La Conferència Sectorial de Medi Ambient, en la seva reunió de 14 d&apos;abril de 2021, aprova els criteris de repartiment i la distribució territorial de crèdits relatius al<em> Pla de suport a la implementació de la normativa de residus, Programa d&apos;economia circular i Pla d&apos;Impuls al Medi Ambient-PIMA Residus. </em>La quantitat consignada a la Comunitat Autònoma de les Illes Balears per als tres programes és de 16.062.634,89 euros.</span></span></p> <p><span style="line-height: 1"><span style="color: black">2. En el <em>Butlletí Oficial de les Illes Balears</em> núm. 45, de 2 d&apos;abril de 2022, es va publicar l&apos;Ordre 5/2022, de 29 de març de 2022, del conseller de Medi Ambient i Territori per la qual s&apos;estableixen les bases reguladores i s&apos;aprova la Convocatòria per a l&apos;any 2022 de subvencions per al suport a la implementació de la normativa de residus i el foment de l&apos;economia circular a les Illes Balears, finançat per la Unió Europea- Next Generation EU (annex 1). L&apos;import màxim que es destina a la convocatòria és de 15.559.303,39 euros.</span></span></p> <p><span style="color: black">3. La finalitat genèrica dels ajuts de l&apos;Ordre 5/2022 és contribuir a la consecució dels objectius relacionats amb la mesura C12.I3 del component 12 de l&apos;annex del Pla de Recuperació i Resiliència d&apos;Espanya&nbsp; aprovat per la Decisió d&apos;Execució del Consell de 13 de juliol de 2021.</span></p> <p><span style="color: black">4. La Conferència Sectorial de Medi Ambient, en la seva reunió de 20 de juny de 2022, aprova els criteris objectius i la distribució territorial per a l&apos;execució de crèdits pressupostaris relatius als següents plans o programes: Pla de suport a la implementació de la normativa de residus, en el marc del Pla de Recuperació, Transformació i Resiliència (PRTR); Programa de millora i gestió de residus municipals; i PIMA Economia Circular. La quantitat consignada a la Comunitat Autònoma de les Illes Balears per als tres programes és de 6.591.866,71 euros.</span></p> <p><span style="color: black">5. La Conferència Sectorial de Medi Ambient, en la seva reunió de 23 de novembre de 2022, aprova la modificació dels criteris de repartiment i la distribució territorial de crèdits relatius al Pla de suport a la implementació de la normativa de residus, Programa d&apos;Economia Circular i Pla d&apos;Impuls al Medi Ambient - PIMA Residus, aprovats per Acord de la Conferència Sectorial de Medi Ambient, en la seva reunió de 14 d&apos;abril de 2021.</span></p> <p><span style="color: black">6. En el </span><em>Butlletí Oficial de les Illes Balears</em><span style="color: black"> núm. 159, de 8 de desembre de 2022, es va publicar l&apos;Ordre 33/2022, de modificació de l&apos;Ordre 5/2022, de 29 de març de 2022, del conseller de Medi Ambient i Territori, per la qual s&apos;estableixen les bases reguladores de subvencions i s&apos;aprova la Convocatòria per a l&apos;any 2022 de subvencions per al suport a la implementació de la normativa de residus i el foment de l&apos;economia circular a les Illes Balears, finançat per la Unió Europea - Next Generation EU, per tal d&apos;esmenar algunes errades materials detectades i ampliar el termini per resoldre i notificar.</span></p> <p><span style="color: black">7. En el Butlletí Oficial de les Illes Balears núm. 51, de 2 d&apos;abril de 2023, es publica la Resolució del conseller de Medi Ambient i Territori, a proposta del director general de Residus i Educació Ambiental, per la qual s&apos;aprova la convocatòria per a l&apos;any 2023 de subvencions per al suport a la implementació de la normativa de residus i el foment de l&apos;economia circular a les Illes Balears finançat per la UnióEuropea- Next Generation EU. L&apos;import màxim que es destina a la convocatòria és de 6.272.059,79 euros.</span></p> <p><span style="color: black">8. El 12 de desembre de 2024 es va publicar en el </span><em><span style="color: black">Butlletí Oficial de les Illes Balears</span></em><span style="color: black"> núm. 161 la Resolució del conseller d&apos;Empresa, Ocupació i Energia per la qual s&apos;aprova, mitjançant el procediment de despesa anticipada, la convocatòria per a l&apos;any 2024, 2025 i 2026 de subvencions per al suport a la implementació de la normativa de residus i el foment de l&apos;economia circular a les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència, finançat per la Unió Europea-Next Generation EU. Aquesta convocatòria incorpora el romanent de crèdit de 2.764.338,78 euros de les convocatòries dels anys 2022 i 2023, procedents de desistiments, renúncies i modificacions de l&apos;import de concessió de les subvencions.