![CDATA[<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Antecedents</strong></span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1. La Llei orgànica 3/2020, de 29 de desembre (LOMLOE), que modifica la Llei orgànica 2/2006, de 3 de maig, d'Educació, estableix que els centres educatius han de disposar dels recursos necessaris per garantir una educació de qualitat per a tot l'alumnat. Aquesta llei impulsa la dotació de recursos, tant materials com humans, per afavorir la igualtat d'oportunitats i l'èxit escolar de tots els estudiants.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. El Decret 43/2025, d'1 d'agost, pel qual s'estableix l'ordenació i el currículum del batxillerat a les Illes Balears, determina un augment de les hores lectives a primer de batxillerat, passant de 31 a 33 hores setmanals. L'objectiu és millorar els aprenentatges essencials, garantir una formació integral i preparar l'alumnat per afrontar amb maduresa els reptes socials, professionals i acadèmics. </span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">A més, aquest Decret, en relació a la modalitat de batxillerat general, introdueix l'obligatorietat d'impartir-la, encara que només hi hagi un alumne, la qual cosa suposa que el nombre d'hores concertades actualment sigui insuficient per impartir totes les matèries de modalitat i optatives en els centres entre una i quatre unitats concertades. </span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3. L'article 19 del Decret 59/2022, de 27 de desembre, pel qual s'estableixen les normes que han de regir les convocatòries per a l'establiment i la renovació de concerts educatius a partir del curs 2023-2024, estableix mitjançant l'Ordre de la consellera d'Educació i Cultura de 7 de maig de 2008 per la qual es regula la dotació dels equips docents als nivells educatius concertats (BOIB núm. 65, de 13 de maig), modificada per l'Ordre de la consellera d'Educació i Cultura de 23 de juny de 2009 (BOIB núm. 96, de 4 de juliol) les plantilles finançades per l'Administració educativa per impartir el pla d'estudis vigents. El nombre d'hores concertades per a batxillerat resulta insuficient per a la nova configuració curricular prevista.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">4. El Decret 59/2022, de 27 de desembre, en el seu article 20.3, estableix que el director general de Planificació, Ordenació i Centres pot autoritzar altres conceptes puntuals, amb informe previ de la Comissió de Concerts. </span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">5. La planificació del curs escolar amb temps suficient assegura un inici escolar exitós, ja que facilita la coordinació entre docents, famílies i alumnat, i contribueix a una experiència educativa més fluida i professional. Per tant, és convenient preveure l'augment d'hores lectives derivat tant de l'aplicació del nou currículum com de la introducció obligatòria d'impartir la modalitat de batxillerat general, atès que en l'Ordre de la consellera d'Educació i Cultura de 7 de maig de 2008 modificada per l'Ordre de la consellera d'Educació i Cultura de 23 de juny de 2009 no estan previstes. </span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">6. En aquest sentit, la Comissió de Concerts, en data de 9 de juny de 2025, ha informat favorablement sobre l'augment de la dotació horària de batxillerat als centres concertats amb unitats d'aquesta etapa, d'acord amb els criteris següents:</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Aquestes hores s'han de destinar exclusivament per impartir les matèries específiques de modalitat i/o matèries optatives. Han de ser impartides per professorat amb atribució docent en matèries de batxillerat i només es poden utilitzar per a alumnat d'aquesta etapa.</span></span></span></p>

D'acord amb el Decret 6/2025, de 2 de juny, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm.70, de 3 de juny) correspon a la Direcció General de Personal Docent i Centres Concertats la gestió dels centres concertats.</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1. Autoritzar l'augment de dotació horària de batxillerat dels centres concertats, d'acord amb el que preveu l'annex 1 d'aquesta Resolució.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. Determinar que les hores autoritzades han de ser impartides per professorat amb atribució docent en matèries de batxillerat i destinades exclusivament a l'alumnat de batxillerat per tal d'impartir les matèries específiques de modalitat i/o matèries optatives.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3. Aprovar el model de sol·licitud de l'ampliació horària, que figura com a annex 1 d'aquesta resolució.</span></span></span></p>
<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">4. Ordenar la publicació d'aquesta resolució i el seu annex en el Butlletí Oficial de les Illes Balears i a la pàgina web del Departament de Centres Concertats de la Conselleria d'Educació i Universitats.</span></span></span></p>

<p><span style="color: rgb(0, 0, 0)"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Contra aquesta resolució, que no exhaureix la via administrativa, es pot interposar recurs d'alçada davant el conseller d'Educació i Universitats en el termini d'un mes comptador des de l'endemà del dia de la seva publicació, d'acord amb els articles 121 i 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 58 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></span></p>
