&lt;p&gt;1. En data de 21 de desembre de 2021 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 174, la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, mitjançant el procediment anticipat de despesa, subvencions per a inversions a les explotacions agràries per l'any 2021.&lt;/p&gt;

&lt;p&gt;2. El 12 d'abril de 2024, el vicepresident en matèria agrària del FOGAIBA va dictar una Resolució de concessió d'ajudes per a inversions a les explotacions agràries, que es va publicar al Butlletí Oficial de les Illes Balears número 52, del 20 d'abril de 2024, en la qual hi figurava una concessió a favor de l'interessat assenyalat a l'annex adjunt.&lt;/p&gt;

&lt;p&gt;3.El 21 de maig de 2024, l'interessat MIGUEL NADAL VIDAL PERELLÓ, amb NIF ***7363**, amb registre d'entrada núm. GOIBE260958/2025, va presentar, dins el termini legalment establert per a la justificació de les inversions aprovades, la sol·licitud de pagament, com també la documentació exigida.&lt;/p&gt;

&lt;p&gt;4.El 23 de setembre de 2025 s'emet l'informe de moderació de costs en el qual s'indica que l'import de la inversió és d'un total de 136.228,43 €.&lt;/p&gt;

&lt;p&gt;5.La inversió inicialment aprovada era de 143.799,43 €, hi ha una diferència de 7.571,00 € i per tant s'han de revocar 3.785,50 € d'ajuda.&lt;/p&gt;

&lt;p&gt;6.El dia 25 de setembre de 2025, es publica a la web del FOGAIBA l'informe proposta provisional de resolució de la revocació parcial per moderació de costs de l'expedient INEA2021_1_049 amb un avís amb l'enllaç per SMS.&lt;/p&gt;

&lt;p&gt;7.Que el beneficiari, finalitzat el termini màxim de 10 dies hàbils del que disposava, no ha presentat al·legacions contra l'informe proposta provisional de resolució parcial.&lt;/p&gt;

&lt;p&gt;8. Atès tot això, es proposa fer la revocació parcial de l' ajuda concedida al beneficiari com s'indica en l'annex adjunt d'aquesta resolució.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fonaments de dret&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;1&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries.&lt;/p&gt;

&lt;p&gt;2. Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/p&gt;

&lt;p&gt;3. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Proposta de resolució&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, s'informa favorablement i es proposa al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;Revocar parcialment l'ajuda concedida &lt;/span&gt;al beneficiari detallat a l'annex adjunt, que és un total d'1 expedient, que comença i acaba per &lt;span style="display:inline-block"&gt;&lt;span style="background-color:#ffffff"&gt;MIGUEL NADAL VIDAL PERELLÓ, amb&lt;/span&gt; NIF ***7363&lt;span style="background-color:#ffffff"&gt;** &lt;/span&gt;&lt;/span&gt;(exp. INEA2021_1/049), per un import de &lt;span style="display:inline-block"&gt;&lt;span style="background-color:#ffffff"&gt;3.785,50&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;€&lt;/span&gt;&lt;/span&gt;, i que correspon al finançament FEADER, AGE i CAIB.&lt;span style="background-color:#ffffff"&gt;.&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;2.&amp;nbsp;&lt;/span&gt;&lt;span style="display:inline-block"&gt;Notificar aquesta resolució a la persona beneficiària mitjançant la publicació al Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposició de recursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller d' Agricultura, Pesca i Medi Natural, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/p&gt;
