Les explotacions dedicades a la producció vegetal han de lluitar contra els agents nocius a les seves explotacions. Les condicions de l'agricultura de Menorca, quant a climatologia, intensitat i varietat de conreus, fan que la problemàtica de la sanitat vegetal revesteixi una complexitat especial. La reduïda estructura de les finques fa recomanable la seva associació en agrupacions de defensa vegetal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les agrupacions de defensa vegetal (ADV) són la figura adoptada a Espanya a través de la Llei 43/2002, de 20 de novembre, de sanitat vegetal, perquè la lluita contra les plagues es faci de manera eficient i, sobretot, de manera considerada amb la salut de les persones i els animals i siguin compatibles amb el desenvolupament d'una agricultura sostenible i respectuosa amb el medi ambient, per complir amb el que s'estableix a l'article 55 del Reglament (CE) núm. 1107/2009, del Parlament Europeu i del Consell, de 21 d'octubre de 2009.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Decret 52/2013, de 29 de novembre, regula les agrupacions de defensa vegetal i crea el Registre Oficial d'Agrupacions de Defensa Vegetal en l'àmbit de les Illes Balears. El Ple del Consell Insular de Menorca, en sessió de caràcter ordinari de 17 de novembre de 2014, aprovà la creació del Registre Insular d'Agrupacions de Defensa Vegetal de Menorca, regit pel que estableix el Decret 52/2013, de 29 de novembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquestes ajudes estaran sotmeses al que disposen els articles 22 i 26 del Reglament (UE) 2022/2472, de la Comissió, de 14 de desembre de 2022, pel qual es declaren determinades categories d'ajuda en els sectors agrícola i forestal i en zones rurals compatibles amb el mercat interior en aplicació dels articles 107 i 108 del Tractat de Funcionament de la Unió Europea. En concret, l'article 22 regula els ajuts destinats a serveis d'assessorament vinculats a objectius específics, entre els quals s'inclou l'assessorament relatiu al compliment del Reglament (UE) 2016/2031, sobre mesures de protecció contra les plagues vegetals, mentre que l'article 26 estableix les condicions per a la concessió d'ajudes destinades a cobrir les despeses derivades de la prevenció, el control i l'erradicació de malalties o plagues vegetals, així com les destinades a reparar els danys ocasionats per aquestes plagues.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Pla Estratègic de Subvencions (PES) per a l'exercici 2025, aprovat pel CEX reunit en sessió de caràcter extraordinari de 22 de novembre de 2024 (BOIB núm. 161 de 12 de desembre de 2024), estableix la previsió de l'activitat subvencionadora en la línia de foment d'activitats d'interès general, dins el marc normatiu establert per a la concessió de subvencions. Una de les línies de subvenció incloses en aquest PES és un ajut per al foment de les associacions de defensa vegetal de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'objecte d'aquests ajuts pel foment de les associacions de defensa vegetal de Menorca és donar suport a les actuacions dutes a terme des de l'1 de gener al 31 de desembre de 2025 per les ADV constituïdes d'acord amb el Decret 52/2013, de 29 de novembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'interès públic d'aquesta convocatòria rau en el suport a les ADV per a l'activitat que desenvolupen, la qual, en coordinació amb les actuacions dutes a terme per l'Administració en matèria de sanitat vegetal, contribueix a reforçar l'eficàcia de les mesures de prevenció i lluita contra els agents nocius dels vegetals, mitjançant una utilització racional de les tècniques d'aplicació, dels productes i dels mitjans fitosanitaris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 6.5 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; del Reglament (UE) 2022/2472, no és necessari que aquests ajuts tenguin un efecte incentivador quan es compleixen les condicions establertes a l'article 26 del mateix reglament. Per tant, les ADV poden sol·licitar els ajuts per a l'execució de programes de control o erradicació de plagues vegetals amb posterioritat a la realització de les actuacions subvencionables. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. L'article 2.2 de la Llei 8/1999, de 12 d'abril, d'atribució de competències als consells insulars de Menorca i d'Eivissa i Formentera en matèria d'agricultura, ramaderia, pesca i artesania, diu que són funcions dels consells insulars de Menorca i Formentera desenvolupar en el seu àmbit territorial, entre d'altres, les actuacions en matèria d'agricultura i ramaderia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'article 30 de la Llei orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'autonomia de les Illes Balears, explica que són competències pròpies dels consells insulars, entre d'altres, l'agricultura, ramaderia i pesca; així com la qualitat, la traçabilitat i les condicions dels productes agrícoles i ramaders i dels productes alimentaris que se'n deriven.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Departament d'Economia i Serveis Generals del Consell Insular de Menorca manifesta la voluntat de col·laborar activament amb les ADV legalment constituïdes a l'illa, en tant que entitats col·lectives de referència en la prevenció, vigilància i control de plagues, malalties i males herbes que afecten els cultius. Aquestes agrupacions han esdevingut aliades estratègiques per al sector agrari menorquí i contribueixen de manera significativa al compliment efectiu de la normativa vigent en matèria de sanitat vegetal, a la protecció del medi ambient i a la sostenibilitat del model productiu insular. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atesa la proposta de la consellera executiva del Departament d'Economa i Serveis Generals;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Executiu, per unanimitat dels sis membres presents (senyor Vilafranca Florit, senyora Reynés Calvache, senyor Gornés Hachero, senyora Taltavull Fernández, señor Pons Torres i senyor Delgado Díaz) i en votació ordinària, adopta el següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACORD&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprovar les bases que regeixen la concessió dels ajuts del Consell Insular de Menorca per a les agrupacions de defensa vegetal de Menorca (ADV) corresponents al període comprès entre l'1 de gener de 2025 i el 31 de desembre de 2025 i que es transcriuen a continuació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segon.