&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El cap de servei d'Ajudes PAC del FOGAIBA, en data 29 de juliol de 2025, va signar la següent proposta provisional,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En data de 19 de desembre de 2023 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 171 la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), per la qual es convoquen, mitjançant el procediment anticipat de despesa i per als anys 2023 i 2024, subvencions per a la creació d'empreses de joves agricultors i agricultores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. De conformitat amb l'apartat sisè de l'esmentada Resolució, el termini de presentació de sol·licituds va acabar el dia 29 de febrer de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En data de 14 de juny de 2025 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 75 la &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;notificació de deficiències&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; als beneficiaris de les ajudes, de data 9 de juny de 2025, a l'empara de la Resolució del president del Fons de Garantia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat establerts, els interessats assenyalats a l' &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Annex I &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;adjunt &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;no compleixen&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; amb algun dels requisits prevists a la convocatòria per poder ser beneficiaris de l'ajuda, pels motius indicats a l'esmentat annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Correspon proposar per a denegar els expedients assenyalats a l'Annex I pels motius indicats a l'esmentat annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), per la qual es convoquen, mitjançant el procediment anticipat de despesa i per als anys 2023 i 2024, subvencions per a la creació d'empreses de joves agricultors i agricultores. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;2. Ordre 10/2023 de la consellera d'Agricultura, Pesca i Alimentació, de 5 d'abril de 2023, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de desenvolupament rural de les Illes Balears 2023-2027, correspon aprovar la convocatòria d'aquestes ajudes mitjançant una resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3. Llei 39/2015 de 1 d'octubre de règim jurídic de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Per tot això, s'informa desfavorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Denegar l'ajuda sol·licitada pels interessats que figuren a &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;l'Annex I&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; , que són un total de 4 expedients i que comença amb LLORENÇ MOLL ARGUIMBAU&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;i acaba amb OLGA VILLALONGA ROMAN, relativa a la línia d'ajudes «Creació d'empreses de joves agricultors», per no complir amb algun dels requisits que s'estableixen a la convocatòria i que s'especifiquen a l'esmentat annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1. Declarar conclòs el procediment i procedir a l'arxiu dels expedients detallats a l&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;'Annex I.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;2. Comunicar aquesta proposta provisional als interessats, fent-los evident que disposen d'un termini màxim de 10 dies hàbils , comptadors des de la publicació a la pàgina web del FOGAIBA d'aquesta proposta, per presentar al·legacions. En el cas de no fer ús del seu dret per al·legar, en el termini indicat, o si manifesta la seva decisió de no efectuar al·legacions ni aportar nous documents o justificacions, aquesta proposta tindrà caràcter definitiu, i s'elevarà al vicepresident del FOGAIBA per a què dicti la Resolució de denegació de l'ajuda sol·licitada.&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;span style="font-size:10px"&gt;A la sol·licitud d'ajuda va assenyalar 45 punts indicant dues orientacions productives (Cultius hortícoles/frutícoles/fruits secs, en regadiu i Cereals/farratges sembrats/proteaginoses i fruits secs/horticultura/fruticultura en secà). &lt;/span&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;span style="font-size:10px"&gt;L'explotació sols pot tenir una orientació productiva i ve marcada per l'activitat que aporti més UTAS. No obstant això, el pla empresarial sols computa 1 UTA en total (0,87 UTAS de cultius en regadiu i 0,179 UTAS de cultiu en secà) i per tant no compleix les condicions per assolir la puntuació de cap de les dues orientacions productives. &lt;/span&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;span style="font-size:10px"&gt;Segons l'apartat setè de la convocatòria, les orientacions productives han de complir el següent:&lt;/span&gt;&lt;/p&gt;

			&lt;p style="margin-left:40px; text-align:left"&gt;&lt;span style="font-size:10px"&gt;1. Cultius hortícoles/frutícoles/fruits secs, en regadiu: +25% de SAU (superfície agrària útil) i que aquesta superfície suposi 1 mínim d'1 UTA.&lt;/span&gt;&lt;/p&gt;

			&lt;p style="margin-left:40px; text-align:left"&gt;&lt;span style="font-size:10px"&gt;2. Cereals/farratges sembrats/proteaginoses i fruits secs/horticultura/fruticultura en secà: +50% de SAU (superfície agrària útil) i que aquesta superfície suposi 1 mínim d'1 UTA.&lt;/span&gt;&lt;/p&gt;
