    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La convocatòria d'ajudes especifica que les comunicacions i les notificacions es realitzaran a les persones interessades mitjançant la seva publicació al &lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;d'acord amb els termes que preveu la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La cap del Servei d' Ajudes al Desenvolupament Rural del FOGAIBA, en data 8 d' octubre de 2025, va signar el següent, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;“ &lt;strong&gt;INFORME/ PROPOSTA PROVISIONAL DE RESOLUCIÓ DE REVOCACIÓ TOTAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1.En data 18 d'abril de 2024 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 51, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per a les inversions no productives vinculades a la realització de compromisos d'agroambient i clima, corresponents a l'any 2024.&lt;/p&gt;

&lt;p&gt;2.De conformitat amb l'apartat sisè de la Resolució esmentada, el termini per presentar les sol·licituds va acabar el dia 31 de maig de 2024.&lt;/p&gt;

&lt;p&gt;3.Amb les dates que figuren a l'annex I es varen notificar les Resolucions de concessió als distints beneficiaries que figuren a l'esmentat annex. Amb l'import concedit i amb les obligacions i compromisos que havien de complir.&lt;/p&gt;

&lt;p&gt;4.L' apartat dotzè de la Resolució de la convocatòria estableix que el termini per notificar i justificar la realització de les inversions acabava el 14 d'agost de 2025.&lt;/p&gt;

&lt;p&gt;5.A data d'avui, les persones beneficiàries que figuren a l'annex I, tot hi haver presentat la sol·licitud de pagament, no han justificat ni acreditat de manera indubtable qua la inversió estava efectuada dins el termini establert, es a dir, abans del 14 d'agost de 2025, per la qual cosa la inversió no pot ser objecte de subvenció.&lt;/p&gt;

&lt;p&gt;6.L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.&lt;/p&gt;

&lt;p&gt;7.L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/p&gt;

&lt;p&gt;8.Atès tot això, es proposa fer la revocació total a causa de l'incompliment de l'obligació de realitzar i justificar les inversions concedides en el termini establert.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;2. Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/p&gt;

&lt;p&gt;3. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Proposta de resolució de revocació total&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Per tot això, es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents.&lt;/p&gt;

&lt;p&gt;1. Procedir a revocar totalment les resolucions d'ajuda concedides a les persones beneficiàries pels imports i amb els terminis al annex següent:&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;a)Annex I (anualitat 2024), que són un total de 3 expedients, que comença amb GUSTAVO BLANCO CUBILAS i acaba amb SON APARETS DE SA TORRE SRM, que suma un import total de 26.070,00 € i amb la següent distribució:&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;100,00% CAIB 26.070,00 €&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;2. Deixar sense efecte les esmentades resolucions de concessió i procedir a arxivar els expedients que figuren a l'annex I.&lt;/p&gt;

&lt;p&gt;3. Notificar aquesta proposta a les persones interessades i informa'ls que disposen d'un termini màxim de 10 dies hàbils, comptadors des de l'endemà a la publicació al BOIB d'aquesta proposta, per presentar al·legacions. En el cas de no fer ús del seu dret per al·legar, en el termini indicat, o si manifesten la seva decisió de no efectuar al·legacions ni aportar nous documents o justificacions, aquesta proposta tindrà caràcter definitiu, i s'elevarà al vicepresident del FOGAIBA perquè dicti la Resolució de revocació de l'ajuda concedida.&lt;/p&gt;