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprovar, simultàniament, la convocatòria dels ajuts corresponent a l'any 2025, que es regeixen per les bases esmentades anteriorment i d'acord amb les condicions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Import global màxim dels ajuts i crèdit pressupostari: les ajudes concedides s'han d'atendre amb càrrec a les partides pressupostàries i amb els imports màxims que s'indiquen més avall, sens perjudici que els imports puguin ser ampliats per aportacions expresses de tercers per contribuir al finançament de l'objecte de la convocatòria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El Pla Estratègic de Subvencions (PES) per a l'exercici 2025, aprovat pel CEX reunit en sessió de caràcter extraordinari de 22 de novembre de 2024 (BOIB núm. 161 de 12 de desembre de 2024), estableix la previsió de l'activitat subvencionadora en la línia de foment d'activitats d'interès general, dins el marc normatiu establert per a la concessió de subvencions. Una de les línies de subvenció incloses en aquest PES és un ajut per al foment de les associacions de defensa vegetal de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'objecte d'aquests ajuts és compensar el cost de les actuacions de les agrupacions de defensa vegetal de Menorca (ADV) constituïdes d'acord amb el Decret 52/2013, de 29 de novembre, que regula les agrupacions de defensa vegetal en l'àmbit de les Illes Balears i crea el Registre Oficial d'Agrupacions de Defensa Vegetal de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les ajudes s'han de concedir d'acord amb el Reglament (CE) núm. 2472/2022, de la Comissió, de 14 de desembre de 2022, pel qual es declaren determinades categories d'ajuda en els sectors agrícola i forestal i en zones rurals compatibles en el mercat interior en aplicació dels articles 107 i 108 del Tractat de Funcionament de la Unió Europea. També es té en compte la Llei 43/2002, de 20 de novembre, de sanitat vegetal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El període subvencionable de les activitats executades és del dia 1 de gener al 31 de desembre de l'any de la convocatòria, d'acord amb el que estableix l'article 6.5&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; del Reglament UE núm. 2472/2022, que diu que quan es compleixin les condicions establertes a l'article 26 del mateix reglament no serà necessari que aquests ajuts tenguin un efecte incentivador. Per tant, els ajuts a les ADV es poden sol·licitar després d'executar les actuacions subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En compliment de l'article 11.1 del Reglament (CE) núm. 2022/2472, es transmetrà a la Comissió Europea la informació resumida relativa a aquesta ajuda en el termini de vint dies hàbils a partir de l'entrada en vigor. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Finalitat&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta convocatòria té per finalitat la prevenció i la lluita contra les plagues i malalties vegetals i infestació per espècies exòtiques invasores per a les quals hi hagi normes nacionals o de la Unió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Finançament i import màxim&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les ajudes que s'atorguin en el marc d'aquestes bases s'han de pagar amb càrrec a les partides i per l'import màxim que s'estableixin en la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Activitats subvencionables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. L'actuació subvencionable és l'assessorament i les mesures de prevenció dels danys causats per les plagues vegetals que fa l'ADV per als seus socis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Les actuacions fetes per les ADV rebran ajut si es compleixen les condicions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les plagues i les malalties vegetals i infestació per espècies exòtiques invasores per a les quals hi ha normes nacionals o de la Unió, tant si són establertes per llei, reglament o acció administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Aquestes normes de la Unió i nacionals es refereixen a un dels aspectes següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;i&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Un programa o pla públic a escala de la Unió, nacional o regional per a la preservació, el control o l'erradicació de la plaga vegetal de què es tracti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;ii&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Mesures d'emergència imposades per l'autoritat competent de l'estat membre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Iii&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Mesures per erradicar o contenir una plaga vegetal aplicades d'acord amb els articles 17 i 18; l'article 28, apartats 1 i 2; l'article 29, apartat 1 i 2; l'article 30, apartat 1, i l'article 33, apartat 1 del Reglament (UE) núm. 2016/2031.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;iv&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Mesures per erradicar o contenir una espècie exòtica invasora aplicades d'acord amb el Reglament (UE) núm. 1143/2014. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Es consideren actuacions subvencionables, en el marc d'aquesta convocatòria, les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Els costos derivants de la contractació del personal tècnic per part de l'ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les despeses associades a la contractació de serveis de direcció tècnica i/o d'assistència tècnica necessaris per al desenvolupament de les funcions pròpies de l'ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Les despeses corrents indispensables per executar l'activitat definida a la base 1 d'aquestes bases reguladores. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les despeses vinculades a la formació del personal tècnic de l'ADV, sempre que aquesta formació sigui imprescindible per a la realització dels controls, les tasques de vigilància i les mesures de detecció de plagues vegetals. Aquesta actuació resta condicionada a l'informe favorable del tècnic del Consell Insular de Menorca competent en matèria de sanitat vegetal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les despeses ocasionades pels desplaçaments del personal tècnic en el marc de l'activitat objecte de la subvenció. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) L'adquisició de material destinat a la prevenció i a la lluita biològica contra les plagues objecte d'actuació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) L'adquisició de material i equipament de laboratori estrictament relacionat amb les finalitats de l'ADV. