&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMER.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Convocar el procediment selectiu per a la creació d'una borsa per a proveir la vacant&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;de peó de brigada mitjançant una contractació de personal laboral temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGON.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Aprovar les bases que han de regir el procediment selectiu la creació d'una borsa per a&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;proveir la vacant de peó de brigada mitjançant una contractació de personal laboral temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCER.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Publicar la convocatòria i les bases en el Butlletí Oficial de les Illes Balears i un extracte&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;de la convocatòria en el Butlletí Oficial de l'Estat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A continuació es transcriuen les bases. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Bases i convocatòria que han regir el procés selectiu mitjançant el sistema de concurs de mèrits, per la cobertura, com a personal laboral temporal, de vacants de peó de brigada&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objecte de la convocatòria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;És objecte d'aquesta convocatòria la creació d'una borsa de treball mitjançant el procediment de concurs de mèrits destinada a cobrir de manera temporal les vacants i substitucions de la plantilla corresponents als llocs de treball de peó de brigada de l'Ajuntament des Migjorn Gran&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Funcions a desenvolupar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les funcions a desenvolupar són les pròpies dels oficis de la brigada municipal, amb especial atenció a petites obres de paleta, però també d'altres com tasques de lampisteria, fusteria, pintura, serralleria, jardineria i electricitat. També s'hauran d'executar tasques de manteniment dels edificis i instal·lacions municipals fixes, muntatge i desmuntatge d'instal·lacions temporals o provisionals, suport a la brigada municipal en èpoques prèvies a festivitats i fires, muntatge i desmuntatge dels diversos mercats, tot sota la direcció i supervisió del superior jeràrquic, així com altres tasques que eventualment i temporalment se li puguin encomanar per suplir alguna vacant, absència o malaltia d'altre personal del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Requisits de les persones aspirants&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Tenir la nacionalitat espanyola o la de qualsevol dels Estats membres de la Unió Europea, o d'aquells Estats que,&lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;virtut del Tractat Internacional subscrit per la Unió Europea i ratificat per Espanya, sigui aplicable la lliure circulació de treballadors, d'acord amb el que preveu l'article 57 del Text refós de la Llei de l'Estatut bàsic de l'empleat públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les persones aspirants que no posseeixin la nacionalitat espanyola i que per la seva procedència no coneguin la llengua castellana hauran d'acreditar-ne el coneixement mitjançant l'aportació del diploma d'espanyol com a llengua estrangera, regulat en el Reial decret 1137/2002, de 31 d'octubre, pel qual es regulen els diplomes d'espanyol com a llengua estrangera (DELE); o el certificat d'aptitud d'espanyol per a estrangers expedit per les escoles oficials d'idiomes, o l'acreditació d'estar en possessió d'una titulació acadèmica espanyola expedida per l'òrgan oficial competent en el territori espanyol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Tenir fets els 16 anys i no excedir de l'edat màxima de jubilació forçosa. En cas de ser menor de 18 anys, és necessari el consentiment dels pares o tutors o l'autorització de la persona o institució que els tengui a càrrec seu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Tenir capacitat funcional suficient per desenvolupar les tasques i exercir les funcions que corresponen al lloc de treball. Per participar en el procediment n'hi ha prou amb la presentació, dins del termini de presentació d'instàncies, d'una declaració responsable de tenir les capacitats i aptituds físiques i psíquiques que són necessàries per a l'exercici de les funcions corresponents al lloc de treball.