'autobaremació. L'òrgan de selecció no valorarà els mèrits que no s'acreditin juntament amb la instància de sol·licitud i estiguin indicats a l'annex IV per participat en el procés selectiu. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Modalitat 2: </strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Annex IV (autobaremació), si escau. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Documents acreditatius dels mèrits, d'acord amb el barem establert en el punt 7 i indicat a l'annex IV d'autobaremació. L'òrgan de selecció no valorarà els mèrits que no s'acreditin juntament amb la instància de sol·licitud i estiguin indicats a l'annex IV per participar en el procés selectiu. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les persones aspirants han de conservar una còpia segellada i registrada de la sol·licitud, per si els fos requerida en cap moment. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La presentació de la instància implica, als efectes de la Llei orgànica 15/1999, de 13 de desembre, de protecció de dades de caràcter personal, el consentiment dels afectats perquè l'Ajuntament de Sant Josep la utilitzi per a la gestió, i és obligatòria la formalització. Es disposa, en tot cas, dels drets d'accés, rectificació, cancel·lació i oposició en els termes previstos a la legislació vigent i és responsable del fitxer l'Ajuntament de Sant Josep de sa Talaia. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Només es podrà fer una sol·licitud per cada interessat, que donarà opció a un únic lloc de venda. En cas d'haver-hi dos o més sol·licituds, únicament s'atendrà la primera que consti al Registre Municipal, excloent-ne la resta presentades. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La participació en aquesta convocatòria comporta l'acceptació de les presents bases.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.</strong> <strong>PROCEDIMENT D'ADJUDICACIÓ</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Finalitzat el període de presentació de sol·licituds, la llista provisional d'admesos i exclosos al procés selectiu es publicarà en el tauler d'anuncis del web municipal i de la seu electrònica de l'Ajuntament, amb expressió del document nacional d'identitat dels aspirants admesos i exclosos, així com els motius d'exclusió. S'atorgarà un termini de <strong>TRES (3) DIES HÀBILS</strong> per a realitzar les esmenes corresponents, aportar la documentació sol·licitada o formular al·legacions. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les persones sol·licitants, que dins el termini assenyalat no esmenin els defectes justificant el dret a ser admeses, seran definitivament excloses del procés selectiu. Si en el termini d'esmenes es presenten al·legacions o reclamacions, seran estimades o desestimades mitjançant la resolució que aprovi la llista definitiva.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La publicació de la llista definitiva d'admesos i exclosos es farà un cop revisades totes les esmenes i verificant els requisits d'obligat compliment establerts en aquestes bases. L'adjudicació de les casetes es realitzarà mitjançant el concurs de mèrits, considerant exclusivament les sol·licituds definitivament admeses. D'acord amb la llista definitiva, s'elaborarà una llista d'adjudicació segons l'ordre de mèrits, en funció dels resultats obtenguts en el procés de valoració. Així mateix, es constituirà una llista de reserva amb els sol·licitants que, tot i haver estat admesos, no hagin resultat adjudicataris d'una parada.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>7.</strong> <strong>TRIBUNAL QUALIFICADOR </strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Es constituirà una comissió encarregada de valorar l'adequació de les sol·licituds presentades a les estipulacions establertes en aquestes bases. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Tribunal Qualificador quedarà facultat per interpretar aquestes bases, resoldre dubtes i incidències que es plantegin i per prendre els acords necessaris per assegurar el correcte desenvolupament de la convocatòria aprovada en tot el que no estigui previst a les bases. També serà l'encarregat de la revisió de totes les sol·licituds. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>8.</strong> <strong>VALORACIÓ DE MÈRITS (fase de concurs)</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta fase únicament serà aplicable als aspirants que hagin resultat definitivament admesos. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els mèrits que l'òrgan de selecció valorarà a la fase de concurs seran els següents, sempre que hagin estat prèviament acreditats en el termini i condicions establertes a les bases, i s'estructuraran en quatre blocs: antiguitat, mèrits per productes objecte de venda, actuació musical i activitats alternatives.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>8.1. ANTIGUITAT. ACTUACIÓ MUSICAL I ALTRES ACTIVITATS ALTERNATIVES. Màxim 5 punts</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">— Per cada actuació musical proposada perrealitzar dins del calendari del Mercat de Nadal, <strong>1 punt</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">— Per cada activitat alternativa proposada a realitzar dins del calendari del Mercat de Nadal, així com tallers, manualitats, xous o algun altre tipus d'activitat d'oci, <strong>1 punt</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per obtenir la puntuació relativa a l'actuació musical, els sol·licitants han de presentar una proposta artística que inclogui la data i l'horari preferent de realització, així com una factura proforma del caixet de l'artista. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les propostes d'actuacions musicals i activitats alternatives presentades es consideraran un compromís ferm de realització i contractació per part dels sol·licitants, en cas que resultin seleccionades. Només es podran cancel·lar per causes de força major degudament justificades i acreditades davant l'organització.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>9. DOCUMENTACIÓ EN CAS DE RESULTAR ADJUDICATARI</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els adjudicataris hauran de presentar, en un termini màxim de <strong>cinc (5) dies hàbils</strong> des de la publicació de la llista definitiva, el justificant d'haver realitzat el pagament de la taxa d'ocupació. La manca de presentació en termini de la documentació descrita anteriorment s'entendrà com a renúncia a l'autorització per part del titular. En aquest cas, es procedirà a autoritzar el següent sol·licitant de la llista corresponent, en funció de l'ordre establert a la llista de reserva, concedint-li un termini de 5 dies per aportar la documentació abans indicada.