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Poden ser subvencionades les actuacions executades i pagades entre l'1 de gener i el 31 de desembre de l'any de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Quan l'import de la despesa subvencionable superi la quantia de 15.000 euros en cas de subministrament de béns d'equipament o prestació de serveis per empreses de consultoria o assistència tècnica, el beneficiari ha de sol·licitar com mínim tres ofertes de proveïdors diferents, amb caràcter previ a la contractació del compromís per a la prestació del servei, o el lliurament del bé, excepte quan, per les característiques especials de les despeses subvencionables, no hi hagi en el mercat prou entitats que el subministrin o ofereixin, o quan la despesa s'hagi fet abans de la sol·licitud de subvenció, quan així s'hagi establert. L'elecció entre les ofertes presentades, que s'han d'aportar com a justificació, si escau, a la sol·licitud de la subvenció, s'ha de fer d'acord amb els criteris d'eficiència i economia, i s'ha de justificar expressament l'elecció en una memòria que no recaigui en la proposta econòmica no avantatjosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. L'IVA no es pot subvencionar, llevat de quan no sigui recuperable per al beneficiari (article 4.3 RD 81/2015). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Naturalesa de l'ajut i compatibilitat amb altres ajuts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Les subvencions que es regeixen per aquestes bases són de caràcter voluntari i eventual i es poden anul·lar, revocar i reintegrar en cada moment per les causes previstes en la llei o en aquestes bases; no generen cap dret a l'obtenció d'altres subvencions en anys posteriors i no es poden al·legar com a precedent. Així mateix, són compatibles amb altres ajudes, subvencions i ingressos o recursos que pugui rebre l'entitat beneficiària per dur a terme el mateix projecte, sense perjudici de l'obligació dels beneficiaris de comunicar-ho al Consell Insular de Menorca de la manera establerta en aquestes bases, sempre que el còmput anual no superi el pressupost d'execució del projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'import de l'ajuda en cap cas pot superar —aïlladament o en concurrència amb altres subvencions o ajudes d'altres administracions públiques o ens públics o privats, nacionals o internacional— el cost total de l'activitat objecte de subvenció, ni els límits establerts en l'article 26.15 del Reglament (CE) núm. 2472/2022, de la Comissió, de 14 de desembre de 2022, pel qual es declaren determinades categories d'ajuda en els sectors agrícola i forestal i en zones rurals compatibles en el mercat interior en aplicació dels articles 107 i 108 del Tractat de Funcionament de la Unió Europea. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El fet de rebre una subvenció implica l'obligatorietat de dur a terme el projecte subvencionat i, per tant, l'entitat beneficiària ha de cercar altres fons de finançament o aportar fons propis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Requisits dels beneficiaris&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Poden tenir la consideració de beneficiaris directes i demanar les ajudes que preveuen aquestes bases les ADV integrades per productors que compleixin els requisits del punt 2 d'aquesta base i que, abans que venci el termini de presentació de sol·licituds, compleixin els requisits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Que estiguin constituïdes d'acord amb el Decret 52/2013, de 29 de novembre, pel qual es regulen les ADV en l'àmbit de les Illes Balears i crea el Registre Oficial d'Agrupacions de Defensa Vegetal de les Illes Balears, i que estiguin inscrites en el Registre Insular d'Agrupacions de Defensa Vegetal de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Que disposin, abans que es dicti la proposta de resolució, d'un programa o un pla per a la prevenció, el control o l'erradicació de plagues vegetals que hagi obtingut informe favorable del tècnic del CIM responsable en matèria de sanitat vegetal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Que estiguin al corrent de les obligacions tributàries, amb la Seguretat Social i el Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Que no estiguin subjectes a una ordre de recuperació pendent després d'una decisió prèvia de la Comissió que hagi declarat una ajuda il·legal i incompatible amb el mercat interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Les explotacions agràries integrades en una agrupació de defensa vegetal de Menorca, en les quals es duen a terme les activitats subvencionables, han de complir els requisits següents (annex V):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Que estigui al corrent de les obligacions tributàries, amb la Seguretat Social i el Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Que tengui la condició de pime, d'acord amb l'annex I del Reglament (UE) 2022/2472, de la Comissió, de 14 de desembre de 2022, pel qual es declaren determinades categories d'ajuda en els sectors agrícola i forestal i en zones rurals compatibles en el mercat interior en aplicació als articles 107 i 108 del Tractat de Funcionament de la Unió Europea. Aquest requisit de pime dedicada a la producció primària de productes agrícoles haurà d'acreditar-se abans de la proposta de resolució de concessió per declaració responsable dels productors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Que no estiguin subjectes a una ordre de recuperació pendent després d'una decisió prèvia de la Comissió que hagi declarat una ajuda il·legal i incompatible amb el mercat interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. No obstant això, no poden ser-ne beneficiàries:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les persones físiques o jurídiques en les quals concorri alguna de les prohibicions establertes en l'article 13.2 de la Llei general de subvencions i l'article 10 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions, i l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions (annex II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les persones físiques o jurídiques sancionades o condemnades per resolució administrativa o sentència judicial fermes per discriminació salarial, assetjament moral o qualsevol tipus de tracte desigual, per raó de sexe, en l'àmbit de les relacions laborals, de conformitat amb el que disposa l'article 27 de la Llei 12/2006, de 20 de setembre, per a la dona (annex II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Presentació de les sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Les sol·licituds s'han de presentar formalitzades electrònicament mitjançant el model normalitzat que s'adjunta com a annex I d'aquestes bases i que es troba a la seu electrònica &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;www.cime.es&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el cas que es presenti més d'una sol·licitud per part d'una mateixa persona sol·licitant, es considerarà vàlida, a tots els efectes, la darrera sol·licitud presentada, la qual deixarà sense efecte qualsevol sol·licitud anterior. