PER A LES TEMPORADES 2025-2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Antecedents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Amb data 19 de setembre de 2025 s&amp;apos;ha comunicat per la Direcció General de Treball i Salut Laboral, que l&amp;apos;empresa MARSAVE MALLORCA SL va presentar davant la citada Direcció comunicació de vaga legal, a l&amp;apos;empara de l&amp;apos;estipulat en el Reial decret 17/1997, de 4 de març, sobre relacions de treball, Titulo I, sobre dret de vaga, de manera indefinida i a partir del dia 28 de setembre de l&amp;apos;any en curs en l&amp;apos;horari de prestació de servei de cada centre de treball, afectant els serveis de salvament i socorrisme a les platges del municipi d&amp;apos;Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;La Constitució espanyola reconeix en l&amp;apos;article 28.2 el dret a la vaga dels treballadors per a la defensa dels seus interessos, disposant que la llei que reguli l&amp;apos;exercici d&amp;apos;aquest dret establirà les garanties precises per a assegurar el manteniment dels serveis essencials de la comunitat, del que es dedueix que el dret de vaga no és absolut i incondicional, estant subjecte a limitacions en funció del bé comú i el respecte al dret dels altres i així la Constitució permet que, per mitjà d&amp;apos;una llei, s&amp;apos;estableixin en cas de vaga les garanties precises per a assegurar el manteniment dels serveis essencials de la comunitat&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;No havent-se produït el desenvolupament legal exigit per l&amp;apos;article de la Constitució abans citat, resulta d&amp;apos;aplicació el que es disposa en l&amp;apos;article 10.2 del Reial decret llei 17/1977, de 4 de març, segons el qual “quan la vaga es declari en empreses encarregades de la prestació de qualsevol gènere de serveis públics o de reconeguda i inajornable necessitat i concorrin circumstàncies d&amp;apos;especial gravetat, l&amp;apos;Autoritat governativa podrà acordar les mesures necessàries per a assegurar el funcionament dels serveis”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Els serveis prestats per l&amp;apos;Ajuntament té la consideració de serveis públics, segons es desprèn del que es disposa en els articles 25 i 26 de la Llei 7/1985, reguladora de les Bases del Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;El servei de salvament i socorrisme a les platges del municipi d&amp;apos;Eivissa, és un servei essencial, explícit competentment per als municipis i imprescindible, ja que en cas de no realitzar-se incompliria amb la Llei 22/0988, de 28 de juliol, de Costas, així com del Decret 2/2005, de 14 de gener, regulador de les mesures mínimes de seguretat i protecció que han de complir les platges i zones de bany de la Comunitat Autònoma de les Illes Balears&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Vist l&amp;apos;informe dels serveis tècnics municipals de data 24 de setembre de 2025 del tenor literal següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;“Informe en relació a la convocatòria de vaga indefinida tots els dies dissabte i diumenge a partir del dia 28 de setembre dels treballadors de l&amp;apos;empresa MARSAVE MALLORCA S.L. pel qual es determinen els serveis mínims.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Antecedents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Amb data 29 de maig de 2025 es va formalitzar contracte amb l&amp;apos;entitat MARSAVE MALLORCA S.L. per a l&amp;apos;execució del “Servei de vigilància, salvament i socorrisme a les platges del municipi d&amp;apos;Eivissa per a les temporades 2024-2026”&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Informe&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Aquest Ajuntament disposa de dues torres i un mòdul de socorrisme en cadascuna de les platges (Figueretes, platja d&amp;apos;en Bossa i Talamanca), totes elles classificades com de risc alt. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Amb data 19 de setembre de 2025 la Direcció General de Treball i Salut Laboral comunica a aquest Ajuntament la convocatòria de vaga dels treballadors de l&amp;apos;empresa MARSAVE MALLORCA SL dels centres de treball de Sant Antoni de Portmany, Sant Josep de sa Talaia i Eivissa, en la qual s&amp;apos;insta aquest Ajuntament a fixar els serveis mínims necessaris per a garantir la prestació del servei de socorrisme.&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;El decret 2/2005, de 14 de gener, regulador de les mesures mínimes de seguretat i protecció que han de complir les platges i zones de bany de la Comunitat Autònoma de les Illes Balears estableix en el seu article 20:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;“Horaris de prestació dels serveis&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;1. A les platges en les quals existís Servei públic de salvament, els horaris que amb caràcter general tindrà cada temporada, s&amp;apos;adequaran a les particularitats de l&amp;apos;entorn, condicions climatològiques i temporada de l&amp;apos;any natural amb afectació turística&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. Els horaris de servei mínim per a cada temporada hauran de ser els següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;a) Per a la temporada alta, almenys des de les 10 hores fins a les 18 hores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;b) Per a la temporada mitjana, almenys des de les 11 hores fins a les 17 hores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;c) Per a la temporada baixa, es recomana des de les 12 hores fins a les 16 