El 27 de març de 2025, al BOIB Núm. 38 va publicar la resolució de la Presidència de l'IMAS de dia 21 de març de 2025 per la qual es va aprovar la convocatòria dels Premis com als Reconeixements del Consell de Mallorca a l'Acció Social 2025 (K9AA CNYQ TKWD FQKZ F93P).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>2</strong>. El Servei Juridicoadministratiu i la Intervenció Delegada de l'IMAS han emès els informes favorables corresponents per la concessió dels Premis i reconeixements del Consell de Mallorca a l'Acció Social 2025.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000">Consideracions Jurídiques </span></strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- El Ple del Consell de Mallorca, per acord de dia 11 d'abril de 2019, va aprovar els Estatuts de l'Institut Mallorquí d'Afers Socials (BOIB núm. 67 de 18 de maig de 2019). L'article 2.1 dels Estatuts disposa que l'IMAS, té per objecte fonamental l'exercici, en forma directa i descentralitzada, de les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i protecció de menors.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.-</strong> D'acord amb l'article 3 dels Estatuts de l'IMAS, aquest organisme té personalitat jurídica pròpia i la capacitat d'obrar necessària per complir els seus fins. Entre les seves facultats al punt m) d'aquest article 3 es troba la d'atorgar premis.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.- </strong> Aquests premis es troben prevists al Pla Estratègic de Subvencions de l'IMAS de 2025, aprovat per Acord del Consell Executiu (BOIB 167, de 21 de desembre de 2024)</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#0000ff"><span style="color:#000000"><strong>4.- </strong></span><span style="color:#000000">La Disposició Addicional Primera de l'Ordenança general de subvencions del Consell Insular de Mallorca, regula el procediment a seguir per a convocar i concedir Premis per part dels subjectes inclosos dins l'àmbit d'aplicació d'aquesta Ordenança, que són tant el Consell Insular de Mallorca com els organismes autònoms que en depenent.</span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#0000ff"><span style="color:#000000"><strong>5.- </strong></span><span style="color:#000000">Resolució de la Presidència de l'institut Mallorquí d'Afers Socials d'aprovació de la convocatòria dels Premis i Reconeixements del Consell de Mallorca a l'Acció Socials 2025 </span><span style="color:#000000">(</span><span style="color:#000000">BOIB Núm. 38, de 27 de març de 2025</span><span style="color:#000000">)</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>6.</strong>- L'òrgan competent per resoldre la concessió, així com del reconeixements de les obligacions, atesa la Resolució de la Presidència de l'IMAS de</span><span style="color:#000009"> </span>21 de març de 2025 <span style="color:#000009">(</span>BOIB Núm. 38, de 27 de març de 2025<span style="color:#000009">) es la Presidència de l'Institut Mallorquí d'Afers Socials.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000009"><strong>7.- </strong></span><span style="color:#000000">La Llei 39/2015, d'1 octubre, del procediment administratiu comú de les administracions públiques (BOE&nbsp;núm.&nbsp;236, de 2 d'octubre de 2015) preveu els supòsits per donar per desistida una sol·licitud així com la obligació de resoldre de la administració.</span><span style="color:#000009"> </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>8.</strong>- La notificació es preveu mitjançant la publicació al BOIB i al Tauler d'anuncis de l'IMAS. No obstant, aquesta publicació es realitzarà una vegada realitzat el lliurament dels Premis del Consell de Mallorca a l'Acció Social 2025, que tindrà lloc el dia 30 d'octubre de 2025 al Teatre Principal.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>9</strong>. Aquest expedient comporta despesa, per això de conformitat a l'article 214 del Reial Decret Legislatiu 2/2004, de 5 de març, pel qual s'aprova el Text refós de la Llei reguladora de les Hisendes Locals, i atès l'acord d'aprovació del règim de fiscalització i intervenció limitada prèvia de requisits bàsics i presa de raó en ingressos del Consell Insular de Mallorca i de les entitats del seu sector públic subjectes a funció interventora de data 12 de desembre de 2019, l'expedient ha de ser sotmès a la Intervenció delegada de l'IMAS per a l'emissió del preceptiu informe de fiscalització prèvia (BOE núm. 59 de 9 de març de 2004).</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