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. A la sol·licitud, s'ha d'adjuntar la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Documentació administrativa&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Document d'identificació del representant (DNI).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Document d'identificació fiscal de l'ADV (NIF).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Escriptura de constitució o modificació dels estatuts o del reglament intern de funcionament inscrits en el registre corresponent. Si fos necessari, de conformitat amb els seus estatuts, han d'aportar certificat de l'acord adoptat per l'òrgan de govern de l'entitat per sol·licitar l'ajuda i per designar representant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Declaració responsable signada pel sol·licitant o pel seu representant legal de no estar sotmès a cap de les circumstàncies que determinen la impossibilitat d'obtenir la condició de beneficiari o entitat col·laboradora de les subvencions públiques recollides en l'article 13.2 de la Llei 38/2003, de 17 de novembre, general de subvencions (BOE núm. 276, de 18 de novembre de 2003), el model de la qual s'adjunta com a annex II d'aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Certificat en què s'indiqui que està inscrit en el registre insular d'ADV o document acreditatiu d'haver sol·licitat aquest tràmit (s'aportarà d'ofici).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Declaració del compte bancari de l'associació segons model facilitat pel CIM, llevat que ja consti a la tresoreria Generals del CIM, cosa que s'ha de fer constar expressament. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Certificat en què consti que està al corrent de les obligacions tributàries i amb la Seguretat Social davant l'Administració de l'Estat. Es pot autoritzar el Consell Insular de Menorca a comprovar el compliment d'aquestes obligacions (vegeu l'annex I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;h&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Declaració responsable signada pel sol·licitant o pel seu representant legal relativa a les subvencions o ajudes obtingudes i/o sol·licitades d'altres institucions públiques o privades per dur a terme la mateixa activitat (annex III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Documentació específica&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;i&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Acta de la Junta General de socis en què s'acorda sol·licitar l'ajuda de l'ADV i se'n designa representant (si fos necessari, de conformitat amb els estatuts).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;j&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Nombre dels socis i superfície de cultiu amb referències SIGPAC.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;k&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Certificat del secretari de l'agrupació en què s'indiqui l'aportació econòmica feta pels socis de l'organització durant l'exercici anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;l&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Pla d'actuació de l'ADV per a la prevenció, el control o erradicació de plagues vegetals que hagi obtingut informe favorable del tècnic del CIM responsable en matèria de sanitat vegetal. Per cada una de les actuacions, s'han d'especificar com a mínim els objectius, el material i la metodologia que s'emprarà.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;m&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Previsió de les despeses subvencionables signada pel president de l'ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;n&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Contracte signat entre l'ADV i el tècnic que dirigirà el programa de lluita o pressupost del cost de la direcció tècnica mitjançant contracte d'arrendament de serveis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;o&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Declaració responsable acreditativa de cada una de les explotacions integrades dins l'ADV en què consti (annex V): &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:80px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que estan al corrent del pagament de les obligacions tributàries de caràcter estatal, insular i local, i amb la Seguretat Social, previstes en les disposicions vigents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'eximeix de presentar la documentació a què fan referència les lletres &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;,&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;,&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; c &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;i &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;en el cas que aquesta ja consti en els arxius del Consell Insular, circumstància que s'ha de fer constar expressament en la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. D'acord amb l'article 28.2 de la Llei 39/2015, d'1 d'octubre, del procediment comú de les administracions públiques; amb la disposició addicional vuitena de la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals, i amb l'article 95.1, lletra K, de la Llei 58/2003, de 17 de desembre, general tributària, el Consell Insular de Menorca podrà verificar l'exactitud de les dades declarades, així com consultar o demanar els documents elaborats per qualsevol administració de forma electrònica mitjançant les seves xarxes corporatives o consulta a les plataformes d'intermediació de dades o altres sistemes electrònics habilitats a l'efecte, sempre que no consti en l'expedient l'oposició expressa a aquesta consulta o quan la llei especial que sigui aplicable al cas en requereixi el consentiment exprés. En aquest darrer cas serà obligatori que l'Administració el requereixi i que l'interessat el presti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 28.3 i l'article 53&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques (LPACAP), les persones interessades no tenen l'obligació de presentar documents originals, llevat que, amb caràcter excepcional, la normativa reguladora aplicable exigeixi el contrari. En qualsevol cas, les persones interessades són responsables de la veracitat dels documents que presentin (article 28.7 de l'LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'acord amb l'article 28.5 de l'LPACAP, excepcionalment, quan la rellevància d'un document de l'expedient aportat per l'interessat així ho exigeixi, o hi hagi dubtes derivats de la qualitat de la còpia, el CIM pot sol·licitar de manera motivada l'autenticació de les còpies aportades per la persona interessada, per la qual cosa pot requerir l'exhibició del document o de la informació original.