![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'article 7 de la Llei 1/2022, de 8 de març, d'educació de les Illes Balears, estableix que l'objectiu de la regulació del primer cicle d'educació infantil és universalitzar aquest cicle, fer-lo gratuït progressivament i garantir una educació equitativa i de qualitat. </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"> <span style="color:black">L'article 51 de la Llei orgànica 8/1985, de 3 de juliol, reguladora del dret a l'educació (LODE), estableix per al règim de concerts i amb caràcter general, el següent:</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Article cinquanta-un</span></strong></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. El règim de concerts que s'estableix en el present Títol implica, per part dels titulars dels centres, l'obligació d'impartir gratuïtament els ensenyaments objecte d'aquests.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. En els centres concertats, les activitats escolars complementàries i les extraescolars i els serveis escolars no podran tenir caràcter lucratiu. El cobrament de qualsevol quantitat als alumnes en concepte d'activitats escolars complementàries haurà de ser autoritzat per l'Administració educativa corresponent.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. En els centres concertats, les activitats extraescolars, així com les corresponents quotes que hagin d'aportar els usuaris, hauran de ser aprovades pel Consell Escolar del centre i comunicades a l'Administració educativa corresponent. Aquestes activitats no podran formar part de l'horari escolar del centre. Les Administracions educatives establiran el procediment d'aprovació dels serveis escolars que prestin els centres i de les seves corresponents quotes. El cobrament de tots dos tipus d'activitats podrà contribuir al manteniment i millora de les instal·lacions.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">4. Les Administracions educatives regularan les activitats escolars complementàries extraescolars i els serveis escolars dels centres concertats, que en tot cas tindran caràcter voluntari.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'article 7 del Decret llei 5/2023, de 28 d'agost, de mesures urgents en l'àmbit educatiu i en el sanitari, determina el següent:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Article 7. </span></strong></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Concerts educatius de primer cicle d'educació infantil</span></strong></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. El finançament de les aules de primer cicle d'educació infantil dels centres privats que presten un servei públic d'educació es podrà instrumentalitzar a través del concert educatiu.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. L'establiment dels concerts de primer cicle d'educació infantil s'ha de regir per</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">aquest Decret llei i per les corresponents resolucions de convocatòria per a l'establiment i la renovació de concerts educatius que es dictin a l'efecte, així com per la resta de la normativa d'aplicació.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. Els concerts educatius subscrits a l'empara d'aquest article es formalitzaran en document administratiu en el qual es faran constar els drets i obligacions recíprocs, i, la resta de circumstàncies derivades de la normativa d'aplicació.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">4. El concert ha d'establir la gratuïtat del servei educatiu de primer cicle d'educació infantil d'un mínim de quatre hores.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">[...]</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">9. L'establiment de percepcions per la prestació dels serveis complementaris que ofereixin els centres educatius que subscriguin concerts educatius de primer cicle d'educació infantil requereix l'autorització de la Conselleria d'Educació i Universitats.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">A aquest efecte, es consideren serveis complementaris el menjador, el transport escolar, el gabinet mèdic o psicopedagògic i qualsevol altre de naturalesa anàloga, així com les hores d'atenció als infants no finançades pel concert educatiu.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Els centres concertats de primer d'educació infantil han subscrit els corresponents concerts educatius, la clàusula 2 sobre c</span>ompromisos de la Conselleria d'Educació i Universitats i del titular del centre <span style="color:black">estableix en l'apartat 3 el següent:</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El titular del centre s'obliga a impartir els ensenyaments objecte d'aquest Concert singular tal com s'indica tot seguit:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">a. Dins l'horari del primer cicle d'educació infantil, donar el servei d'escolarització bàsica d'un mínim de quatre hores, sense incloure-hi les menjades, amb caràcter gratuït. S'ha de fer constar així en totes les publicacions i informacions a les famílies. Aquest horari d'escolarització bàsica ha de tenir lloc entre les 8 h i les 14 h dels dies laborables, des del mes de setembre fins al mes de juny. En cas que per causes justificades el titular del centre vulgui establir l'escolarització bàsica en un horari diferent, haurà de comptar amb l'informe favorable de la Conselleria d'Educació i Universitats.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. Els centres no poden percebre de les famílies aportacions econòmiques associades a l'activitat objecte de concert ni establir l'obligatorietat de fer ingressos per a fundacions o associacions ni altres serveis que puguin contravenir el principi de gratuïtat i no estiguin autoritzats, si pertoca, per la Conselleria d'Educació i Universitats.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c. L'establiment de percepcions per la prestació dels serveis complementaris que ofereixin els centres educatius que subscriguin concerts educatius de primer cicle d'educació infantil seran voluntàries, no tendran caràcter discriminatori per als alumnes, no podran formar part de l'horari d'escolarització bàsica, no tendran caràcter lucratiu i requereixen l'autorització de la Conselleria d'Educació i Universitats d'acord amb l'establert a l'article 51 de la LOE 8/1985 i els articles 15 i 56 del Reial decret 2377/1985.