La Llei orgànica 3/2022, de 31 de març, d'ordenació i integració de la formació professional, va integrar la formació conduent a certificats de professionalitat en el Catàleg nacional d'ofertes de formació professional, com a ofertes de grau C (amb la nova denominació de «certificats professionals»), i estableix que la impartició d'ofertes de formació professional està subjecta a prèvia autorització i inscripció registral per part de l'administració competent.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. El Servei d'Ocupació de les Illes Balears (SOIB) tenia atribuïda la formació professional en els graus A, B, C impartida en els centres que no pertanyen al sistema educatiu, d'acord amb el Decret 1/2024, de 4 de gener, de la presidenta de les Illes Balears, pel qual es modifica el Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la CAIB. Un cop derogat el Decret 12/2023 per mitjà del Decret 10/2025, de 14 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, la competència de l'autorització de centres per a ofertes de grau C correspon a la Conselleria d'Educació i Universitats.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. El Reial decret 659/2023, de 18 de juliol, pel qual es desenvolupa l'ordenació del Sistema de Formació Professional, deroga el Reial decret 34/2008 de 18 de gener, pel qual es regulen els certificats de professionalitat, però sens perjudici del manteniment en vigor dels requisits recollits en el Reial decret 62/2022, de 25 de gener. Per tant, el Reial decret 34/2008 i la normativa de desplegament són encara aplicables pel que fa als requisits generals que han de complir els centres. És aplicable, per tant, l'Ordre TMS/369/2019, de 28 de març, per la qual es regulen el Registre Estatal d'Entitats de Formació del sistema de formació professional per a l'ocupació, així com els processos comuns d'acreditació i inscripció de les entitats de formació per a impartir especialitats formatives incloses en el Catàleg d'especialitats formatives.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Les especificacions del certificat professional per al qual se sol·licita l'autorització es contenen en el reial decrets pel qual s'estableix, citat en la taula inclosa en el punt 1 de l'apartat de Fets. D'acord amb la disposició transitòria primera de l'esmentat Reial decret 659/2023, fins que no es procedeixi reglamentàriament a la seva modificació, romandrà vigent l'ordenació dels certificats de professionalitat recollida en cadascun dels reials decrets pels quals s'estableixen.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. Les disposicions generals sobre els procediments administratius es contenen en la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú; i les especificacions procedimentals de l'Administració de la CAIB es contenen en la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la CAIB.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per tot això, i d'acord amb la proposta formulada pel Servei d'Ocupació de les Illes Balears 16 de setembre de 2025, dict la següent </span></span></span></span></p> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Resolució</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Autoritzar, amb efectes 1 de setembre de 2025, per impartir l'oferta formativa de Grau C (certificat professional) que figura en la fitxa d'oferta formativa annexa, en el centre denominat AAP ONLINE CENTRE FP SOIB, amb la distribució d'espais i nombre d'alumnes que s'hi indiquen.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Inscriure i actualitzar aquesta autorització en el Registre General de Centres de Formació Professional del Ministeri d'Educació, Formació Professional i Esports i en el Registre autonòmic de la Conselleria d'Educació i Universitats.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Fer avinent al centre esmentat que resta obligat a complir la legislació vigent i a sol·licitar la revisió oportuna de la seva configuració quan s'hagi de modificar qualsevol de les dades que figuren en aquesta Resolució. En cas contrari, es revocarà l'autorització atorgada.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Publicar aquesta Resolució en el </span><em><span style="background-color:null">Butlletí Oficial de les Illes Balears.</span></em></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Interposició de recursos</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Universitats en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
