El 22 de febrer de 2024 la Comissió Negociadora del centre de treball situat a Cala Millor, que pertany a l'empresa Family Food &amp; Fun, SLU, signà l'acord d'adhesió al I Conveni col·lectiu sectorial estatal de marques de restauració moderna.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. El 19 de novembre de 2024, Ramón Garmendia Merino, en representació de la Comissió Negociadora de l'Acord, sol·licità el registre, el dipòsit i la publicació de l'Acord esmentat.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Fonaments de dret</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. L'article 90.3 del text refós de la Llei de l'Estatut dels treballadors, aprovat pel Reial decret legislatiu 2/2015, de 23 d'octubre.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. font-size:12px"><strong>MANIFESTEN</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>PRIMER.</strong> Les dues parts es reconeixen capacitat i legitimació suficient de manera recíproca, de conformitat amb l'article 87 de l'Estatut dels treballadors.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SEGON.</strong> Les dues parts decideixen, de mutu acord, deixar sense efecte el Conveni propi de l'empresa (codi de conveni número 07100432012016) publicat el 30 d'abril de 2022 perquè es pugui dur a terme l'adhesió al CMR.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>TERCER. </strong>Que el Conveni d'MRM és el conveni propi de l'activitat de l'empresa, ja que ha estat signat per la nostra franquícia, Restaurantes McDonald's SAU, i no està afectat per cap altre Conveni col·lectiu, ja que es tracta d'un sector de nova creació i, en aquest acte, es deixa sense efecte el Conveni propi de l'empresa que està vigent per poder complir l'adhesió. És condició <em>sine qua non</em> de la pèrdua de vigència del Conveni propi d'empresa l'adhesió al Conveni d'MRM.</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ACORDEN</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>PRIMER. </strong>Que les parts, de comú acord, s'adhereixen a la totalitat del Conveni col·lectiu sectorial estatal de marques de restauració moderna (d'ara endavant, Conveni col·lectiu MRM), amb codi de conveni núm. 99100275012022, publicat el 8 de desembre de 2022, en virtut del que estableix la disposició addicional primera del Conveni col·lectiu esmentat, que estableix:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">«Les empreses franquiciades, de les empreses i/o grups d'empreses que estiguin afectades per l'àmbit funcional d'aquest Conveni col·lectiu, podran aplicar aquest Conveni col·lectiu seguint el mecanisme que preveu l'article 92.1 de l'Estatut dels treballadors».</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Com que la mercantil té subscrit un contracte de franquícia amb Restaurantes McDonald's SAU, consistent en l'explotació d'establiments de menjar ràpid amb el nom de McDonald's (marca comercial de cadenes de restauració de gran implementació en l'àmbit territorial) està afectada per l'àmbit funcional d'aplicació del Conveni d'MRM i té el caràcter d'empresa franquiciada de la disposició addicional primera.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SEGON. </strong>Que s'ha facilitat als representants legals de les persones treballadores una còpia del Conveni col·lectiu sectorial estatal de marques de restauració moderna<em> </em>per al seu coneixement complet, i, al seu torn, se'n deixa un exemplar al centre de treball perquè es pugui consultar.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>TERCER.</strong> Que les parts expressen que es donarà trasllat i còpia d'aquest escrit a l'autoritat laboral competent perquè en tengui constància i el registri, tal com estableix l'article 92.1 de l'Estatut dels treballadors esmentat abans.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>QUART. </strong>Que les parts, de conformitat amb la disposició transitòria primera del Conveni col·lectiu d'MRM, ordenen l'estructura salarial de manera que el conjunt de retribucions que s'estiguin abonant es transformin fins a assolir, com a mínim, el salari base que estableix l'article 21 del Conveni col·lectiu sectorial estatal de marques de restauració moderna<em> </em>per a cada exercici salarial.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aquest sentit, l'empresa tindrà en compte el conjunt de retribucions que estiguin abonant a les persones treballadores amb caràcter fix i el sistema de classificació professional de l'article 8 del Conveni col·lectiu d'MRM mitjançant l'ordre següent:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Salari base del conveni de referència (propi d'empresa).</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Complements salarials existents en el conveni de referència (propi d'empresa).</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Complements salarials compensables, absorbibles i no revaloritzables, si escau.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Complements salarials compensables, absorbibles i revaloritzables, si escau.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resta de complements.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A aquest efecte, l'empresa adequarà els imports i conceptes de la nòmina de les persones treballadores afectades en aquest acord als imports i conceptes del Conveni col·lectiu sectorial estatal de marques de restauració moderna<em> </em>mitjançant l'abonament de les diferències com un plus o plusos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Una vegada llevat el salari base en vigor, les persones treballadores mantindran a títol personal els conceptes salarials restants en la seva pròpia naturalesa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les persones treballadores que tenien conceptes salarials que s'incrementaven regularment i que en el seu conjunt siguin superiors al salari base que fixa el Conveni col·lectiu sectorial estatal de marques de restauració moderna veuran incrementat anualment l'import de les retribucions convencionals d'origen que s'incrementaven en un 1,5&nbsp;% per exercici (garantia <em>pax</em>).<em> </em>Aquest increment integrarà un concepte salarial independent.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">S'adjunta la taula salarial amb la readequació salarial corresponent acordada com a <strong>ANNEX I</strong>, que ha estat expressament negociada amb la RLT respectant les condicions <em>ad personam </em>que, considerades globalment i en còmput anual, excedeixin aquest Conveni col·lectiu MRM, però sense que en aquest cas es puguin acumular als mateixos avantatges derivats del Conveni col·lectiu MRM.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