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A aquest efecte, es consideren serveis complementaris el menjador, el transport escolar, el gabinet mèdic o psicopedagògic i qualsevol altre de naturalesa anàloga, així com les hores d'atenció als infants no finançades pel concert educatiu.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d. Impartir els ensenyament d'acord amb els currículums vigents i amb els reglaments de la Conselleria d'Educació i Universitats aplicables a la Comunitat autònoma de les Illes Balears.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Els articles 61 i 62 de la LODE regulen la Comissió de conciliació i els incompliments del concert educatiu.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">En definitiva, és necessari establir el procediment per tal que els centres privats concertats de primer cicle d'educació infantil sol·licitin l'autorització en relació als serveis escolars complementaris que ofereixen.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">D'altra banda, atès que és la primera vegada que s'estableix aquest procediment resulta necessari determinar els imports màxims de les quotes dels diferents serveis escolars complementaris que els centres concertats de primer cicle d'educació infantil ofereixen. Aquests imports es fixen per al curs 2025-2026 prenent com a referència els que cada centre concertat va percebre de les famílies el curs 2024-2025, </span>incrementat en un 2,5 %, corresponent a l'Índex de Preus al Consum d'ensenyança de maig 2024 a maig 2025. No obstant això, per al cas que amb aquesta referència determinats imports superessin l'anterior, s'estableixen uns imports màxims que es consideren raonables partint de la mitjana dels imports percebuts, en funció de les diferents illes, pels centres concertats per cada servei escolar complementari, incrementat en un 10%.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">La competència per dictar aquesta Resolució correspon al conseller d'Educació i Universitats, d'acord amb el que estableix l'article 10.1.<em>i)</em> i 20.2 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, i d'acord amb </span>el Decret 6/2025, de 2 de juny, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Per tot l'anterior, dict la següent:</span></span></span></p>
<p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Resolució</span></strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. Establir el procediment perquè els centres concertats de primer cicle d'educació infantil sol·licitin l'autorització en relació als serveis escolars complementaris que ofereixen, que figura com a annex 1 d'aquesta Resolució.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Aprovar l'annex 2, que conté el model de sol·licitud d'autorització de serveis escolars complementaris i de les quotes corresponents.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Aprovar l'annex 3, que conté el model de certificació de l'acord del Consell Escolar sobre els serveis escolars complementaris.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Aprovar l'annex 4, que conté el model de memòria econòmica justificativa dels serveis escolars complementaris.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Aprovar l'annex 5, que conté el model de comunicació i pròrroga d'autorització de quotes dels serveis escolars complementaris per els cursos escolars posteriors.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Publicar aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears</em>.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Notificar aquesta Resolució als centres concertats de primer cicle d'educació infantil mitjançant l'aplicació per a la gestió educativa de les Illes Balears.</span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposició de recursos</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació i Universitats en el termini d'un mes, comptador des de l'endemà de la publicació d'aquesta Resolució, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i amb l'article </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">També es pot interposar directament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma en el termini de dos mesos, comptadors des de l'endemà de la publicació d'aquesta Resolució, d'acord amb els articles 8 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la Jurisdicció Contenciosa Administrativa.</span></span></p>

<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. A l'efecte d'aquest procediment són serveis escolars complementaris:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p>

<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Les hores d'atenció als infants no finançades pel concert educatiu </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Els serveis escolars complementaris han de tenir caràcter voluntari per a les famílies i han de ser autoritzats per la Direcció General de Personal Docent i Centres Concertats.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Els centres concertats poden percebre quotes per la prestació d'aquests serveis, que han de ser autoritzades per la Direcció General de Personal Docent i Centres Concertats.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. No obstant l'anterior, la prestació del servei no pot tenir caràcter lucratiu, la qual cosa implica:</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Que les quotes que percebi el centre per la prestació dels serveis no pot ser superior al cost suportat pel centre per a la seva prestació.</span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Que, en cas que les quotes siguin superiors al cost suportat, la diferència pot contribuir al manteniment i millora de les instal·lacions del centre educatiu.