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>10. OBLIGACIONS DELS ADJUDICATARIS</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Els adjudicataris hauran de complir el calendari i els horaris establerts en aquestes bases. En cas d'absència o tancament temporal, ho han de notificar a l'Ajuntament amb antelació i justificar-ne adequadament el motiu.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Els adjudicataris estan obligats, sota la seva responsabilitat exclusiva, al compliment de les disposicions vigents en matèria de salut pública, seguretat alimentària, seguretat dels consumidors, laboral, seguretat social, fiscal, prevenció de riscos laborals i de protecció del medi ambient. Així mateix, hauran de donar compliment a tota la legislació sectorial específica que afecti el producte que es vol vendre. L'Ajuntament no assumirà cap responsabilitat respecte de les obligacions laborals existents entre la persona adjudicatària i els seus empleats.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La persona que atengui personalment la caseta haurà de complir les condicions d'higiene i seguretat alimentària que siguin aplicables en cada cas.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Els adjudicataris hauran de tenir exposades, de manera fàcilment visible per al públic, les seves dades personals i el document en què consti la corresponent autorització municipal, així com una adreça per a la recepció de les possibles reclamacions.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. No està permès cedir, vendre o sotsarrendar a terceres persones les autoritzacions per a la venda, atès el seu caràcter personal i intransferible.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Qualsevol necessitat d'ocupació d'espai fora de la caseta es convindrà prèviament amb la organització del mercat. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Es mantindran en perfecte estat de conservació, seguretat, neteja, ornament, salubritat i higiene les instal·lacions, la superfície concedida i els seus voltants, tant durant l'horari d'ocupació com quan finalitzi aquest. No pot quedar cap element a l'exterior de la caseta després del tancament ni fora de l'horari establert. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Els adjudicataris hauran de mantenir la seva caseta decorada i ambientada segons la temàtica nadalenca, tant durant l'horari d'obertura com fora d'aquest. La decoració haurà de ser adequada, segura i respectuosa amb l'espai públic, i contribuir a l'ambient festiu del mercat. L'Ajuntament es reserva el dret de requerir la correcció de qualsevol decoració que no compleixi amb aquests criteris.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Els adjudicataris deixaran lliures de residus la zona o espai ocupat i la seva àrea d'influència i adoptaran les mesures necessàries per evitar que s'embrutin. Les casetes han de disposar de dipòsits o recipients on dipositar els residus que vagin produint per evitar-ne l'expansió.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. Els participants han de fer un ús adequat i correcte de les instal·lacions municipals que es posen a la seva disposició. En cas de deteriorament o destrucció del domini públic local o de les instal·lacions proveïdes per l'Ajuntament per a la celebració del mercat, l'adjudicatari estarà obligat al reintegrament del cost de reparació dels béns danyats.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. Un cop finalitzi el mercat, l'espai públic ha de quedar expedit i en les mateixes condicions que presentava abans de l'ocupació, sense que es pugui al·legar l'existència de desperfectes que no s'hagin posat de manifest a l'inici de l'ocupació.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. En qualsevol moment es podrà fer una visita d'inspecció per part de personal de l'Ajuntament per comprovar el compliment de les condicions establertes en aquestes bases.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13. Segons el que estableix el Reial Decret 1055/2022, de 27 de desembre, d'envasos i residus d'envasos, i per tal de promoure pràctiques sostenibles i reduir l'impacte dels envasos al medi ambient, fomentant-ne la reutilització, durant el Mercat de Nadal totes les begudes es distribuiran en envasos reutilitzables. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Ajuntament proporcionarà 500 gots de plàstic reutilitzables a cada caseta. Aquests gots compliran amb els requisits establerts a la norma europea harmonitzada UNE-EN 13429:2005 “Envasos i embalatges. Reutilització”.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14. Per tal de garantir la recuperació dels gots, s'estableix el sistema de dipòsit següent: Cada got reutilitzable tindrà el cost d'un euro, que s'haurà de cobrar al consumidor en el moment de la venda de la beguda. Quan el got sigui retornat pel consumidor es tornarà 1,00 €.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">15. L'adjudicatari serà el responsable del rentat i de la reutilització dels gots. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">16. En finalitzar el Mercat de Nadal, cadascun dels adjudicataris haurà de retornar els gots reutilitzables restants a l'Ajuntament.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>11. TAXES</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els adjudicataris hauran de fer el pagament de la taxa que estableix a l'Ordenança fiscal reguladora de la taxa de mercats municipals (BOIB, Núm. 134, de 30 de setembre de 2021) de l'Ajuntament de Sant Josep de sa Talaia, fixada en la quantitat de dos-cents quaranta euros (240 €) per caseta adjudicada. </span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les adjudicacions de casetes destinades a associacions del municipi no tindran cap cost, atès que l'Ajuntament assumirà íntegrament l'import corresponent. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El pagament de la taxa es podrà realitzar per Internet, a l'apartat <em>Pagaments online (autoliquidacions) </em>del web</span><a href="http://www.santjosep.org"><span style="color:#000000"> www.santjosep.org</span></a><span style="color:#000000">, seleccionant l'opció ‘Mercats de Nadal'.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>12.
