Sant Antoni de Portmany &lt;/span&gt;&lt;span style="color:#000000"&gt;que consta a l'expedient núm. 2024/00016495G, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb CSV 15703121472153720142.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SEGON. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;APROVAR i DISPOSAR&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; la despesa màxima &lt;/span&gt;&lt;span style="color:#000000"&gt;d'&lt;/span&gt;&lt;span style="color:#000000"&gt;un&lt;/span&gt;&lt;span style="color:#000000"&gt; milió sis mil set-cents vuitanta-sis euros amb un cèntim (1.006.786,01 €)&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;en favor de l'Ajuntament &lt;/span&gt;&lt;span style="color:#000000"&gt;de Sant Antoni de Portmany&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;NIF&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;P0704600-F,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;amb motiu de finançar les obligacions derivades de la formalització del conveni específic entre &lt;/span&gt;&lt;span style="color:#000000"&gt;el Consell Insular d'Eivissa i &lt;/span&gt;&lt;span style="color:#000000"&gt;l'Ajuntament de Sant Antoni de Portmany per a l'execució del&lt;/span&gt;&lt;span style="color:#000000"&gt; projecte “Itinerari accessible en la Carretera Ei-500 connexió nucli urbà i Col·legi Públic de Santa Agnès de Corona T.M. Sant Antoni de Portmany&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;”&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;amb càrrec a l'aplicació pressupostària 9420.7620&lt;/span&gt;&lt;span style="color:#000000"&gt;2&lt;/span&gt;&lt;span style="color:#000000"&gt; (RC núm. 2/2025000002819&lt;/span&gt;&lt;span style="color:#000000"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Sant Antoni de Portmany,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;les persones següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vicent Marí Torres, president del Consell Insular d'Eivissa per nomenament del Ple reunit en sessió extraordinària de 25 de juny de 2023, &lt;/span&gt;&lt;span style="color:#000000"&gt;en nom i representació d'aquesta entitat, i en virtut de les atribucions que li confereixen l'article 21 de la Llei 4/2022, de 28 de juny de consells insulars; els articles 34 i 41.3 de la Llei 7/1985, de 2 d'abril, que regula les bases de règim local, i l'art. 52 del Reglament orgànic d'aquesta corporació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Marcos Serra Colomar&lt;/span&gt;&lt;span style="color:#000000"&gt;, alcalde de l'Ajuntament de Sant Antoni de Portmany per nomenament del Ple de 17 de juny de 2023, en nom i representació d'aquesta entitat, actuant en virtut de les facultats previstes a l'article 21.1.b) de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les parts es reconeixen mútuament la capacitat necessària per formalitzar aquest Conveni de conformitat amb els següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ANTECEDENTS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. &lt;/strong&gt;La Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, en el seu article 36, estableix que és competència de les diputacions o entitats equivalents, com és el cas dels Consells Insulars d'acord amb l'article 41 de l'esmentada llei, l'assistència i la cooperació jurídica, econòmica i tècnica als municipis, així com la cooperació en el foment del desenvolupament econòmic i social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; La Llei 7/1985 també preveu la competència d'assegurar la prestació integral i adequada en tot el territori insular dels serveis de competència municipal i, en aquest sentit, el Consell Insular d'Eivissa pot atorgar subvencions i ajudes amb càrrec a seus fons propis parell la realització i el manteniment d'obres i inversions de competència municipal, les quals es podran instrumentar mitjançant plans específics o un altre tipus d'instruments.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. &lt;/strong&gt;La Llei 4/2022, de 28 de juny, de consells insulars, en l'article 102 de la Secció 3a Competències pròpies en relació amb els municipis i altres entitats locals, del TÍTOL VII, estableix com a competències pròpies dels consells insulars, entre d'altres:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;“(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;b) L'assistència i la cooperació jurídica, econòmica i tècnica, especialment als de menor capacitat econòmica i de gestió (...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;e) La col·laboració en el desenvolupament econòmic i social dels municipis, així com la planificació municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;(...)”