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas que la persona aspirant hagi estat seleccionada per formar part de la borsa i sigui cridada per ser incorporada com a treballador/a peó de brigada, haurà de presentar, dins del termini de 3 dies hàbils des de la crida, un certificat mèdic oficial acreditatiu que compta amb les capacitats i aptituds físiques i psíquiques necessàries per realitzar les funcions del lloc de treball establertes en aquesta convocatòria. Si no es presenta el certificat mèdic oficial esmentat en el termini indicat, o si d'aquest es desprèn que la persona no és apta físicament o psíquicament per al lloc de treball ofert, no es podrà procedir al nomenament que s'hagi ofert a l'aspirant i es passarà a cridar la següent persona de la llista, de conformitat amb l'ordre de prelació que pertoqui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Estar en possessió del Certificat Escolar, ESO o equivalent o estar en condicions d'obtenir-lo en la data de finalització del termini per a la presentació d'instàncies. En el cas de titulacions expedides a l'estranger, caldrà aportar la documentació que n'acrediti l'homologació oficial del Ministeri d'Educació i Formació Professional, o d'una universitat espanyola. La titulació s'ha d'acreditar mitjançant l'expedició dels títols corresponents per l'autoritat acadèmica competent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;No haver estat separat o separada mitjançant expedient disciplinari del servei de l'Administració pública, ni trobar-se en inhabilitació per a l'exercici de funcions públiques, ni trobar-se en inhabilitació absoluta o especial per a ocupacions o càrrecs públics per resolució judicial per a l'accés al cos o a l'escala de personal funcionari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Estar en possessió del carnet de conduir tipus B, que s'ha de justificar aportant una còpia del permís de conduir en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Acreditar els coneixements de llengua catalana corresponents al nivell de certificat B1 de la Direcció General de Política Lingüística, de l'Escola Balear d'Administració Pública, de l'Escola Oficial d'Idiomes o equivalent. En cas que les persones aspirants optin per acreditar els coneixements de llengua catalana mitjançant l'aportació del títol o el certificat oficial corresponent, els títols vàlids seran els expedits o homologats pels organismes competents i d'acord amb la legislació vigent pel que fa a aquesta matèria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tots aquests requisits s'han de complir quan es presentin les sol·licituds i mantenir-se durant el període en què la persona romangui a la borsa. Serà causa d'exclusió si es detecta, en qualsevol moment, que no s'acompleixen les condicions i requisits exigits per poder participar en el procediment selectiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si durant el desenvolupament del procés selectiu el tribunal considera que hi ha motius suficients per fer-ho, podrà demanar als aspirants que acreditin el compliment de totes o alguna de les condicions i requisits exigits per prendre-hi part i determinar la continuació o l'exclusió de &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;l'aspirant en el procés, si escau.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Presentació de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les sol·licituds per participar en el procés selectiu es presentaran preferiblement de forma telemàtica a través de la carpeta ciutadana, o bé per qualsevol altre mitjà previst en l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, o directament al Registre General de l'Ajuntament des Migjorn Gran, a l'Oficina d'Atenció Ciutadana (OAC), Plaça de l'Església, núm. 3, telèfon 971 37 01 10, en horari d'atenció al públic, de manera presencial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El termini de presentació de sol·licituds serà 10 dies hàbils comptadors des de l'endemà de la publicació d'aquestes bases en el Butlletí Oficial de les Illes Balears (BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En les instàncies, que es presentaran d'acord amb l'annex, es farà constar la manifestació de reunir totes i cadascuna de les condicions exigides en la base tercera de la present convocatòria, i alhora s'hi haurà d'adjuntar la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) Fotocòpia del DNI o NIE. En el cas de no tenir la nacionalitat espanyola, és necessari presentar una fotocòpia compulsada del permís de residència vigent.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) Còpia de les titulacions exigides.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) Còpia del certificat del nivell de català.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d) Documentació justificativa del mèrits al·legats.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Llista de persones aspirants&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Finalitzat el termini de presentació de sol·licituds, el batle dictarà una resolució en la qual declararà aprovada la llista provisional de persones admeses i excloses en funció de si han presentat la sol·licitud formalitzada i la documentació exigida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En aquesta resolució es faran constar les inicials de les persones aspirants i el seu número de DNI dissociat juntament amb la causa per la qual no han estat admeses. Així mateix, s'indicarà el nomenament dels membres que formaran part del tribunal qualificador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Tribunal