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Pel fet de presentar-se a aquesta convocatòria la persona interessada presta al Consell Insular de Menorca els consentiments següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Per consultar i comprovar la veracitat de la documentació i de les dades presentades per l'interessat que tenguin en el seu poder altres administracions públiques, principalment mitjançant les plataformes d'interoperabilitat, les xarxes corporatives o altres sistemes electrònics habilitats a aquest efecte i als quals el CIM tengui accés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Per consultar l'existència i veracitat de la documentació i de les dades que eventualment l'interessat hagi considerat oportú no presentar acollint-se al dret de no fer-ho pel fet que hagin estat elaborades per les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els consentiments esmentats només es consideraran atorgats quan no consti en l'expedient l'oposició expressa a l'esmentada consulta o quan la llei especial que sigui aplicable al cas en requereixi el consentiment exprés. En aquest darrer cas serà obligatori que l'Administració el requereixi i que l'interessat el presti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Les sol·licituds i tota la documentació transcrita en l'apartat 2 de la base 7 s'han de presentar, dins el termini establert en la convocatòria, d'acord amb les indicacions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per mitjans electrònics, pels subjectes legalment prevists d'acord amb el que estableix l'article 14.1 i 2 de l'LPACAP al registre electrònic del Consell Insular de Menorca (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;www.cime.es&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) o a qualsevol altre registre electrònic dels establerts en l'article 16.4 de l'esmentada llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si algun dels subjectes obligats als quals fa referència l'article 14, apartats 2 i 3, de l'LPACAP, presenta la sol·licitud presencialment, se'l requerirà per tal que l'esmeni mitjançant la presentació electrònica. A aquests efectes i d'acord amb el que estableix l'article 68.4 de la mateixa llei, es considerarà com a data de presentació de la sol·licitud aquella en què hagi tingut lloc l'esmena.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Si la sol·licitud o la documentació fossin incorrectes o incompletes, el Consell Insular de Menorca en requerirà la rectificació o el complement necessaris. Si en el termini de deu dies hàbils, comptats des de l'endemà d'haver rebut el requeriment d'esmena de la sol·licitud, la persona interessada no fa la rectificació reclamada o no presenta la documentació requerida, s'entendrà que ha desistit de la seva petició de conformitat amb l'article 68 de l'LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Despeses subvencionables. Pressupost del projecte i pressupost subvencionable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Són despeses justificables en el marc d'aquesta convocatòria les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les nòmines, així com les quotes d'IRPF i de Seguretat Social, relatives al personal tècnic contractat per l'ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les factures corresponents als serveis de direcció tècnica o d'assistència tècnica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les factures de serveis de gestoria, de subministrament de material d'oficina, i de serveis d'enviament i missatgeria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) En relació amb l'assistència del personal tècnic a activitats formatives: despeses de matrícula, desplaçament i allotjament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les despeses de carburant i de manteniment dels vehicles utilitzats per a l'execució de les activitats objecte de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) El cost d'adquisició del material destinat a la prevenció i a la lluita biològica contra les plagues indicades en el projecte subvencionat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Les despeses vinculades al material i l'equipament de laboratori necessari per al desenvolupament de les funcions tècniques de l'ADV.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. D'acord amb el que estableix l'article 31 de la Llei 38/2003, de 17 de novembre, general de subvencions, és despesa subvencionable i, per tant, forma part del pressupost inicial del projecte que es presenti, la que respongui a la naturalesa de l'activitat subvencionada, sigui estrictament necessària i es faci dins el termini establert en aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. A més del compliment dels requisits establerts en aquesta base, només es pot considerar com a despesa realitzada i, per tant, subvencionable, la que s'hagi pagat abans d'acabar el termini de presentació de la justificació de l'ajuda. La forma d'acreditar aquest pagament i el termini per dur-lo a terme es regulen en la base quinzena (justificació de les despeses).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En qualsevol cas, no formen part del pressupost subvencionable, vista la naturalesa del crèdit pressupostari, tot i que formin part del projecte:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Inversions, obres, compra d'equipaments o de qualsevol bé inventariable de naturalesa similar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Despeses que no compleixin els requisits esmentats en l'apartat 1 d'aquesta base.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Despeses l'import de les quals s'hagi pagat a un preu superior de mercat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Interessos deutors dels comptes bancaris, els interessos, els recàrrecs i les sancions administratives, i les despeses de procediments judicials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Impostos indirectes, quan siguin susceptibles de recuperació o compensació, i els impostos sobre la renda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Costos indirectes de llum, telèfon i internet.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Despeses relatives a menjars, refrigeris, serveis de menjars o altres de semblants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Determinació de l'import de la subvenció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Els ajuts màxims que es poden concedir per a cada ajuda és del 100 % de la despesa subvencionable, amb els límits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Apartats &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; i &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; fins a un màxim conjunt de 24.