    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La Junta Rectora del Consorci de la Ciudad Romana de Pol·lèntia en sessió celebrada dia 22/07/2025 va aprovar la modificació dels seus Estatuts, que a continuació es transcriu, per a general coneixement i als efectes oportuns. Se podrà consultar un text consolidat dels Estatuts, a efectes informatius, en la seu electrònica del Consorci:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;MODIFICACIÓ DELS ESTATUTS DEL CONSORCI CIUTAT ROMANA DE POL·LÈNTIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El 30 de novembre de 2000 es va signar el Conveni Marc de la Col·laboració entre l'Ajuntament d'Alcúdia, el Consell Insular de Mallorca, el Govern de les Illes Balears i el Ministeri de Cultura i Esport per a la constitució del Consorci de la Ciutat Romana de Pol·lèntia, el qual incloïa els Estatuts, com a annex, els quals foren publicats en el Butlletí Oficial de les Illes Balears, de 3 febrer de 2001.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;L'entrada en vigor de la Llei 40/2015, d'1 d'octubre, de Règim Jurídic del Sector Públic – LRJSP-, introdueix una nova regulació dels consorcis en el marc del Sector Públic. En la seva disposició transitòria segona establia normes d'aplicació directa, mentre que la disposició addicional quarta establia un termini d' adaptació que finalitzava l'1 d'octubre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Hores d'ara aquesta adaptació legal no s'ha dut a terme, però el Consorci hi ha anat avançant, i, de fet l'Ajuntament ha exercit les seves potestats com a administració d'adscripció del Consorci, i així el Ple de l'Ajuntament n'ha aprovat tant el pressupost com la liquidació. Això, no obstant, es fa necessari regularitzar aquesta situació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El passat 17 de desembre de 2024 es va dur a terme una Junta Rectora on es va presentar la Proposta de Modificació dels Estatuts, que es va aprovar per unanimitat del assistents. Al punt segon de la proposta s'indicava que: “Segon. – D'acord amb l'article 25 dels Estatuts, el present acord de modificació dels Estatus requerirà de la ratificació per part dels membres, fundadors o adherits, per a la seva eficàcia.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El Consorci ha rebut la ratificació de tres del quatre membres que el formen; el Govern Balear, el Consell de Mallorca i l'Ajuntament d'Alcúdia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En virtut d'això, el Ministeri de Cultura va fer arribar al Consorci en data de 10 d' abril de 2025, un document os es recullen un seguit de consideracions. Posteriorment, a fi d'incorporar-ne el contingut, el passat dia 4 de juny es va dur a terme una reunió protagonitzada per els quatre tècnics representants de les institucions del Consorci per tal d'exposar i acordar diversos aspectes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;tècnics. Acte seguit, en data de 10 de juny, el Govern va fer arribar les seves aportacions, i finalment, el 19 de juny el Ministeri traslladà les respectives valoracions sobre la qüestió. A fi d'incorporar-ne la majoria, i evitant una modificació substancial del text de l'aprovació que es va aprovar a la Junta Rectora de dia 17 de desembre de 2024, s'ha redactat la nova proposta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;La Junta, d'acord amb l'article 11.2 dels Estatuts del Consorci, es l'òrgan competent per modificar els Estatus, i adopta els següent ACORD:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Modificar els Estatuts del Consorci de la Ciutat Romana de Pol·lèntia en els següents termes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1.- Es dona nova redacció a l'article 1, amb el següent contingut:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;“ARTICLE 1.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. &lt;em&gt;El Consorci, amb el nom de “Consorci de la Ciutat Romana de Pol·lèntia”, té caràcter voluntari i se regirà pels presents Estatuts, als quals subjectarà la seva activitat .&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;em&gt;Serà d'aplicació al Consorci allò disposat per la Llei 40/2015, d'1 d' octubre, de Règim jurídic del Sector Públic, en els termes de l'art. 119, i, amb caràcter supletori, les normes establertes a la Llei 3/2003, de 26 de març, de Règim Jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears així com en la normativa de règim local, estatal i autonòmica que resulti d'aplicació.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2.- Es dona nova redacció a l'article 2, amb el següent contingut:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;“ARTICLE 2.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;El Consorci té com a finalitat la d'ampliar, mantenir, conservar, restaurar, protegir i difondre les restes arqueològiques de l'antiga Ciutat Romana de Pollentia situada al municipi d'Alcúdia podent desenvolupar tantes activitats com contribueixin al foment de la cultura i del coneixement del nostre passat així com participar i col·laborar en les activitats del Museu Monogràfic de Pollentia.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3.- Es dona nova redacció a l'article 3 amb el següent contingut: “&lt;em&gt;ARTICLE 3.