El Consell Executiu de dia 28 de maig de 2025 va aprovar l'expedient de Convocatòria de subvenció 2025 per a entitats sense ànim de lucre que realitzin projectes i activitats adreçades a l'atenció i l'empoderament de les persones en context de prostitució de la part forana de Mallorca (BOIB núm. 77, de 19 de juny de 2025).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">2. Dia 19 de setembre de 2025, l'òrgan instructor va emetre informe relatiu al compliment per part de les entitats dels requisits necessaris per accedir a la subvenció.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">4. L'aportació econòmica que representa la convocatòria està prevista dins el pressupost del Consell de Mallorca per a l'any 2025&nbsp; amb càrrec a l'aplicació pressupostària 00.23168.48901, i es disposa dels corresponents certificats d'existència de crèdit.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">5. La Intervenció Delegada ha fiscalitzat de conformitat amb data 24 de setembre de 2025</span></span></p> <p><strong><span style="line-height:107%">Fonaments</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">1. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions, tal com estableix la disposició addicional novena de la Llei 4/2022, de 28 de juny, de consells insulars.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">2. L'Ordenança General de Subvencions del Consell Insular de Mallorca aprovada pel Ple del Consell de Mallorca, en sessió de dia 23 de desembre de 2016 (BOIB núm. 21, de 18 de febrer de 2017), modificada per Acord del Ple de 14 de juny de 2018 (BOIB núm. 96, de 4 d'agost de 2018) en la qual s'estableix el règim jurídic general de les subvencions atorgades pel Consell Insular de Mallorca.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">3. La pròpia convocatòria de subvenció per a entitats sense ànim de lucre que realitzin projectes i activitats adreçades a l'atenció i l'empoderament de les persones en context de prostitució a la part forana de Mallorca (BOIB núm. 77, de 19 de juny de 2025).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">4. Els articles 121 i 122 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques, en quant a l'objecte i terminis per a interposar recurs d'alçada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">5. Revertir el sobrant per import de 45.200,00 € (A/ 920250012354).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">4. Notificar aquesta resolució a Intervenció General i a les persones&nbsp; beneficiàries i remetre al BOIB i a la BDNS les dades relatives a les subvencions concedides per a la seva publicació.</span></span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Contra aquesta resolució, que no exhaureix la via administrativa, podeu interposar el recurs d'alçada en el termini d'un mes, comptador a partir de l'endemà de rebre aquesta notificació. El recurs es pot interposar formalment davant el consell executiu del Consell Insular de Mallorca, que és l'òrgan competent per resoldre'l.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Contra la desestimació expressa d'aquest recurs d'alçada, hi podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui, en el termini de dos mesos, comptadors a partir de l'endemà de rebre la notificació de la desestimació del dit recurs d'alçada. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Si han transcorregut tres mesos des de la interposició del recurs d'alçada i no n'heu rebut la notificació de resolució expressa, s'entén desestimat per silenci i podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui, sense limitació de temps.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">No obstant l'anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú.