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Apartats del &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; al &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; fins a un màxim conjunt de 10.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En tot cas, l'import màxim de l'ajut es limitarà a 32.000 per a cada agrupació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Criteris que es tenen en compte per a la concessió dels d'ajuts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Sempre que es compleixin els requisits de la convocatòria, s'han d'atorgar els ajuts sol·licitats amb els límits fixats en la convocatòria i en aquestes bases, dintre del crèdit disponible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Si el total de l'ajut sol·licitat és superior al crèdit disponible, aquest s'ha de repartir proporcionalment entre els sol·licitants que compleixin els requisits i fins a l'import màxim establert en la base vuitena.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Per a la concessió dels ajuts, s'han de tenir en compte i prioritzar els aspectes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) El nombre de socis. Fins a deu socis, es donaran 5 punts. Per cada soci de més,1 punt més.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Major aportació anual que facin els socis a l'entitat. Fins a una aportació mitjana de 300 €/soci/any es donaran 3 punts, i per cada 100 €/soci/any, 1 punt més.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Formació que es preveu dur a terme per als tècnics de l'ADV, d'acord amb les línies establertes pel departament competent en la matèria, s'atorgaran 2 punts per cada curs assistit fins a un màxim de 6 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) S'atorgaran 1,5 punts per cada programa de control de plaga presentat per a la que hi hagi normes nacionals o de la unió, tant si són establertes per llei, reglament o acció administrativa, amb un màxim de 10 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. L'import de l'ajut es calcula en funció de la puntuació obtinguda i segons els barems següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Fins a 15 punts: 15.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De 16 a 29 punts: s'augmentarà proporcionalment fins a un màxim de 31.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;30 punts o més: 32.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Comissió Avaluadora dels ajuts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Comissió Avaluadora és l'òrgan col·legiat a qui correspon examinar les sol·licituds presentades i emetre'n l'informe que ha de servir de base per elaborar la proposta de resolució que ha de formular l'òrgan instructor competent. La seva creació i el nomenament dels seus membres s'estableix per a cada convocatòria, d'acord amb aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'objecte de la Comissió Avaluadora és examinar els expedients d'ajuts, que hauran d'anar acompanyats d'un informe tècnic, i emetre un informe que ha de servir de base per elaborar la proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Comissió Avaluadora ha d'estar integrada per persones que compleixin els criteris de competència professional i experiència. La composició ha de ser la següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Secretari/ària: un/a funcionari/ària del Departament&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vocals titulars:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Director/a insular competent en la matèria &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Dos tècnics agrícoles del CIM&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Tècnic de gestió del CIM&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Perquè la Comissió Avaluadora s'entengui vàlidament constituïda, es requerirà la presència del president, del secretari i almenys de la meitat dels membres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Procediment i òrgans competents per a la concessió dels ajuts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. D'acord amb els principis d'objectivitat, transparència, igualtat, no discriminació i publicitat, els ajuts es concediran per mitjà del procediment de concurrència competitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'expedient s'iniciarà amb l'aprovació de la convocatòria corresponent, posteriorment les bases i la convocatòria d'aquests ajuts es comunicaran a la Base de Dades Nacional de Subvencions (BDNS) i es publicarà en el BOIB l'esmentada identificació, conjuntament amb les bases i la convocatòria, en compliment de l'art. 20.8 de la Llei general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En compliment del que disposa l'article 11.1 del Reglament (UE) 2022/2472, es transmetrà a la Comissió Europea, a través del sistema de notificació electrònica corresponent, la informació resumida sobre cada mesura d'ajut exempta en virtut del Reglament esmentat, en el format normalitzat establert en l'annex II. Aquesta informació anirà acompanyada d'un enllaç que permeti accedir al text complet de la mesura de l'ajut, incloses les modificacions, en un termini de vint dies hàbits a partir de la seva entrada en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La instrucció correspon a un funcionari del Departament d'Economia i Serveis Generals, que ha de dur a terme d'ofici totes les actuacions necessàries per a la determinació, el coneixement i la comprovació de les dades en virtut de les quals s'ha de dictar resolució sobre la concessió dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Prèviament a la tramitació de la concessió d'aquests ajuts, l'instructor ha de comprovar que són compatibles amb altres ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Les sol·licituds presentades dins el termini establert en la convocatòria se sotmetran a l'examen de la Comissió Avaluadora. Si la sol·licitud no compleix els requisits establerts en la convocatòria o hi manca la documentació exigida, s'ha de requerir al sol·licitant perquè en un termini de deu dies hàbils esmeni el defecte o aporti la documentació preceptiva, amb l'advertiment que, si no ho fa, se'l tindrà per desistit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Una vegada la Comissió Avaluadora ha examinat les sol·licituds i després que hagi emès el seu informe, l'instructor n'ha d'elevar la proposta de resolució corresponent al conseller executiu competent, el qual dictarà una resolució sobre la concessió o denegació dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Quan la quantia de l'ajut proposat per l'òrgan instructor sigui substancialment inferior al sol·licitat, es podrà instar el beneficiari a reformular la sol·licitud a fi d'ajustar els compromisos i les condicions de la subvenció atorgable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La resolució de l'expedient d'atorgament de les subvencions ha de ser expressa i motivada, i ha de fixar, amb caràcter definitiu, la quantia específica de cada una de les subvencions concedides.