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. &lt;em&gt;El Consorci té plena capacitat jurídica, podent adquirir, permutar, gravar i &lt;/em&gt;alienar tota classe de bens i drets, així com contreure obligacions i exercitar tot&lt;em&gt; tipus d´accions, civils, administratives, laborals i de qualsevol classe, davant la jurisdicció corresponent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;em&gt;El Consorci no té finalitat lucrativa.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4.- Es dona nova redacció a l'Article 4 que queda amb el següent contingut:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;“ARTICLE 4.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;L'àmbit d'actuació del Consorci són les Illes Balears.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;5.- Es dona nova redacció a l'Article 5 que queda amb el següent contingut:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;“ARTICLE 5.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;La Seu del Consorci és al Casal de Can Domènec, al Carrer Dels Albellons, 7, de la Ciutat d'Alcúdia”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6.- Es dona nova redacció a l'article 6, que queda com segueix: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;“&lt;em&gt;ARTICLE 6.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;La duració del Consorci és indefinida fins que sigui dissolt d'acord amb la llei i els presents Estatuts.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7.- Es dona nova redacció a l'article 7, amb el següent contingut: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;“&lt;em&gt;ARTICLE 7.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. &lt;em&gt;El Consorci està constituït per l'Ajuntament d'Alcúdia, el Consell Insular de Mallorca, el Govern de les Illes Balears i el Ministeri de Cultura.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;em&gt;En compliment de l'article 124.b) de la llei 40/2015, les Administracions Públiques membres del Consorci, hauran de contribuir al pressupost general del mateix per a cobrir les despeses de funcionament i d'activitat ordinària, serà d' un mínim de 50.000.- € anuals cada una, sense perjudici que puguin superar- lo. No obstant, les aportacions resten condicionades a les disponibilitats pressupostàries de cada administració.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. &lt;em&gt;Les entitats consorciades comunicaran cada any al Consorci les quantitats que preveuen aportar abans de l'aprovació dels pressupostos anuals. El Consorci vetllarà de no emprendre activitats pressupostades sense prèviament haver assegurat els ingressos pertinents dels ens consorciats, d'acord amb l'article&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;124. b) de la Llei 40/2015.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;8.- S'afegeix un article 7 bis amb el següent contingut:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;“ARTICLE 7 bis.-&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;El Consorci quedarà adscrit a l'Ajuntament d'Alcúdia d'acord amb el que disposa l'article 120, apartats 2 al 4 de la Llei 40/2015.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;em&gt;Les sessions de la Junta Rectora es realitzaran de manera presencial o a distància. En les sessions que la Junta Rectora celebri a distància, els seus membres podran trobar-se a diferents llocs, sempre i quan s'asseguri per medis electrònics, considerant-se com a tals els telefònics i audiovisuals, la identitat dels membres o persones que els supleixin, el contingut de les seves manifestacions, el moment en que aquestes es produeixen, així com la interactivitat i intercomunicació entre ells en temps real.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. &lt;em&gt;Per a la vàlida adopció d´acords que a la mateixa corresponguin es requerirà la majoria de vots dels seus membres.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. &lt;em&gt;S'emetrà un únic vot per cada representant de la Junta Rectora.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El Gerent acudirà en qualitat d'oient.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;em&gt;Serà el president de la Comissió Tècnica el que ho sigui de la Junta Rectora.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. &lt;em&gt;Cada Institució podrà designar un suplent per a cada representant titular.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. &lt;em&gt;Serà secretari/a de la Comissió Tècnica el que ho sigui de la Junta Rectora o persona en qui delegui.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. &lt;em&gt;bis. Les sessions de la Comissió Tècnica es realitzaran de manera presencial o a distància. En las sessions que la Comissió Tècnica celebri a distància, els seus membres podran trobar-se a diferents llocs, sempre i quan s'asseguri per medis electrònics, considerant-se com a tals els telefònics i audiovisuals, la identitat dels membres o persones que els supleixin, el contingut de les seves &lt;/em&gt;manifestacions, el moment en que aquestes es produeixen, així com la interactivitat i intercomunicació entre ells en temps real.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;em&gt;Per a la vàlida adopció d´acords que a la mateixa corresponguin es requerirà la majoria de vots dels seus membres.