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. &lt;/strong&gt;La Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, estableix en el seu article 47.1 que són convenis els acords amb efectes jurídics adoptats per les administracions públiques, els organismes públics i entitats de dret públic vinculats o dependents o les universitats públiques entre si o amb subjectes de dret privat per a una finalitat comuna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt; Altrament, en el marc dels principis generals que han de regir les relacions entre les diferents administracions públiques de la dita Llei 40/2015, d'1 d'octubre, es disposa a l'article 3 que les administracions públiques, en les seues relacions, es regeixen pels principis de cooperació, col·laboració i coordinació, i en la seva actuació pels criteris d'eficàcia i servei efectiu als ciutadans.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.&lt;/strong&gt; Per la seva banda, la Llei 4/2022, de 28 de juny, de consells insulars (BOIB nº88 de 7 de juliol de 2022), al seu article 117, sobre «Relacions Interadministratives», preveu que, els consells insulars es relacionen amb la resta d'administracions públiques d'acord amb els principis establerts en la legislació bàsica de l'Estat, i especialment els de lleialtat institucional, respecte a l'autonomia, col·laboració, cooperació i coordinació i l'article 120 estableix al seu apartat 1, que d'acord amb la legislació bàsica del l'Estat, els consells insulars i les seves entitats instrumentals poden subscriure convenis amb subjectes de dret públic i privat, sense que això impliqui cessió de la titularitat de la competència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. &lt;/strong&gt;L'Ajuntament gaudeix de la naturalesa d'ens local i té plena capacitat i personalitat jurídica independent per al compliment de les seues finalitats pròpies i es regeix pel principi de cooperació i col·laboració, i en la seua actuació pels criteris d'eficiència i servei a la ciutadania.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Així mateix, pel que fa a la competència dels municipis en matèria de desenvolupament econòmic local, l'article 29 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, preveu, al seu punt 1, que “A més de les competències derivades de la legislació bàsica de l'Estat i de l'exercici de les que puguin ser delegades per l'Estat, per la comunitat autònoma, pels consells i per altres administracions, aquesta llei garanteix als municipis un nucli de competències pròpies que han de ser exercides per aquestes entitats amb plena autonomia, subjecta només al control de constitucionalitat i legalitat”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.&lt;/strong&gt; El Pla Insular de Cooperació d'obres i serveis municipals de l'illa d'Eivissa per a l'any 2024 &lt;/span&gt;&lt;span style="color:#000000"&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;BOIB núm. 87 de data 2 de juliol de 2024&lt;/span&gt;&lt;span style="color:#000000"&gt;), modificat per acord de Ple de data &lt;/span&gt;&lt;span style="color:#000000"&gt;27 de setembre de 2024 (BOIB núm. 13&lt;/span&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;span style="color:#000000"&gt;, de &lt;/span&gt;&lt;span style="color:#000000"&gt;24&lt;/span&gt;&lt;span style="color:#000000"&gt; d'octubre de 2024)&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;estableix una línia de finançament per &lt;/span&gt;&lt;span style="color:#000000"&gt;de l'execució del projecte &lt;/span&gt;&lt;span style="color:#000000"&gt;«itinerari acces&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt;ible en la Carretera Ei-500 connexió nucli urbà i Col·legi Públic de Santa Agnès de Corona T.M. Sant Antoni de Portmany», &lt;/span&gt;&lt;span style="color:#000000"&gt;per import&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;1.006.786,01 €&lt;/span&gt;&lt;span style="color:#000000"&gt;, segons &lt;/span&gt;&lt;span style="color:#000000"&gt;l'acord de&lt;/span&gt;&lt;span style="color:#000000"&gt;l Consell d'Alcaldes de data 1&lt;/span&gt;&lt;span style="color:#000000"&gt;3&lt;/span&gt;&lt;span style="color:#000000"&gt; de setembre de 2024. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9.