hores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Així mateix estableix en el seu Annex VAIG VEURE els criteris per al dimensionament de l&amp;apos;equip humà en funció del risc&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;:(…)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;c) Un socorrista d&amp;apos;activitats aquàtiques per a l&amp;apos;atenció sanitària per cada dues torres i com a mínim un socorrista d&amp;apos;activitats aquàtiques si només hi ha una torre&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;d) Dos socorristes d&amp;apos;activitats aquàtiques per cada embarcació d&amp;apos;auxili, un dels quals, almenys, estar degudament acreditat per al maneig de l&amp;apos;embarcació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Conclusions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Donada la classificació de les totes les platges del municipi com a platges de risc alt i sobre la base dels criteris que estableix el Decret 2/2005, de 14 de gener, regulador de les mesures mínimes de seguretat i protecció que han de complir les platges i zones de bany de la Comunitat Autònoma de les Illes Balears es determinen els següents serveis mínims:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Per a la platja de Talamanca:3 socorristes, un per torre i un en lloc de socors i 1 supervisor de platja.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Per a la platja de Figueretes: 3 socorristes, un per torre i un en lloc de socors i 1 supervisor de platja&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Per a la platja d&amp;apos;en Bossa: 3 socorristes, un per torre i un en lloc de socors i 1 supervisor de platja&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;A més, i atès que l&amp;apos;embarcació de rescat és compartida entre les platges, haurà d&amp;apos;haver-hi 2 socorristes més, un d&amp;apos;ells patró d&amp;apos;embarcació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Aquests serveis mínims constitueixen un 93,33% de la plantilla adscrita al contracte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;S&amp;apos;estableix l&amp;apos;horari de servei mentre duri la vaga en el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;- Fins al 15 d&amp;apos;octubre inclòs, d&amp;apos;11.00 hores fins a les 17.00 hores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;- Des del 16 d&amp;apos;octubre fins al 31 d&amp;apos;octubre, tots dos inclosos, de 12.00 hores fins a les 16.00 hores&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Eivissa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;La tècnica municipal&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;(document signat electrònicament en el marge)”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;A la vista de tot l&amp;apos;exposat anteriorment i en virtut de les competències que tinc atribuïdes segons l&amp;apos;article 21.1 lletra k) de la Llei 7/1985 de 2 d&amp;apos;abril, de Bases de Règim Local,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Primer.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; Establir els serveis mínims establerts en l&amp;apos;informe dels serveis municipals amb la finalitat de garantir el funcionament dels serveis de salvament i socorrisme durant la vaga fixada de manera indefinida amb inici el dia 28 de setembre de 2025, convocada per l&amp;apos;empresa MARSAVE MALLORCA S.L&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;.&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Segon.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; MARSAVE MALLORCA S.L. haurà de comunicar a aquest Ajuntament, abans de l&amp;apos;inici de la vaga, la relació nominal de les persones que hagin de prestar els serveis mínims establerts en l&amp;apos;informe tècnic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Tercer.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;L&amp;apos;incompliment de l&amp;apos;obligació d&amp;apos;atendre els serveis mínims serà sancionat de conformitat en la normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Quart.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; Notificar aquest acord a MARSAVE MALLORCA S.L., i a la Direcció General de Treball i Salut Laboral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Cinquè.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Ordenar la publicació de la present resolució en el Butlletí Oficial de les Illes Balears.&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;span style="display: block; margin-bottom: 0px; margin-top: 0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Sisè.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; Contra el present Decret que posa fi a la via administrativa es podrà interposar, potestativament, recurs de reposició davant l&amp;apos;òrgan que ha dictat la resolució de conformitat amb el qual disposa en els articles 123 i 124 de la Llei 39/2015 1 d&amp;apos;octubre de Procediment Administratiu Comú de les Administracions Públiques en el termini d&amp;apos;un mes a comptar des de l&amp;apos;endemà de la notificació, o directament un recurs contenciós administratiu, pel procediment especial per a la protecció dels drets fonamentals davant la Sala d&amp;apos;aquest Ordre Jurisdiccional del Tribunal Superior de Justícia d&amp;apos;illes Balears,en el termini de 10 dies hàbils que es computarà des del següent al de la notificació del present Decret d&amp;apos;acord amb el que preveuen els articles 114 i 115 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa . Tot això sense perjudici de poder interposar qualsevol altre recurs que estimi procedent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