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Són indelegables les atribucions de les lletres a),b),c) i d).”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;em&gt;El Consorci queda sotmès a control financer, que s´efectuarà mitjançant procediments d´auditoria, pels òrgans que la legislació vigent determini.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El personal al servei del Consorci podrà ser funcionari o laboral i procedirà exclusivament de les Administracions participants. El seu règim jurídic serà el de l'Administració Pública d'adscripció i les seves retribucions no podran superar les establertes per llocs de treball equivalents en aquella.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;2. Quan no resulti possible disposar de personal procedent de les Administracions presents en el Consorci, sempre de forma excepcional i en atenció a la singularitat de las funcions a desenvolupar, el Ple de l'ajuntament d' Alcúdia, com a administració a la qual està adscrita el Consorci, podrà autoritzar la contractació directa del personal per part del Consorci per a l'exercici de dites funcions.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Separació del Consorci.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. &lt;em&gt;Els membres del Consorci podran separar-se del mateix en qualsevol moment.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;em&gt;El dret de separació s'haurà d'executar mitjançant escrit notificat a la Junta Rectora del Consorci.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. &lt;em&gt;En l'escrit de l'apartat anterior s'haurà de fer constar l'incompliment que s' atribueix a algun dels seus membres respecte de les seves obligacions estatutàries, que motiva la separació, en particular, d'acord amb l'article 125.1 de la Llei 40/2015, aquelles que impedeixin complir amb la finalitat per a la qual ha estat creat el Consorci, com ho és l'obligació de realitzar aportacions als fons patrimonial. L'escrit inclourà un requeriment previ i el termini atorgat per dar-li compliment.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. &lt;em&gt;Si l'exercici del dret de separació no comporta la dissolució del Consorci, s' aplicarà el que es disposa en l'article 126.2 de la Llei 40/2015 d'1 d'octubre, de Règim Jurídic del Sector Públic, procedint-se a la liquidació parcial conforme s' estableix en l'article següent.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&amp;#xa0;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;ARTICLE 27.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Dissolució i liquidació del Consorci.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. &lt;em&gt;El Consorci podrà dissoldre's per acord unànime dels membres que el conformen, previ acord dels seus òrgans competents, amb l'obligació de fer front als compromisos adquirits fins a la data d'aprovació de l'acord de dissolució.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;Podrà dissoldre's, igualment, per l'exercici del dret de separació d'alguns dels membres del Consorci, tret que la resta dels seus membres, de conformitat amb el que es preveu en aquests estatuts, acordin la seva continuïtat i continuïn romanent en el Consorci, almenys, dues Administracions o entitats o organismes públics vinculats o dependents de més d'una Administració.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;em&gt;La dissolució del Consorci produeix la seva liquidació i extinció.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. &lt;em&gt;La Junta Rectora del Consorci, en adoptar l'acord de dissolució, nomenarà un liquidador, que serà un òrgan de l'Ajuntament d'Alcúdia.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. &lt;em&gt;El liquidador calcularà la quota de liquidació que correspon a cada membre del Consorci en conformitat amb la participació que correspongui en el saldo resultant del patrimoni net després de la liquidació. El criteri de repartiment s' establirà tenint en compte tant el percentatge de les aportacions que hagi efectuat cada membre al fons patrimonial d'aquest, com el finançament en els últims cinc anys.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. &lt;em&gt;S'acordarà per la Junta Rectora del Consorci la forma i condicions en què tindrà lloc el pagament de la quota de liquidació en el supòsit en què aquesta resulti positiva.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;6 . Les entitats consorciades podran acordar, amb la majoria de dos terços del total dels membres, la cessió global d'actius i passius a una altra entitat jurídicament adequada amb la finalitat de mantenir la continuïtat de l'activitat i aconseguir els objectius del Consorci que s'extingeix. La cessió global d'actius i passius implicarà l'extinció sense liquidació del Consorci.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;7. El conveni col·lectiu dels treballadors del Consorci podrà preveure que, en el cas de liquidació, el personal del Consorci, que no depengui d'altres administracions, i que hagi superat processos de selecció, en compliment dels principis de publicitat, mèrit i capacitat, s'integri en la plantilla municipal.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