</span></p> <p><span style="color: black">9. El 15 de maig de 2025, conforme a l&apos;establert a l&apos;Ordre 5/2022, els instructors, a la vista de l&apos;expedient i de l&apos;acta de la comissió avaluadora, formulen les propostes de resolució provisional motivades, i es procedeix a obrir un tràmit d&apos;audiència per un termini de deu dies durant el qual les entitats sol·licitants poden formular les al·legacions que estimin adients.</span></p> <p><span style="color: black">11. El 19 de maig de 2025, el conseller d&apos;Empresa, Ocupació i Energia dicta la resolució per la qual es té per desistit a l&apos;Ajuntament de Campos de la seva sol·licitud a la convocatòria per a l&apos;any 2024, 2025 i 2026 de subvencions per al suport a la implementació de la normativa de residus a les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència, finançat per la Unió Europea-Next Generation EU.</span></p> <p><span style="line-height: 1"><span style="color: black">12. El 19 de maig de 2025, el conseller d&apos;Empresa, Ocupació i Energia dicta la resolució per la qual es té per desistit de la seva sol·licitud a l&apos;Ajuntament de Banyalbufar a la convocatòria per a l&apos;any 2024, 2025 i 2026 de subvencions per al suport a la implementació de la normativa de residus a les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència, finançat per la Unió Europea-Next Generation EU.</span></span></p> <p><span style="line-height: 1"><span style="color: black">13. El 19 de maig de 2025, el conseller d&apos;Empresa, Ocupació i Energia dicta la resolució per la qual no s&apos;admet a tràmit la sol·licitud, per a la línia 4, presentada per l&apos;Empresa Municipal de Serveis 2002 SLU a la convocatòria per a l&apos;any 2024, 2025 i 2026 de subvencions per al suport a la implementació de la normativa de residus a les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència, per haver-se presentat fora de termini.</span></span></p> <p><span style="line-height: 1"><span style="color: black">14. El 20 de maig de 2025, el conseller d&apos;Empresa, Ocupació i Energia dicta la resolució per la qual es té per desistit a l&apos;Ajuntament de Binissalem de la seva sol·licitud a la convocatòria per a l&apos;any 2024, 2025 i 2026 de subvencions per al suport a la implementació de la normativa de residus a les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència, finançat per la Unió Europea-Next Generation EU.</span></span></p> <p><span style="line-height: 1"><span style="color: black">15. El 23 de juny de 2025, el conseller d&apos;Empresa, Ocupació i Energia dicta la resolució per la qual es desestima la sol·licitud per a la línia 1 de la subvenció de l&apos;Ajuntament de Marratxí a la convocatòria per a l&apos;any 2024, 2025 i 2026 de subvencions per al suport a la implementació de la normativa de residus a les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència, finançat per la Unió Europea-Next Generation EU.</span></span></p> <p><span style="line-height: 1"><span style="color: black">16. L&apos;1 de juny de 2025, el director general d&apos;Economia Circular, Transició Energètica i Canvi Climàtic dicta les corresponents propostes de resolució per les quals s&apos;aprova la concessió de la subvenció a les entitats beneficiàries.</span></span></p> <p><span style="line-height: 1"><span style="color: black">17. Entre el 5 i el 25 de juny de 2025, la Intervenció General de la CAIB emet els informes de fiscalització prèvia limitada favorables a les corresponents propostes de resolució.</span></span></p> <p><span style="line-height: 1"><span style="color: black">18. Entre el 20 i el 29 de juny de 2025, el conseller de Medi Ambient i Territori dicta les corresponents resolucions de concessió, per les quals es concedeix una subvenció a les entitats beneficiàries i per als projectes i les quanties que es relacionen en l&apos;annex I, notificant-se individualment a cada una d&apos;elles.</span></span></p> <p><span style="line-height: 1"><span style="color: black">19. El 20 de juny de 2025, el conseller d&apos;Empresa, Ocupació i Energia dicta les corresponents resolucions, a proposta del director general d&apos;Economia Circular, Transició Energètica i Canvi Climàtic, per les quals es denega la subvenció a les entitats sol·licitants que es relacionen a l&apos;annex II, notificant-se individualment cadascuna d&apos;elles.</span></span></p> <p><span style="line-height: 1"><strong><span style="color: black">Fonaments de dret</span></strong></span></p> <p><span style="line-height: 1"><span style="color: black">1.