qualificador&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El tribunal, nomenat per l'Ajuntament, estarà constituït per tres funcionaris de carrera (Presidència, vocal i secretaria) i el mateix nombre de suplents; qualsevol d'aquests podrà actuar indistintament. Totes aquests han de posseir un nivell de titulació igual o superior a l'exigit per a l'ingrés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els membres del Tribunal Qualificador estan obligats a complir el deure de sigil en relació amb les deliberacions, així com en relació amb qualsevol de les dades, del fets o de les circumstàncies del procés de selecció el coneixement de les quals adquireixin en virtut de la seva condició; i no poden facilitar cap informació sobre aquestes deliberacions a persones alienes al Tribunal Qualificador al qual pertanyen. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els membres del Tribunal hauran d'abstenir-se d'intervenir, i ho notificaran a l'autoritat convocant, quan concorri alguna de les causes previstes a la Llei 40/2015, d'1 d'octubre, de Règim Jurídic del Sector Públic, o si han realitzat tasques de preparació de persones aspirants per a proves selectives d'accés a la plaça de què es tracta, durant els cinc anys anteriors a la publicació de la convocatòria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix les persones aspirants podran recusar els membres del Tribunal quan es doni alguna de les circumstàncies esmentades en el paràgraf anterior, conforme a què preveu la mateixa Llei 40/2015, d'1 d'octubre, de Règim Jurídic del Sector Públic. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les sessions dels tribunals podran ser a distància, d'acord amb allò que estableix l'article 17 de la Llei 40/2015, d'1 d'octubre, de Règim Jurídic del Sector Públic, sempre que en les sessions s'asseguri per mitjans electrònics, considerats també com a tals els telefònics i els audiovisuals, la identitat dels membres o les persones que els supleixin, el contingut de les seves manifestacions, el moment en què aquestes es produeixen, així com la interactivitat i intercomunicació, entre aquests en temps real i la disponibilitat dels mitjans durant la sessió. Entre d'altres, es consideren inclosos entre els mitjans electrònics vàlids la missatgeria electrònica, les audioconferències i les videoconferències.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Procediment selectiu&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El procés de selecció constarà d'una única fase de concurs i els mèrits presentats es valoraran dins del termini de presentació d'instàncies.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Valoració de mèrits&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El procés de selecció tindrà una puntuació màxima de 30 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;A) Experiència professional: màxim 20 punts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es valorarà l'experiència professional en oficis propis de les brigades municipals (construcció, fusteria, electricitat, transport, jardineria, pintura, treball del ferro i altres de similars o anàlegs) prestada en empreses privades o en administracions públiques. Es valoraran de la següent forma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per cada 30 dies cotitzats de servei a qualsevol administració pública, com a personal funcionari o laboral, en un lloc de treball relacionat amb el que és objecte d'aquesta convocatòria o en un altre amb funcions similars en què es realitzi alguna o algunes de les funcions descrites en la base segona: 0,30 punts per mes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per cada 30 dies cotitzats de servei en el sector privat en un lloc de treball relacionat (com a assalariat o com a autònom) amb el que és objecte d'aquesta convocatòria o en un altre amb funcions similars en què es realitzi alguna o algunes de les funcions descrites en la base segona: 0,20 punts per mes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La prestació dels serveis s'haurà d'acreditar amb un informe de la vida laboral emès per la Tresoreria General de la Seguretat Social, juntament amb una còpia del contracte laboral i/o el nomenament, o bé per qualsevol altre mitjà que acrediti la naturalesa dels serveis prestats i la categoria laboral o el grup (certificats de feina, nòmines) amb indicació de l'inici i de la finalització de la prestació dels serveis professionals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;B) Titulacions acadèmiques: màxim 6 punts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per estar en possessió del títol de batxillerat: 1 punt.