    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="color:#000000"&gt;En data de la signatura digital, el director general d'Economia circular, Transició E&lt;/span&gt;&lt;span style="color:#000000"&gt;nergètica i Canvi Climàtic ha formulat la proposta definitiva següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Fets&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;1. El 26 de desembre de 2023 es va publicar la convocatòria pública de subvencions per al foment d'instal·lacions d'autoconsum amb o sense emmagatzematge elèctric amb fonts d'energia renovable, així com a de renovables tèrmiques, promogudes per a persones físiques dins les actuacions previstes en el Pla d'Inversions per a la Transició Energètica de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea (NextGenerationEU) (BOIB núm. 174, de 26 de desembre de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;2. Les persones que figuren en l'annex d'aquesta resolució varen obtenir una subvenció per a la implantació d'instal·lacions renovables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;3. Les persones que figuren en l'annex d'aquesta resolució varen presentar la documentació justificativa de les actuacions realitzades, en què s'acredita que l'import de l'actuació ha estat inferior al previst inicialment o s'ha reduït la instal·lació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;4. Els serveis tècnics competents han informat favorablement sobre el pagament de les subvencions descrites en l'annex, en què s'inclou una minoració de l'import proporcional a les modificacions realitzades, les quals s'han calculat d'acord amb la Resolució de convocatòria d'aquests ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;5. El 2 de juliol de 2025, es va emetre la Proposta de resolució provisional del director general d'Economia Circular, Transició Energètica i Canvi Climàtic per la qual es minora la quantitat de l'ajut i es proposa el pagament del director general d'economia Circular, Transició Energètica i Canvi Climàtic (BOIB núm. 86, de 5 de juliol de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;6. El 2 d'agost de 2025, es va publicar en el BOIB núm. 102, la Resolució del conseller d'Empresa, Autònoms i Energia per la qual es corregeix l'error observat a l'annex de la proposta de resolució provisional del director general de Economia Circular, Transició Energètica i Canvi Climàtic de 5 de juliol de 2025 per la qual es minora la quantitat d'ajut i es proposa el pagament en el marc de la convocatòria pública de referència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;7. S'ha exhaurit el termini que es concedia per presentar al·legacions sense que se'n hagin presentat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;1. La Llei 38/2003, de 17 de novembre, general de subvencions. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;2. El Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;3. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;4. El Decret 75/2004, de 27 d'agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm. 122, de 2 de setembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;5. L'Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en matèria d'energia (BOIB núm. 72, de 24 de maig de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;6. L'Ordre HFP/1030/2021, de 29 de setembre, per la qual es configura el sistema de gestió del Pla de Recuperació, Transformació i Resiliència, així com per l'Ordre HFP/1031/2021, de 29 de setembre, per la qual s'estableix el procediment i format de la informació a proporcionar per les entitats del sector públic per al seguiment del compliment de les fites i objectius i d'execució pressupostària i comptable de les mesures dels components del Pla de Recuperació, Transformació i Resiliència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;7. El Reial decret 451/2022, de 14 de juny, pel qual es regula la concessió directa d'ajudes destinades al finançament d'estratègies d'energia sostenible per a les Illes Balears i Canàries, en el marc del Pla de Recuperació, Transformació i Resiliència, s'emmarca en el Pla de Recuperació, presentat pel Govern espanyol el 21 d'abril de 2021 i aprovat per la Decisió d'Execució del Consell relativa a l'aprovació de l'avaluació del Pla de Recuperació i Resiliència d'Espanya (Council Implementing Decision-CID), de 13 de juliol de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;8. El Reial decret 244/2019, de 5 d'abril, pel qual es regulen les condicions administratives, tècniques i econòmiques de l'autoconsum d'energia elèctrica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;9. La Resolució del conseller d'Empresa, Ocupació i Energia per la qual s'aprova, mitjançant el procediment de despesa anticipada, la convocatòria pública de subvencions per al foment d'instal·lacions d'autoconsum amb o sense emmagatzematge elèctric amb fonts d'energia renovable, així com a de renovables tèrmiques, promogudes per a persones físiques dins les actuacions previstes en el Pla d'Inversions per a la Transició Energètica de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea (NextGenerationEU) (BOIB núm. 174, de 26 de desembre de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Proposta de resolució definitiva&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;Propòs al conseller d'Empresa, Autònoms i Energia que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;1. Reconèixer l'obligació i proposar el pagament de l'ajut als beneficiaris que figuren en l'annex, d'acord amb l'import que també s'hi indica. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;2. Revocar parcialment la subvenció concedida ja que la quantitat de cost elegible ha estat inferior al previst.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;3. Autoritzar i disposar negativament la despesa a revocar parcialment dels beneficiaris i pels imports detallats a l'annex.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;4. Establir que els beneficiaris estan obligats a complir amb el que disposa l'apartat dissetè de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;5. Disposar que tota alteració de les condicions establertes per a la concessió de la subvenció, com també l'obtenció concurrent de subvencions o ajuts atorgats per altres administracions públiques o ens públics, nacionals o internacionals, dona lloc a la revisió parcial o total de la subvenció i, per tant, al reintegrament de la quantitat corresponent més els interessos de demora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;6. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="background-color:#ffffff"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Empresa, Autònoms i Energia en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació de la resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