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El termini màxim per dictar i notificar la resolució expressa de concessió de subvenció serà de sis mesos comptats des de la data d'acabament del termini de presentació de sol·licituds. No obstant l'anterior, aquest termini es podrà reduir si s'estableix expressament en la convocatòria dels ajuts. El silenci administratiu tindrà caràcter desestimatori.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. La resolució de l'expedient de concessió o denegació dels ajuts s'ha de remetre a la BDNS en compliment de l'article 20.8 de l'LGS i s'ha de publicar en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; als efectes de notificació (article 45.1 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de l'LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Modificació del projecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Quan l'entitat beneficiària, per causes de força major o per causes imprevisibles i alienes a la seva voluntat, hagi d'introduir modificacions irrellevants en el projecte, és a dir, que no alterin els objectius ni els aspectes essencials, aquestes s'han de comunicar al Consell Insular de Menorca el més prest possible o, en tot cas, en el moment de la justificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. No s'admetran modificacions substancials del projecte, és a dir, que alterin la naturalesa, les finalitats, les característiques essencials o qualsevol altre aspecte que pugui desvirtuar-lo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Abonament dels ajuts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Les subvencions s'han de fer efectives en el termini màxim de 60 dies des del moment en què es comprovi que la justificació presentada s'ajusta als requisits exigits en les bases de la convocatòria i sempre que la disponibilitat de tresoreria ho permeti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En el moment del pagament, el beneficiari haurà d'acreditar que està al corrent amb el compliment de les obligacions tributàries i de la Seguretat Social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. No es podrà fer el pagament de la subvenció mentre el beneficiari no estigui al corrent en el compliment de les obligacions tributàries i davant la Seguretat Social i de les obligacions tributàries amb el Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Respecte a les obligacions tributàries i amb la Seguretat Social, cal regir-se pel que estableix la base 6. No obstant això, l'entitat beneficiària pot substituir els certificats que s'assenyalen per una declaració responsable d'estar al corrent en el compliment de les obligacions esmentades quan l'import de la subvenció concedida en la convocatòria no superi els 3.000 euros (article 11 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; TRLGSIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. No s'abonaran els ajuts a les persones o entitats subjectes a una ordre de recuperació pendent després d'una decisió prèvia de la Comissió que hagi declarat una ajuda il·legal i incomptable amb el mercat interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Justificació de les despeses&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Les despeses que són objecte de subvenció s'han d'haver efectuat i pagat com a màxim el 31 de desembre de 2025. A aquests efectes, només es consideren subvencionables les despeses que hagin estat efectivament pagades dins d'aquest termini, amb la qual cosa queden excloses les que, tot i estar compromeses o facturades, no hagin estat abonades abans de la data esmentada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També són despeses subvencionables els pagaments duts a terme de l'1 al 15 de gener de l'any 2026, relatius a l'impost sobre la renda de les persones físiques (IRPF) i a la Seguretat Social que corresponguin a les despeses executades en el darrer trimestre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La documentació justificativa de l'activitat subvencionada s'ha de presentar fins al dia 15 de gener de 2026, inclòs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La justificació d'aquest conveni s'ha de presentar en la data abans indicada, tret que hi hagi causes excepcionals que ho impedeixin i que els beneficiaris han d'al·legar per escrit abans que acabi aquest termini, tal com preveu l'article 32 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques, i l'article 70 del Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions. Amb vista d'això, el CIM podrà ampliar el termini de justificació dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La justificació de la realització del projecte subvencionat s'ha de fer de manera individual per a cada una de les actuacions subvencionades i ha d'acreditar la consecució dels objectius de la subvenció, així com el compliment de les obligacions que determini, si escau, l'acte de concessió de l'ajut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Amb aquesta documentació, el beneficiari ha de demostrar que ha executat el projecte d'acord amb com el va sol·licitar inicialment o amb la introducció dels canvis que prèviament ha comunicat al Departament. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La justificació s'ha de formalitzar d'acord amb el que estableix l'article 75 del Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, general de subvencions, mitjançant la presentació d'un compte justificatiu simplificat, que ha d'incloure el contingut següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Memòria justificativa del compliment de les condicions imposades en la concessió de la subvenció, amb indicació de les activitats executades i el suport documental d'aquestes i altres aspectes que siguin rellevants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En relació amb els assajos fets o les experiències dutes a terme, s'han d'exposar els resultats obtinguts i les conclusions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cas que no s'hagi executat la totalitat del projecte per causes alienes o de força major, la memòria n'ha d'exposar les causes i s'ha d'explicar la resta del projecte elaborat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Relació nominativa de les despeses de l'activitat, amb identificació del creditor i document, import, data d'emissió i, si escau, data de pagament. En cas que el pressupost s'atorgui d'acord amb un pressupost estimat, cal indicar les desviacions esdevingudes (annex V, amb caràcter orientatiu).