&lt;/strong&gt; El Pla estratègic de subvencions del Consell Insular d'Eivissa (2023-2025), aprovat per Acord del Consell Executiu de data 23 de gener de 2023, publicat en el BOIB núm. 12 de data 26 de gener de 2023, i modificat per Decret de Presidència núm. 2024000440 del dia 14 de juny de 2024 (BOIB núm. 82 de 20 de juny de 2024) i per Decret de Presidència núm. 2024000625 de data 28 d'agost de 2024 (BOIB núm. 114 de 31 d'agost de 2024), preveu una línia de subvenció directa a l'Ajuntament de Sant Antoni de Portmany per al finançament del projecte &lt;span style="color:#000000"&gt;«&lt;/span&gt;&lt;span style="color:#000000"&gt;Itinerari accessible en la Carretera Ei-500 connexió nucli urbà i Col·legi Públic de Santa Agnès de Corona T.M. Sant Antoni de Portmany», amb un pressupost de 1.006.786,01 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10.&lt;/strong&gt; El Consell Insular d'Eivissa ha previst, en l'aplicació pressupostària 9420.76202 del pressupost de l'any 2024, la quantia de UN MILIÓ SIS MIL SET-CENTS VUITANTA-SIS EUROS AMB UN CÈNTIMS (&lt;span style="color:#000000"&gt;1.006.786,01 €&lt;/span&gt;) amb l'objectiu d'atorgar una ajuda econòmica a l'Ajuntament de Sant Antoni de Portmany&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11.&lt;/strong&gt; En aquest sentit, el Consell Insular d'Eivissa finançarà el &lt;span style="color:#000000"&gt;«Projecte d'Execució d'un itinerari acces&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt;ible en la Carretera Ei-500 connexió nucli urbà i Col·legi Públic de Santa Agnès de Corona T.M. Sant Antoni de Portmany»&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;que, d'acord amb la sol·licitud de l'Ajuntament de Sant &lt;/span&gt;&lt;span style="color:#000000"&gt;Antoni de Portmany &lt;/span&gt;&lt;span style="color:#000000"&gt;de data &lt;/span&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;span style="color:#000000"&gt; de setembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2024 &lt;/span&gt;&lt;span style="color:#000000"&gt;(RGE núm. 2024026049), té com objectiu el següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;«La carretera de Santa Agnès de Corona, EI-500 (antiga PMV-812-1), és titularitat del Consell Insular d'Eivissa. Aquesta carretera dona accés al nucli urbà i a l'escola unitària de Santa Agnès de Corona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'associació de veïns de Santa Agnès de Corona, ens han fet arribar a aquesta Corporació la petició perquè s'executi un accés per als vianants que uneixi el col·legi amb el centre del poble. Actualment, els alumnes i veïns han de transitar per la cuneta de la carretera, envaint els vorals i la calçada, amb el perill que això suposa per a la seva seguretat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Des de l'Ajuntament de Sant Antoni de Portmany i amb la finalitat de donar solució a aquest problema volem posar en marxa l'execució de les obres del projecte anomenat “Projecte d'Execució d'un itinerari accesible en la Carretera Ei-500 connexió nucli urbà i Col·legi Públic de Santa Agnès de Corona T.M. Sant Antoni de Portmany”, que us va ser remès mitjançant registre general de sortida núm. 2024-S-RC-797 de data 14 de març de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Aquesta iniciativa no sols és fonamental per a millorar la seguretat dels nostres nens i nenes en desplaçar-se a l'escola, sinó que també fomenta un entorn més accessible i sostenible per a tots els ciutadans.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es tracta d'un projecte de gran importància però el finançament del qual suposa un pes molt important per al pressupost d'una administració local com és l'Ajuntament de Sant Antoni de Portmany.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Atès que el Consell d'Eivissa té la responsabilitat de vetllar pel benestar de tots els ciutadans de l'illa, considerem que aquest projecte s'alinea amb els seus objectius de desenvolupament i millora de la qualitat de vida a la nostra comunitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tot l'anterior, sol·licitem respectuosament que el Consell d'Eivissa assumeixi el cost total de l'execució d'aquest projecte que ascendeix a la quantitat de 1.006.786,01€ (IVA inclòs), confiant que junts podem construir un futur més segur i accessible per a tots.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;CLÀUSULES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primera.- OBJECTE DEL CONVENI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'objecte del conveni és establir la cooperació econòmica per part del Consell Insular d'Eivissa amb l'Ajuntament de Sant Antoni de Portmany (d'ara endavant l'Ajuntament), d'acord amb allò establert en la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, en allò referent a cooperació local, en la realització d'inversions i obres que assegurin i millorin els serveis que són competència municipal, concretament en matèria d'accés als nuclis de població, concedint una ajuda econòmica, provinent dels fons propis del Consell Insular d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segona.