703549 CAIB 40041 310 CAIB 2025-07-18 ca text/html ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">La consellera executiva de Promoció Econòmica i Desenvolupament Local del Consell Insular de Mallorca dia 17 de juliol de 2025, ha dictat la següent resolució:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">“<strong>Antecedents de fet</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Primer. </span></strong><span style="line-height:107%">En data 13 de març de 2025 es va dictar, por la consellera executiva de Promoció Econòmica i Desenvolupament Local, resolució per la qual s'aprova la convocatòria de cooperacions tècniques del Consell de Mallorca per l'any 2025 relativa a la redacció de projectes i la direcció tècnica d'obres municipals.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Segon. </span></strong><span style="line-height:107%">En data 17 de juliol de 2025, una vegada fetes les comprovacions de viabilitat previstes a l'apartat 6c) de la convocatòria, pel servei d'assistència tècnica es va emetre informe indicant quals del projectes poden ser objecte de cooperació tècnica sol·licitada i quals han de ser exclosos. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong><span style="line-height:107%">Tercera.</span></strong><span style="line-height:107%"> En data 17 de juliol de 2025, s'ha signat per part del secretari tècnic del departament, la proposta de resolució de concessió de la convocatòria de cooperacions tècniques del Consell de Mallorca per l'any 2025 relativa a la redacció de projectes i la direcció tècnica d'obres municipals.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Fonaments dret</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">I. L'article&nbsp; 36.1. lletra&nbsp; b)&nbsp; de la&nbsp; Llei&nbsp; 7/1985,&nbsp; de&nbsp; 2&nbsp; d'abril,&nbsp; reguladora&nbsp; de les Bases&nbsp; del Règim&nbsp; Local, que estableix com competència dels Consells Insulars la cooperació tècnica als municipis.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">II. L'article 29, que du per títol "Plans de cooperació tècnica" del Reglament abans esmentat, disposa a l'apartat 1 que "<em>el Consell de Mallorca ha de fer una convocatòria de cooperació tècnica per a la redacció de projectes com per a la direcció tècnica de les obres, que no té periodicitat preestablerta i es farà en funció de les disponibilitats i la càrrega de treball dels serveis</em>".</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">III. Atesa la singularitat d'aquesta convocatòria, el criteri de concessió aplicat s'ajusta a allò previst al paràgraf segon de l'article 17.1 de l'Ordenança General de Subvencions aprovada per Acord de Plenari de data 23 de desembre de 2016, que disposa: “<em>No és necessari fixar un ordre de prelació entre les sol·licituds presentades que reuneixen els requisits establerts si el crèdit consignat en la convocatòria és suficient, atenent el nombre de sol·licituds una vegada finalitzat el termini de presentació</em>”. En aquest cas, si bé es va realitzar informe de valoració de la viabilitat dels projectes puntuant-los el règim de concessió és de concurrència no competitiva, perquè es concediran les cooperacions de tots els projectes que compleixin amb les condicions de viabilitat sense que cap beneficiari sigui exclòs per la manca de capacitat per atendre les sol·licituds presentades.</span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Resolució</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">Per tot l'exposat anteriorment, la consellera executiva de Promoció Econòmica i Desenvolupament Local aprova la següent concessió:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><span style="line-height:107%">1.
