&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data &lt;span style="background-color: rgb(255, 255, 255)"&gt;30&lt;/span&gt; de juliol de 2025, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1.En data 23 de juny de 2017 es va aprovar mitjançant Resolució de l&amp;apos;Autoritat de Gestió del Programa de Desenvolupament Rural de les Illes Balears, l&amp;apos;Estratègia de Desenvolupament Local Participatiu (EDLP), que conté les actuacions que es duran a terme durant el període 2014-2020 en aplicació de la mesura 19.2 del PDR.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Aquesta Estratègia inclou una sèrie de Projectes Programats que seran promoguts pel propi Grup d&amp;apos;Acció Local o per altres actors del territori per tal d&amp;apos;assolir els objectius que planteja la EDLP aprovada. Tot i que segons disposa la normativa d&amp;apos;aplicació, la selecció dels projectes a finançar en el marc de l&amp;apos;EDLP s&amp;apos;ha de realitzar mitjançant el procediment de concurrència competitiva entre les sol·licituds presentades en els períodes de sol·licitud que estableixi el Grup, s&amp;apos;exceptuen d&amp;apos;aquestes norma els projectes programats aprovats a la pròpia EDLP de caràcter no productiu, el promotor dels quals sigui una entitat pública amb competències en la matèria i el propi Grup d&amp;apos;Acció Local.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;2.En data 14 de gener de 2020 amb NRGE 786, el Sr. FRANCISCO CANALS CORTÉS amb NIF ***3447**, en nom i representació de l&amp;apos; ASSOCIACIÓ LEADER ILLA DE MENORCA amb NIF G57111833, va presentar una sol·licitud d&amp;apos;ajuda per al projecte «&lt;span style="background-color: rgb(255, 255, 255)"&gt;Construcció, emmagatzematge, muntatge i desmuntatge de 50 estands amb il·luminació per a les fires de Menorca”&lt;/span&gt;. Aquest projecte està inclòs a l&amp;apos;Estratègia aprovada de Desenvolupament Local com a projecte programat i està promogut per l&amp;apos;Associació Leader Illa de Menorca&lt;span style="background-color: rgb(255, 255, 255)"&gt;,&lt;/span&gt; pel que no era necessari aplicar concurrència competitiva i es va seleccionar individualment mitjançant la Resolució del vicepresident del FOGAIBA de data 23 de juliol de 2020 que fou notificada el 23 de juliol de 2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;3.En data 2 de setembre de 2020 amb NRGE 19875, el Sr. FRANCISCO CANALS CORTÈS amb NIF ***3447**, en nom i representació de l&amp;apos; ASSOCIACIÓ LEADER ILLA DE MENORCA amb NIF G57111833, va presentar una sol·licitud d&amp;apos;ajuda per al projecte &lt;span style="background-color: rgb(255, 255, 255)"&gt;“Menorca al plat de la joventut”&lt;/span&gt;. Aquest projecte està inclòs a l&amp;apos;Estratègia aprovada de Desenvolupament Local com a projecte programat i està promogut per&lt;em&gt; &lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;l&amp;apos;Associació Leader Illa de Menorca,&lt;/span&gt; pel que no era necessari aplicar concurrència competitiva i es va seleccionar individualment mitjançant la Resolució del vicepresident del FOGAIBA de data 17 de març de 2021 que fou notificada el 19 de març de 2021.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;4.Atesa l&amp;apos;esmentada Resolució de concessió de l&amp;apos;ajuda, el beneficiari s&amp;apos;obliga, entre altres, a realitzar les actuacions auxiliades dins del termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la forma i els terminis determinats en la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;5.Dins el termini legalment establert per a la justificació de les inversions aprovades, els interessats han presentat les&lt;em&gt; &lt;/em&gt;sol·licituds de pagament adients així com la documentació exigida, però, revisada aquesta, es comprova que no s&amp;apos;ha realitzat tota la despesa aprovada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;6.Els sol·licitants declaren que malgrat la diferència, s&amp;apos;han assolit tots els objectius previstos al projecte aprovat.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;7.Vist l&amp;apos;anterior i d&amp;apos;acord amb l&amp;apos;article 43 del Decret legislatiu 2/2005, de 28 de desembre.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;I. Conveni de col·laboració entre el Fons de Garantia Agrària i Pesquera de les Illes Balears com a Organisme Pagador, l&amp;apos;adjunt a la Gerència del FOGAIBA com Autoritat de Gestió i el Grup d&amp;apos;Acció Local Local per al desenvolupament rural i pesquer d&amp;apos; Eivissa i Formentera pel que s&amp;apos;estableixen les condicions per a l&amp;apos;aplicació de la mesura 19 del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ordre de la consellera d&amp;apos;Agricultura i Pesca de 23 de desembre de 2005, per la qual es disposa que el FOGAIBA assumeix l&amp;apos;execució de la política de la conselleria d&amp;apos;Agricultura i Pesca referent a l&amp;apos;aplicació de les mesures de foment i millora dels sectors agrari i pesquer a partir de l&amp;apos;1 de gener de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;XI. Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l&amp;apos;Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l&amp;apos;Ordre de la consellera d&amp;apos;Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l&amp;apos;assumpció de l&amp;apos;execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l&amp;apos;article 1 que el FOGAIBA assumeix l&amp;apos;execució de la política de la Conselleria d&amp;apos;Agricultura i Pesca referent a l&amp;apos;aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l&amp;apos;1 de gener de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;XII. Ordre del conseller d&amp;apos;Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s&amp;apos;estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;XIII. La resta de la normativa que li sigui d&amp;apos;aplicació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Proposta de resolució de revocació parcial&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Per tot això, s&amp;apos;informa favorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;1.Procedir a la revocació parcial de la Resolució d&amp;apos;ajuda concedida al beneficiari i per l&amp;apos;import detallats a l&amp;apos; Annex I , que són un total de 2 expedients que comença amb l&amp;apos;Associació Leader Illa de Menorca &lt;em&gt; &lt;/em&gt;i acaba amb l&amp;apos;Associació Leader Illa de Menorca, que suma un import total de 7.085,79 euros, relativa a la línia d&amp;apos;ajuda ‘&amp;apos;Implementació operacions incloses a les EDLP&amp;apos;&amp;apos;, ja que la justificació de la despesa ha estat inferior a l&amp;apos;aprovada. L&amp;apos;import total de l&amp;apos;ajuda finalment concedida haurà de ser 102.005,01&lt;em&gt; &lt;/em&gt;euros.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
