&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Històricament, l'Escola d'Art d'Eivissa havia impartit els cicles formatius d'Arts Plàstiques i Disseny en horari de matí fins al curs 2023-2024. En aquest curs, es va sol·licitar i autoritzar la impartició del cicle formatiu de Grau Superior LOE d'Ebenisteria Artística en torn de tarda (BOIB núm. 51, 18/04/2024), amb la intenció d'adaptar els estudis al perfil de l'alumnat i facilitar la conciliació, esperant un augment de matrícula.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Direcció de l'Escola d'Art d'Eivissa ha sol·licitat el canvi d'horari del cicle formatiu de Grau Superior LOE d'Ebenisteria Artística al torn de matí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La petició actual de retornar el cicle d'Ebenisteria Artística al torn de matí es justifica per la no consecució de l'augment esperat de matrícula, la qualitat de l'ensenyament i les greus dificultats organitzatives derivades de l'horari de tarda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Durant el curs 2025-2026, el segon curs d'Ebenisteria Artística es mantindrà en torn de tarda per no perjudicar els drets de l'alumnat ja matriculat. L'horari d'aquest segon curs es veurà modificat per adaptació a la normativa vigent, amb una reducció de 68 hores, que repercutirà en l'horari general del centre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El canvi d'horari al torn de matí no suposarà cap augment de quota ni de dotació material.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. L'evolució de la matrícula del cicle d'Ebenisteria Artística GS LOE mostra que el nombre d'alumnes no ha augmentat en els dos darrers cursos en què el cicle s'ha impartit en torn de tarda:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. En data 8 de juliol de 2025, la cap de servei dels Ensenyaments de Règim Especial va emetre un informe favorable al canvi de torn (de tarda a matí) del cicle formatiu d'Ebenisteria Artística, atès que el Claustre de professors i el Consell Escolar aproven el canvi, i no suposa increment de quota ni de dotació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. En data 11 de juliol de 2025, la directora general de Planificació i Gestió Educatives va proposar la modificació de la configuració de l'Escola d'Art (EA) d'Eivissa, amb el canvi de torn del cicle formatiu de Grau Superior LOE d'Ebenisteria Artística de tarda a matí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Llei orgànica 8/1985, de 3 de juliol, reguladora del dret a l'educació (BOE núm. 159, de 4 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Llei orgànica 2/2006, de 3 de maig, d'educació (BOE núm. 106, de 4 de maig), modificada per la Llei orgànica 3/2020, de 29 de desembre (BOE núm. 340, de 30 de desembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. L'Estatut d'autonomia de les Illes Balears, aprovat per la Llei orgànica 1/2007, de 28 de febrer (BOE núm. 52, d'1 de març), el qual estableix, en l'article 36.2, que, en matèria d'ensenyament, correspon a la Comunitat Autònoma de les Illes Balears la competència de desenvolupament legislatiu i d'execució de l'ensenyament en tota la seva extensió, nivells i graus, modalitats i especialitats.4.&amp;nbsp;La Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 44, de 3 d'abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Llei 1/2022, de 8 de març, d'educació de les Illes Balears, la qual estableix a l'article 102, punt 2 de creació de centres que la creació, la supressió i la transformació de centres privats s'ha de sotmetre a l'autorització administrativa corresponent (BOIB núm. 38, de 17 de març).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El Reial decret 303/2010, de 15 de març, pel qual s'estableixen els requisits mínims dels centres que imparteixen els ensenyaments artístics regulats a la Llei orgànica 2/2006, de 3 de maig, d'educació (BOE núm. 86, de 9 d'abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Reial decret 596/2007, de 4 de maig, pel qual s'estableix l'ordenació general dels ensenyaments professionals d'Arts plàstiques i disseny (BOE núm. 125, de 25 de maig).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Reial decret 219/2015, de 27 de març, pel qual s'estableix el títol de Tècnic Superior d'Arts Plàstiques i Disseny en Ebenisteria Artística pertanyent a la família professional artística d'Escultura i s'aprova el corresponent currículum bàsic (BOE núm. 97, de 23 d'abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El Decret 10/2025, de 14 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm.91, de 14 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, i d'acord amb la proposta formulada per la Direcció General de Planificació i Gestió Educatives en data 11 de juliol de 2025, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cicles formatius de grau superior d'Arts plàstiques i disseny:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;
	&lt;ul class="decimal"&gt;
		&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Modelisme d'Indumentària (LOGSE) a partir del curs 1997-1998, amb l'horari modificat segons la resolució corresponent a partir del curs 2025-2026.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
		&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Moblament (LOGSE) a partir del curs 1998-1999&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
		&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ebenisteria Artística (LOE) a partir del curs 2018-2019, modalitat presencial i torn de matí, mantenint el segon curs en torn de tarda durant el curs 2025-2026 per no perjudicar els drets de l'alumnat ja matriculat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;/ul&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Inscriure aquesta autorització en el Registre estatal de centres docents no universitaris del Ministeri d'Educació, Formació Professional i Esports (RCD) i en el Registre de centres de la Direcció General de Planificació i Gestió Educatives.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Fer avinent al centre esmentat que resta obligat a complir la legislació vigent i a sol·licitar la revisió oportuna de la seva configuració quan s'hagi de modificar qualsevol de les dades que figuren en aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Notificar aquesta resolució a l'Escola d'Art d'Eivissa als efectes oportuns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Universitats en el termini d'un mes a comptar des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També s'hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos a comptar des de l'endemà de la publicació, d'acord amb els articles 10 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