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per estar en possessió d'un títol oficial de formació professional de grau mitjà, en especialitats de construcció; reforma i manteniment d'edificis; electricitat i/o instal·lacions tèrmiques/fluids o anàlegs: en l'àmbit de les funcions del lloc de treball: 2 punts per cada títol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per estar en possessió d'un títol oficial de formació professional de grau superior, en especialitats de construcció; reforma i manteniment d'edificis; electricitat i/o instal·lacions tèrmiques/fluids o anàlegs: o en l'àmbit de les funcions del lloc de treball: 3 punts per cada títol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;C) Formació acadèmica complementària: màxim 3 punts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per l'assistència i aprofitament a cursos, seminaris o jornades, sempre que tenguin relació directa amb oficis propis de la brigada municipal (construcció, fusteria, electricitat, jardineria, lampisteria, entre altres d'anàlegs), es podrà obtenir fins a un màxim de 3 punts:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 10 a 20 hores de durada: 0,05 punts per curs&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 21 a 40 hores de durada: 0,1 punts per curs&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 41 a 100 hores de durada: 0,2 punts per curs&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Més de 100 hores de durada: 0,4 punts per curs&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La formació acadèmica complementària s'haurà d'acreditar amb la presentació del diploma corresponent. Els diplomes o certificats han de ser d'aprofitament, no basta amb els certificats d'assistència, i han de ser expedits per centres oficials o homologats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;D) Per coneixements de llengua catalana: màxim 1 punt&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Per estar en possessió del certificat de coneixement del nivell B2: 0,5 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Per estar en possessió del certificat de coneixements del nivell C1: 0,75 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Per estar en possessió del certificat de coneixements del nivell C2: 1 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si es presenta més d'un certificat, es tindrà en compte només el de nivell superior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Puntuació final&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La puntuació final vindrà determinada per la suma dels mèrits (experiència professional, titulacions acadèmiques i formació complementària).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas d'empat, es tindrà en compte la major puntuació obtinguda en l'apartat d'experiència professional. Si persisteix l'empat, es tindrà en compte la major puntuació obtinguda en l'apartat de titulacions acadèmiques. Si persisteix l'empat, es tindrà en compte la major puntuació obtinguda en l'apartat de coneixements superiors de llengua catalana. Si també persistís l'empat, es faria per sorteig.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Base 8. Valoració dels aspirants, aprovació de la borsa i vigència&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vegada conclosa la valoració de mèrits dels aspirants admesos es publicarà a la pàgina web de l'Ajuntament des Migjorn Gran, la llista amb la relació de la valoració de mèrits per ordre de puntuació, de major a menor, i en el termini que s'estableixi els aspirants hi podran formular les al·legacions i reclamacions que estimin oportunes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Passat aquest termini, i si no s'han formulat al·legacions o reclamacions, aquesta llista provisional passarà a ser definitiva i s'elevarà a la Batlia perquè mitjançant resolució aprovi la llista de persones que podran cobrir amb caràcter temporal llocs de treball de naturalesa funcionarial corresponents a les places de la brigada municipal, quan sigui procedent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta resolució es publicarà a la seu electrònica de l'Ajuntament a l'efecte de considerar-la notificada a totes les persones interessades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta borsa tindrà una vigència de 3 anys des que es publiqui la resolució de constitució, sens perjudici que es pugui entendre prorrogada mentre es fa el procediment selectiu per constituir-ne una altra de posterior. No obstant això, la constitució d'una borsa posterior rere el procediment selectiu corresponent deixarà sense efecte la present.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Funcionament de la borsa de treball&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els aspirants que hagin aprovat el procés però no hagin obtingut plaça, passaran a formar part de la borsa de treball preferent de l'Ajuntament, en ordre de puntuació del concurs-oposició, amb la finalitat de cobri vacants temporalment. Seran cridats en ordre, establert per la puntuació obtinguda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'oferta de treball es farà via telefònica. Si no s'aconsegueix localitzar la persona per telèfon, es tornarà a fer un segon intent, amb una (1) hora de diferència. Si no es localitza a la persona, se li enviarà un missatge al correu electrònic indicat al formulari, i es donarà per avisada. Si la persona interessada no manifesta la seva conformitat amb el