- OBRES I INVERSIONS SUBVENCIONABLES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les obres objecte i/o inversions del present conveni executiu seran les incloses en el &lt;span style="color:#000000"&gt;«Projecte d'Execució d'un itinerari acces&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt;ible en la Carretera Ei-500 connexió nucli urbà i Col·legi Públic de Santa Agnès de Corona T.M. Sant Antoni de Portmany»&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;que va ser &lt;/span&gt;&lt;span style="color:#000000"&gt;comunicat&lt;/span&gt;&lt;span style="color:#000000"&gt; al Consell Insular d'Eivissa en data &lt;/span&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;span style="color:#000000"&gt; de setembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2024 (RGE núm. 2024026049), &lt;/span&gt;&lt;span style="color:#000000"&gt;i &lt;/span&gt;&lt;span style="color:#000000"&gt;la documentació del qual consta a l'expedient TAO 2024/00016495G en&lt;span style="color:#000000"&gt; &lt;/span&gt;el document amb CSV 15251213401630466275. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Així mateix, a més de les despeses derivades de l'execució del projecte, es podran subvencionar les despeses derivades de la contractació de la redacció del projectes bàsics i/o d'execució de les obres i/o inversions objecte de finançament pel present conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercera.- PERÍODE DE VIGÈNCIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La vigència d'aquest conveni és de quatre anys a partir de la seua signatura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quarta.- OBLIGACIONS DE L'AJUNTAMENT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'Ajuntament haurà de dur a terme les obres que s'incloguin en el present conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Seran obligacions de l'Ajuntament les establertes per als beneficiaris de subvencions a la Llei 38/2003, de 17 de novembre, general de subvencions així com en el Reial Decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions, i el Decret Legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el tex refós de la Llei de subvencions aplicable a les Illes Balears que, entre d'altres, són:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;a) Complir l'objectiu, executar el projecte, exercir l'activitat o adoptar el comportament que fonamenta la concessió de les subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;b) Justificar davant l'òrgan concedent o l'entitat col·laboradora, si s'escau, el compliment dels requisits i les condicions, i també la realització de l'activitat i el compliment de la finalitat que determinin la concessió o el gaudi de la subvenció. La justificació de l'execució de les obres i inversions municipals s'haurà de fer d'acord amb les condicions que es determinin en aquest conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;c) Sotmetre's a les actuacions de comprovació, que ha d'efectuar l'òrgan concedent o l'entitat col·laboradora, si s'escau, i qualsevol altra de comprovació i control financer que puguin dur a terme els òrgans de control competents, tant nacionals com comunitaris, i aportar tota la informació que li sigui requerida en l'exercici de les actuacions anteriors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;d) Comunicar a l'òrgan concedent o l'entitat col·laboradora l'obtenció d'altres subvencions, ajuts, ingressos o recursos que financin les activitats subvencionades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Aquesta comunicació s'ha d'efectuar dins el termini de tres dies hàbils des de la sol·licitud o de l'obtenció de l'ajuda concurrent i, en tot cas, abans de la justificació de l'aplicació donada als fons percebuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;e) Acreditar que està al corrent en el compliment de les seves obligacions tributàries i davant la Seguretat Social, en la forma que es determini per reglament, i sense perjudici del que estableix la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;f) Conservar els documents justificatius de l'aplicació dels fons rebuts, inclosos els documents electrònics, mentre puguin ser objecte de les actuacions de comprovació i control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;g) Adoptar les mesures de difusió que conté l'apartat 4 de l'article 18 de la Llei general de subvencions, en els termes establerts