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">5. P</span>er al càlcul del cost suportat del servei a l'efecte de la consideració del preu com no lucratiu, la memòria econòmica justificativa pot imputar els costos directes del servei més un percentatge de costos indirectes. </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquest percentatge ha de respectar els principis i normes de comptabilitat i, en tot cas, ha de correspondre al període en què efectivament es realitza l'activitat. </span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tercer</strong></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="display:block; margin-bottom:0px; margin-top:0px"> </span>Informació a les famílies</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Els centres han d'exposar públicament el llistat de serveis escolars complementaris que ofereixen, amb els preus autoritzats per l'Administració educativa, i amb indicació expressa del seu caràcter voluntari. </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Mentre el centre no tengui l'autorització de l'Administració pot cobrar, a compte, les quotes sol·licitades a les famílies. En el cas que les quantitats que aprovi l'Administració siguin inferiors a les que el centre hagi percebut, el titular del centre ha de retornar els imports cobrats de més, podent descomptar-los dels rebuts posteriors, i sense perjudici de la responsabilitat en la que hagués pogut incórrer. </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Quart</strong></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="display:block; margin-bottom:0px; margin-top:0px"> </span>Sol·licitud d'autorització de quotes pels serveis escolars complementaris</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El titular o el representant del centre ha de presentar la sol·licitud al Registre de la Conselleria d'Educació i Universitats o a qualsevol dels llocs que determina l'article 37.1 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, i l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La sol·licitud s'ha d'ajustar al model normalitzat que figura com a annex 2 de la Resolució i ha d'anar acompanyat de la documentació següent: </span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Certificació de l'Acord del Consell Escolar sobre els serveis escolars complementaris (annex 3) per aquells centres que tinguin Consell Escolar. </span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">bMemòria econòmica justificativa dels serveis escolars complementaris on quedi constància del cost de la prestació del servei, amb indicació de l'import de la quota que es cobra a les famílies (annex 4).</span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El termini màxim per presentar la sol·licitud d'autorització dels serveis escolars complementaris i de les quotes és el 31 de juliol de cada curs escolar.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el mateix termini s'han de presentar les comunicacions a què fa referència l'apartat vuitè d'aquest annex, quan pertoqui.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. De manera excepcional, si durant el curs escolar sorgís la necessitat d'establir un nou servei escolar complementari no previst a l'inici de curs, s'ha de presentar la sol·licitud d'autorització per a aquest servei en concret i per la quota corresponent.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Sisè </strong></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="display:block; margin-bottom:0px; margin-top:0px"> </span>Esmena de sol·licituds</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Si la sol·licitud no reuneix els requisits establerts a l'apartat quart d'aquest annex, la Direcció General de Personal Docent i Centres Concertats ha de requerir al sol·licitant perquè l'esmeni, en els termes previstos en l'article 68 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El requeriment suspèn el termini màxim per resoldre, en els termes establerts en l'article 22.1.<em>a)</em> de la Llei 39/2015, d'1 d'octubre.</span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Correspon al director general de Personal Docent i Centres Concertats autoritzar els serveis escolars complementaris i les corresponents quotes, mitjançant resolució. </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. El termini màxim per resoldre és de tres mesos. </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Si transcorregut aquest termini l'Administració no ha notificat resolució expressa, el sol·licitant pot entendre estimada la seva sol·licitud i, en conseqüència, autoritzats els serveis escolars complementaris i les corresponents quotes. </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. L'autorització dels serveis i de les quotes ha d'estar referida a un curs escolar. </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Les resolucions que no autoritzin un servei escolar complementari i/o una quota han de ser motivades.</span></span></p>

En cas que, per al cursos escolars posteriors a aquell en què s'hagi autoritzat el servei escolar complementari i la corresponent quota, el centre mantingui el servei escolar i las quota autoritzada és suficient comunicar aquesta circumstància a la Direcció General de Personal Docent i Centres Concertats, mitjançant el model de comunicació que figura com a annex 5 i el tràmit telemàtic habilitat a l'efecte.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En cas que l'import de la quota autoritzada s'incrementi, com a màxim, en el percentatge que fixi, per a cada curs escolar, el conseller d'Educació i Universitats mitjançant resolució, és suficient presentar la comunicació a què fa referència el punt anterior.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Una vegada comprovat que la comunicació s'ajusta al que disposen els punts anteriors, el director general de Personal Docent i Centres Concertats dictarà una resolució per la qual es prorrogarà, per un curs escolar, l' autorització concedida.</span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1 .És causa d'incompliment lleu del concert per part del titular del centre percebre quantitats per serveis complementaris escolars que no hagin estat autoritzats per l'Administració educativa (art. 62.1.a) LODE).</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. És causa d'incompliment greu del concert educatiu per part del titular quan resulti que l'incompliment es produeixi amb ànim de lucre, amb intencionalitat evident, amb pertorbació manifesta en la prestació del servei de l'ensenyament o de forma reiterada o reincident (art. 62.2.<em>a)</em> LODE).</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. És causa d'incompliment molt greu del concert educatiu la reiteració o reincidència dels incompliments greus (art. 62.<em>2.bis</em> LODE).</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">4. L'incompliment del concert educatiu donarà lloc a la constitució de la Comissió de Conciliació i, si s'escau, a l'aplicació de les sancions que preveu l'article 62.4 de la LODE.</span></span></span></p>