nomenament en el termini de 24 hores des de l'enviament del missatge de correu i la seva disposició a incorporar-se en el termini indicat pel departament de personal de l'Ajuntament, que serà com a mínim de tres (3) dies hàbils, s'entendrà que renuncia a ocupar el lloc de feina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas que no s'hi hagi pogut contactar en cap dels tres intents, que no hagi contestat el correu electrònic o bé que no accepti la proposta de contracte, la persona aspirant retrocedirà fins a la darrera posició de la borsa i s'oferirà el nomenament a la persona que ocupi el lloc immediatament següent de la llista, i així successivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les persones aspirants que renunciïn passaran a ocupar el darrer lloc de la borsa, llevat que al·leguin, en el termini establert per manifestar la seva conformitat, la concurrència d'alguna de les circumstàncies següents, que s'han de justificar documentalment en els tres (3) dies següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Estar en període d'embaràs, de maternitat o paternitat, d'adopció o d'acolliment permanent o preadoptiu, la qual cosa inclou el període en què sigui procedent la concessió d'excedència per a cura de fills i filles per qualsevol dels supòsits anteriors. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Prestar serveis en un lloc de la relació de llocs de treball de l'Ajuntament des Migjorn Gran com a personal funcionari interí en una altra escala, subescala, classe o categoria, o com a personal laboral temporal o indefinit no fix. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Patir malaltia o incapacitat temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Si està, en el moment de la crida, exercint funcions sindicals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquests casos s'hauran d'acreditar documentalment en el termini dels 5 dies naturals següents a produir-se aquestes situacions. En cas que no es justifiqui dins aquest termini, es passarà a ocupar el darrer lloc de la llista.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Quan la persona seleccionada mitjançant aquest sistema de borsa cessi en el lloc de treball, llevat que sigui per renúncia voluntària, es reincorporarà novament a la borsa de treball amb el mateix ordre de prelació que tenia. També es mantindrà en el mateix ordre de prelació la persona que, essent citada per fer efectiva una contractació, ja estigui contractada per l'Ajuntament i es mantingui en el lloc de treball que desenvolupa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Incidències, publicitat, règim normatiu i impugnació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pel que fa a la tramitació del procediment selectiu, el tribunal qualificador queda facultat per resoldre els dubtes que es presentin en la interpretació d'aquestes bases i prendre els acords necessaris per al bon ordre d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La convocatòria d'aquest procediment selectiu i les seves bases es publicaran, íntegrament, al tauler d'anuncis electrònic de l'Ajuntament des Migjorn i en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;(BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Rere la publicació de la convocatòria i les bases en el BOIB, els anuncis successius relatius al procediment selectiu es faran al tauler d'anuncis de l'Ajuntament des Migjorn.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el que no preveuen les bases serà d'aplicació el Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el Text refós de la Llei de l'Estatut bàsic de l'empleat públic; la Llei 7/1985, de 2 d'abril, de bases del règim local; el Reial decret legislatiu 781/1986, de 18 d'abril, pel qual s'aprova el Text refós de les disposicions legals vigents en matèria de règim local; el Reial decret 30/2009, de 22 de maig, pel qual s'aprova el procediment de selecció de personal funcionari interí al servei de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les presents bases i tots els actes administratius que se'n derivin, d'aquestes i de les actuacions del tribunal qualificador, poden ser impugnats de conformitat amb el que estableix la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Protecció de dades de caràcter personal&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb el que disposa l'article 11 de la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garanties dels drets digitals (BOE núm. 294, de 6 de desembre de 2018), s'informa a les persones aspirants:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En el cas de ser nacional d'un altre estat, no estar inhabilitat o en situació equivalent que impedeixi, en el seu estat i en els mateixos termes, l'accés a l'ocupació pública. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que no estic en situació d'incórrer en el moment del contracte en una causa d'incompatibilitat, d'acords amb el que preveu la Llei 53/1984, de 26 de desembre, d'incompatibilitats al servei de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