en el present conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;h) Procedir al reintegrament dels fons percebuts en els casos que preveu l'article 37 de la Llei general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'Ajuntament haurà de realitzar l'execució de les obres i inversions municipals incloses en el present conveni d'acord amb la normativa vigent en matèria de contractació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Així mateix, l'Ajuntament queda també sotmès a totes aquelles obligacions que es derivin de la Llei 38/2003, de 17 de novembre, general de subvencions i el seu Reglament, aprovat per Reial decret 887/2006, de 21 de juliol, i del Decret Legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el tex refós de la Llei de subvencions, en tot allò que hi sigui d'aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cinquena.- OBLIGACIONS DEL CONSELL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Consell Insular d'Eivissa aportarà anticipadament un import màxim d'UN MILIÓ SIS MIL SET-CENTS VUITANTA-SIS EUROS AMB UN CÈNTIM (&lt;span style="color:#000000"&gt;1.006.786,01 €&lt;/span&gt;)&lt;span style="color:#000000"&gt; &lt;/span&gt;a l'Ajuntament per finançar les obres del &lt;span style="color:#000000"&gt;«Projecte d'Execució d'un itinerari accessible en la Carretera Ei-500 connexió nucli urbà i Col·legi Públic de Santa Agnès de Corona T.M. Sant Antoni de Portmany». &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'ajuda econòmica del Consell Insular d'Eivissa no podrà ser superior a la quantia degudament justificada per l'Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'aportació del Consell s'imputarà en el pressupost del Consell Insular d'Eivissa de l'any 2025, en l'aplicació pressupostària 9420.76202. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Sisena.- COMPATIBILITAT DE LES AJUDES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Aquesta aportació és compatible amb qualsevol altra ajuda pel mateix concepte que es concedeixi per part d'altres entitats públiques o privades, així com d'altres línies de subvenció del Consell Insular d'Eivissa, sense perjudici de l'obligació de l'Ajuntament de comunicar aquest fet al Consell Insular d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En cap cas l'import de les aportacions i les ajudes rebudes pel mateix concepte, aïlladament o en concurrència, no pot superar el cost total de l'obra o inversió, de conformitat amb el que disposa l'article 19 de la Llei 38/2003, de 17 de novembre, general de subvencions, i amb l'article 20 del Decret Legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el tex refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Setena.- PAGAMENT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Consell Insular d'Eivissa abonarà a l'Ajuntament la quantia establerta en el present conveni&lt;span style="color:#000000"&gt; &lt;/span&gt;en un import màxim d'&lt;/span&gt;&lt;span style="color:#000000"&gt;UN MILIÓ SIS MIL SET-CENTS VUITANTA-SIS EUROS AMB UN CÈNTIM&lt;/span&gt;&lt;span style="color:#000000"&gt; (&lt;/span&gt;&lt;span style="color:#000000"&gt;1.006.786,01 €&lt;/span&gt;&lt;span style="color:#000000"&gt;) &lt;/span&gt;&lt;span style="color:#000000"&gt;per a l'execució &lt;/span&gt;&lt;span style="color:#000000"&gt;del &lt;/span&gt;&lt;span style="color:#000000"&gt;«Projecte d'Execució d'un itinerari accessible en la Carretera Ei-500 connexió nucli urbà i Col·legi Públic de Santa Agnès de Corona T.M. Sant Antoni de Portmany», en forma de pagament avançat un cop signat el present conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'ajuda econòmica rebuda en virtut d'aquest conveni no podrà ser superior a la quantia degudament justificada per l'Ajuntament. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Atenent la condició d'administració local de l'Ajuntament i que el pagament es realitzarà de manera anticipada, no s'estableix l'exigència de constituir una garantia per assegurar el compliment dels compromisos adquirits pel beneficiari, tot d'acord amb allò establert a l'article 42.2 del Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de desenvolupament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Vuitena.- JUSTIFICACIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;L'Ajuntament haurà de justificar les obres i inversions totalment executades abans de la finalització del conveni. La justificació de les despeses de les obres i inversions s'hauran de constatar, de conformitat amb la disposició addicional novena de la Llei 4/2022, de 28 de juny, de Consells Insulars, mitjançant:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;-&amp;nbsp;&lt;strong&gt;ANNEX I&lt;/strong&gt; Relació ordenada de documentació aportada que s'inclou al compte justificatiu (ANNEX I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;-&amp;nbsp;&lt;strong&gt;ANNEX II&lt;/strong&gt; Memòria tècnica de l'òrgan gestor de la subvenció amb una breu descripció dels projectes executats i imatges dels mateixos, que acrediti la realització de l'activitat i el compliment de la finalitat per la qual &lt;span style="color:#000000"&gt;rep&lt;/span&gt;&lt;span style="color:#000000"&gt; l&lt;/span&gt;'aportació econòmica (text redacció lliure).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;-&amp;nbsp;&lt;strong&gt;ANNEX &lt;/strong&gt;&lt;strong&gt;III&lt;/strong&gt; Certificat/Informe de la Intervenció de l'ajuntament que acrediti de manera detallada les despeses realitzades en relació amb cada obra i la data de pagament, així com la veracitat i la regularitat de la documentació justificativa aportada, segons model annex (ANNEX III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;-&amp;nbsp;&lt;strong&gt;ANNEX &lt;/strong&gt;&lt;strong&gt;IV&lt;/strong&gt; Certificat/Informe del Secretari/a de l'Ajuntament que &lt;span style="color:#000000"&gt;acrediti la recepció d&lt;/span&gt;&lt;span style="color:#000000"&gt;e les obres, ajudes rebudes, segons model annex (ANNEX IV).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;-&amp;nbsp;&lt;strong&gt;ANNEX V&lt;/strong&gt; Memòria que inclogui l'acreditació de la publicitat de les obres subvencionades aportant imatges, reculls de premsa, certificats de radiació o qualsevol document amb el qual es pugui acreditar el compliment d'aquesta obligació, tot d'acord amb la clàusula novena del present conveni (text redacció lliure).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Tot l'anterior, sense perjudici de l'obligació de conservació dels documents justificatius de l'aplicació dels fons rebuts inclosos els documents electrònics, en tant puguin ser objectes d'actuacions de comprovació i control posterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'Ajuntament presentarà la justificació corresponent a cada obra i/o inversió municipal una vegada aquesta hagi estat totalment executada i en el termini màxim de 6 mesos des de l'aprovació de l'acta de recepció. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Pel que fa al termini màxim de justificació, en qualsevol cas, la justificació de l'execució de la totalitat de les obres i/o inversions municipals, sempre i quan no s'hagi presentat abans, s'haurà de presentar en un màxim de quatre anys a partir de la signatura del Conveni, tot d'acord amb la Llei General de Subvencions i el seu reglament de desenvolupament, d'acord amb el que estableix la base 24 de les Bases d'Execució del pressupost del Consell Insular d'Eivissa de 2024 i d'acord amb la disposició addicional vuitena de la Llei de Consells Insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Novena.- PUBLICITAT DE LES OBRES SUBVENCIONADES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;És voluntat d'aquest Consell donar a conèixer a la societat eivissenca la cohesió i cooperació entre tots els municipis de l'illa amb aquesta entitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'Ajuntament es compromet a incloure l'escut de Consell Insular d'Eivissa en els cartells informatius, plaques, anuncis, fullets i qualsevol altre suport publicitari i/o informatiu o de comunicació, sobre l'obra o inversió inclosa en aquest conveni, figurant expressament la col·laboració del Consell Insular d'Eivissa tant en el material i suports abans esmentats com a les memòries o informes que es puguin derivar del projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En tot cas, a l'espai físic on es realitzi la inversió o l'obra es col·locarà un cartell informatiu amb la imatge corporativa del Consell Insular d'Eivissa, informant que l'obra ha estat finançada per la institució insular. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En el cas d'obres executades, s'haurà d'incloure la publicitat establerta en aquesta clàusula en totes aquelles accions publicitàries que es puguin realitzar en relació amb la inversió. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En qualsevol cas, l'ajuntament haurà de fer menció de la subvenció rebuda del Consell Insular d'Eivissa en notes de premsa, entrevistes, presentacions i accions informatives i de comunicació que es realitzin sobre l'obra executada, en compliment de la seua obligació com a beneficiari d'una subvenció d'acord amb la normativa vigent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La difusió i publicitat del finançament rebut per part del Consell Insular d'Eivissa en l'obra és una obligació del beneficiari de l'ajuda, en aquest cas, l'ajuntament. L'incompliment d'aquesta obligació donarà lloc a la penalització corresponent, establerta en una reducció del 3% de l'ajuda, calculat sobre el finançament de cada obra sobre la qual no s'ha donat publicitat, d'acord amb la clàusula quinzena del present conveni. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Desena.- COORDINACIÓ DEL CONVENI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Consell d'Alcaldes, com a òrgan de coordinació supramunicipal, realitzarà la coordinació de l'execució dels convenis signats a l'empar del Pla Insular de Cooperació d'obres i serveis municipals de l'illa d'Eivissa per a l'any 2024, per al qual rebrà, puntualment, les informacions de seguiment del mateix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Onzena.- COMISSIÓ BILATERAL PARITÀRIA DE SEGUIMENT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;A partir de la signatura del Conveni i amb la finalitat de fer el seguiment, la vigilància i el control de l'execució del conveni, així com dels compromisos adquirits per les parts i de dur a terme la coordinació entre aquestes, es constituirà una Comissió Bilateral Paritària de Seguiment (CBPS), que estarà formada per:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a conseller/a executiu/va del Consell Insular d'Eivissa, nomenat/da pel Consell.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a regidor/a, nomenat/da per l'Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a tècnic/a de l'Ajuntament, nomenat/da per l'Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a tècnic/a del Consell Insular d'Eivissa, nomenat/da pel Consell.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a funcionari/ària del Consell Insular d'Eivissa, assessor/a jurídic/a, que actuarà com a secretari/ària de la comissió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La comissió es reunirà, com a mínim, amb una periodicitat anual per donar compte de l'evolució de les obres objecte de subvenció, de la qual es donarà trasllat a la Intervenció del Consell Insular d'Eivissa, als efectes escaients. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La Comissió podrà convocar a les seues reunions les persones assessores que consideri oportú d'acord amb els assumptes que hagin d'avaluar en cada sessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La comissió resoldrà els problemes d'interpretació i compliment que puguin plantejar-se respecte l'execució del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Dotzena.- REVISIÓ I MODIFICACIÓ DEL CONVENI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Els termes d'aquest conveni podran ser revisats sempre que no alterin l'import de l'ajuda total concedida a la finalització o el termini d'execució del mateix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Qualsevol altre tipus de modificació dels termes del present conveni, haurà de ser aprovada per les parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les modificacions del conveni es tramitaran en forma de addenda al mateix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tretzena.- ÒRGAN COMPETENT PER INSTRUIR I RESOLDRE EL PROCEDIMENT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Departament de Promoció Econòmica, Cooperació Municipal i Recursos Humans del Consell Insular, és el competent per instruir el procediment d'aquest Conveni, de conformitat amb el Decret de Presidència núm.2023000467, d'estructura del govern del Consell Insular d'Eivissa i creació de departaments( BOIB núm. 88 de 29 de juny de 2023) ,&lt;/span&gt;&lt;span style="color:#000000"&gt; que &lt;/span&gt;&lt;span style="color:#000000"&gt;atribueix al Departament de Promoció Econòmica Cooperació Municipal i Recursos Humans "L'activitat competencial pròpia del Consell Insular en matèria de cooperació i assistència local als municipis de l'illa, recollides tant a la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local com a la llei 4/2022, de 28 de juny, de consells insulars".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Pel que fa a la competència per aprovar aquest Conveni, de conformitat amb la circular de Secretaria del Consell Insular de data 30 de juny del 2023 i segons disposa l'article 28.g de la llei 4/2022 de consells insulars, correspon al Consell Executiu "Aprovar els convenis i els acords de col·laboració i cooperació amb altres entitats públiques o subjectes privats , quan no correspongui expressament a altres òrgans", mentre que l'atribució de la resolució dels actes posteriors a la concessió de la subvenció que regula el present conveni correspondran a la consellera executiva del Departament de Promoció Econòmica, Cooperació Municipal i Recursos Humans del Consell Insular d'Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Catorzena.