    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès que el Consell Executiu d'aquest Consell Insular, en sessió de caràcter ordinari de 16 de desembre de 2024, va aprovar la convocatòria dels ajuts de minimis per a la creació en arts visuals i projectes audiovisuals i de la convocatòria per a l'any 2024 (BOIB núm. 13, de 28 de gener de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vist que el termini de presentació de sol·licituds va finalitzar dia 28 de març de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès que un cop revisada la documentació dels sol·licitants per la instructora de la convocatòria, s'han convocat les dues comissions avaluadores previstes en la convocatòria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista l'acta de la comissió avaluadora de les línies 1 a 4, reunida el 18 d'agost de 2025. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista l'acta de la comissió avaluadora de la línia 5, reunida el 2 de setembre de 2025. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la nota jurídica amb data 7 d'octubre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès que la convocatòria preveu un pressupost de 10.000 € per a les línies 1, 2 i 4, de 15.000 € per a la línia 3 i de 45.000 € per a la línia 5.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès que en el cas que no s'esgoti la consignació pressupostària d'una línia, la quantitat sobrant s'assignarà a una de les altres línies d'ajuts per l'ordre de preferència següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Investigació 2. Formació 3. Producció d'obra 4. Producció d'exposicions i 5. Projectes audiovisuals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la proposta de la instructora de la convocatòria que consta en l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès que la interventora accidental ha fiscalitzat favorablement la concessió dels ajuts, mitjançant signatura de la proposta de la instructora. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès que l'article 33.2.K de la Llei 4/2022, de 28 de juny, de consells insulars, estableix com a atribució dels consellers executius resoldre les convocatòries d'ajudes i subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Com a titular del Departament de Cultura, Educació, Joventut i Esports, en exercici de les competències atribuïdes per l'article 33 de la Llei 4/2022, de 28 de juny, de consells insulars, en relació amb el Decret de presidència núm. 91/2023 de 10 de juliol, de creació dels departaments (BOIB núm. 95 d'11 de juliol de 2023);&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESOLC&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;MOTIU: La comissió avaluadora ha revisat aquest projecte, i després de valorar-lo segons els requisits de la convocatòria, ha valorat que no arriba a la puntuació mínima de 10 punts, requerida al punt 7 A) de les bases, pel que fa a la qualitat de la proposta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercer.&lt;/strong&gt; Desestimar l'ajut a la següent sol·licitud de projecte d'investigació artística (línia 1) corresponent a l'any 2024 pel motiu que s'especifica:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SOL·LICITANT: Núria Marquès Marroquín&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;MOTIU: La sol·licitant presenta una instància genèrica, però no aporta la documentació requerida d'acord amb les bases de la convocatòria. Amb data 19 de juny de 2025, la instructora de la convocatòria requereix a la sol·licitant que esmeni la sol·licitud. Passat el termini de deu dies hàbils, comptats des de l'endemà d'haver rebut el requeriment d'esmena de la sol·licitud, la persona interessada no ha presentat la documentació requerida. Per tant, s'entén que ha desistit de la seva petició de conformitat amb l'article 68 de la Llei 39/2015. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'import total concedit de la línia 1 és de 10.000 €. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quart.&lt;/strong&gt; Concedir els ajuts a les següents sol·licituds per a projectes de formació artística (línia 2) corresponents a l'any 2024 que seguidament es relacionen:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Si aquest import és inferior a un 50% del pressupost del projecte, la Comissió Avaluadora podrà proposar destinar-lo a una altra línia d'ajuts d'acord amb les condicions que es prevegin en la convocatòria».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Dotzè.&lt;/strong&gt; La resolució de l'expedient de concessió o denegació dels ajuts es remetrà a la Base de Dades Nacional de Subvencions, en compliment de l'art. 20.8 b de l'LGS i es publicarà en el Butlletí Oficial de les Illes Balears i en el web del Consell Insular de Menorca www.cime.es, i hi figuraran les dades identificatives de les persones interessades. La publicació en el BOIB té els efectes de notificació d'acord amb l'art. 45.1 b de l'LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquest acord – que no exhaureix la via administrativa – es pot interposar un recurs d'alçada davant el Consell Executiu en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'esmentat recurs s'entendrà desestimat, si no es notifica la resolució corresponent, quan hagin transcorregut tres mesos des de la seva interposició. Contra la desestimació del recurs d'alçada per silenci administratiu podreu interposar recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