-. RESOLUCIÓ I EXTINCIÓ DEL CONVENI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Seran causes de resolució del conveni, a més de la determinada per la seva vigència:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- El compliment de les actuacions que constitueixen el seu objecte, en haver-se realitzat el pagament i la justificació de l'ajuda en la seua totalitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Transcurs del temps previst com a durada quan alguna de les parts manifesti la seva voluntat de no prorrogar el conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Denúncia del conveni per qualsevol de les parts feta amb un mínim de tres mesos d'anticipació a la data prevista d'extinció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Per acord de les parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Per les causes generals establertes per la legislació vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'incompliment de qualsevol de les parts de les obligacions establertes en aquest conveni podrà ser causa de resolució del mateix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En el cas de divergència sobre la interpretació i/o execució de les clàusules d'aquest conveni marc, les parts, renunciant al seu fur propi, si en tinguessin, es sotmeten a la competència dels Jutjats i Tribunals de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quinzena.- REVOCACIÓ DE L'AJUDA I CRITERIS GRADUACIÓ PER INCOMPLIMENT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;1. L'incompliment de l'obligació de justificar la finalitat de l'ajuda econòmica rebuda en la forma i els terminis establerts, suposarà a més de la revocació, la incompossibilitat de rebre ajudes del Consell Insula d'Eivissa mentre no es faci la devolució del import reclamat el reintegrament de l'ajuda concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El reintegrament es realitzarà pel procediment regulat per les disposicions generals sobre procediments administratius contingudes en el títol IV de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, sense perjudici de les especialitats que s'estableixen en la Llei general de subvencions i en el Reglament de la Llei &lt;span style="color:#000000"&gt;General de Subvencions, en el qual s'ha de garantir l'audiència a les entitats interessades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. De conformitat amb l'article 17.3.n de la Llei general de subvencions,&lt;/span&gt; en relació amb l'article 37.2 de la mateixa llei, i amb l'article 13 del Decret Legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions de la comunitat autònoma de les Illes Balears, s'estableixen el següents criteris de graduació del possible incompliment material de l'activitat objecte d'aquesta subvenció, i sempre que l'entitat beneficiària acrediti una actuació inequívoca tendent a la satisfacció dels seus compromisos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El present conveni no té caràcter contractual sinó que articula una subvenció, i s'ha de regir per les seues clàusules, i en tot allò no previst en el present Conveni, per la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic, per la Llei 38/2003, de 17 de novembre, general de subvencions, pel Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de desenvolupament de la Llei 38/2003, i pel Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Dissetena.- PUBLICITAT DEL CONVENI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El present Conveni es publicarà a la Base de Dades Nacional de Subvencions en els termes expressats a l'article 18 de la Llei 38/2003, de 17 novembre, general de subvencions (LGS), al &lt;/span&gt;&lt;span style="color:#000000"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;span style="color:#000000"&gt; i al Portal de Transparència del Consell &lt;/span&gt;&lt;span style="color:null"&gt;(http://transparencia.conselldeivissa.info), &lt;/span&gt;&lt;span style="color:#000000"&gt;de conformitat amb l'establert &lt;/span&gt;&lt;span style="color:#000000"&gt;als articles 5.4 i 8.1 de la Llei 19/2013, de 9 de desembre, de transparència, accés a la informació pública i bon govern.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Com a mostra de conformitat, se signa aquest conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