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Un detall d'altres ingressos o subvencions que hagin finançat l'activitat subvencionada amb indicació de l'import i procedència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Un exemplar, en cas d'actuacions que tenguin lloc després de l'aprovació de la convocatòria, de la publicitat escrita i gràfica relativa a l'activitat subvencionada, en la qual s'ha de fer constar el patrocini del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Una declaració responsable de l'entitat beneficiària sobre el fet que la despesa justificada no té un valor superior al de mercat (article 31.1 i 33 LGS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Si escau, una declaració responsable de l'entitat beneficiària que acrediti que no recupera ni compensa l'IVA (article 31.8 LGS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) Qualsevol altra documentació que es derivi de les bases o que sigui requerida per l'entitat beneficiària amb la finalitat de comprovar la justificació econòmica del projecte subvencionat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Si la documentació presentada fos incompleta o incorrecta, el servei responsable haurà de demanar al beneficiari que en faci la rectificació oportuna en el termini improrrogable de deu dies hàbils.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Si la despesa justificada excedeix de l'import concedit, la possible desviació pressupostària anirà a càrrec de l'entitat subvencionada. Si, per contra, la despesa justificada és inferior a l'import del pressupost sol·licitat i subvencionat s'haurà de reduir proporcionalment la subvenció concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En la fase de comprovació de la despesa feta es podrà requerir al beneficiari, mitjançant tècniques de mostreig, els justificants de despesa seleccionats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Consell Insular de Menorca podrà inspeccionar les activitats subvencionades, sens perjudici de les competències que puguin correspondre, per normativa legal o reglamentària, a altres organismes o institucions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Si el beneficiari no adopta les mesures de difusió adequades per donar publicitat al finançament públic del projecte, d'acord amb el que estableix l'article 31.3 &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;de l'RLGS, l'òrgan instructor li farà un requeriment perquè les adopti en un termini no superior a quinze dies, amb l'advertiment de les conseqüències que es poden derivar de no adoptar-les en aplicació de l'article 37 de l'LGS (en cas d'actuacions que tenguin lloc després de l'aprovació de la convocatòria).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Un cop transcorregut el termini establert a les bases per a la justificació, si aquesta no s'ha presentat, s'ha de requerir el beneficiari perquè la presenti en un termini improrrogable de quinze dies. Així mateix, aquest requeriment tindrà la consideració d'inici d'expedient de revocació i reintegrament que correspongui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Obligacions dels beneficiaris&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els beneficiaris han de complir les obligacions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Dur a terme les activitats que fonamenten la concessió dels ajuts i justificar-ne la realització en els terminis i en les condicions establertes en aquestes bases i en la resolució de concessió dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Comunicar al Consell Insular de Menorca l'acceptació de la subvenció en els termes en què aquesta es concedeix. En qualsevol cas, la subvenció s'entendrà acceptada tàcitament un cop hagin transcorregut quinze dies hàbils des de la notificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Dur a terme les activitats que fonamenten la concessió dels ajuts i justificar-ne la realització en els terminis i en les condicions establerts en aquestes bases i en la resolució de concessió dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Comunicar al Consell Insular de Menorca, en qualsevol moment o, en tot cas, a l'hora de justificar la subvenció, la sol·licitud o l'obtenció d'altres ingressos, subvencions o recursos d'ajudes per al mateix projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Comunicar immediatament al Consell Insular de Menorca qualsevol eventualitat que alteri o que dificulti greument el desenvolupament del projecte subvencionat, en particular si se'n poden derivar retards en l'execució o si en poden afectar el cost total.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Les entitats beneficiàries d'aquestes ajudes han de mantenir l'activitat durant un termini mínim d'un any des de la presentació de la sol·licitud; en cas contrari, se'ls podrà exigir la devolució total o parcial de la subvenció abonada més els interessos de demora, sens perjudici de la sanció que pugui correspondre per alteració de la finalitat per a la qual la subvenció va ser concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Acreditar, d'acord amb el que estableixen aquestes bases, que es troben al corrent de les obligacions tributàries i amb la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'acreditació no serà necessària en el cas que s'hagi autoritzat expressament el Consell Insular a consultar-ho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Proporcionar la informació sobre l'activitat subvencionada que li requereixi el Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Sotmetre's a les actuacions de comprovació que efectuïn el Consell Insular de Menorca i la resta d'organismes competents per a la fiscalització dels comptes públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Deixar constància de la percepció i l'aplicació de la subvenció en la comptabilitat o en els llibres registre que hagi de portar l'entitat beneficiària d'acord amb la normativa vigent i, en cas de no tenir aquesta obligació, en la documentació que la substitueixi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Conservar els documents justificatius de l'aplicació dels fons percebuts, inclosos els documents electrònics, mentre puguin ser objecte d'actuacions de comprovació i control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. Dur a terme les mesures de difusió adequades per fer públic el suport econòmic del Consell Insular de Menorca. En aquest sentit, la difusió s'ha de fer a través dels mitjans que siguin adequats d'acord amb la naturalesa del projecte. Si es fan fullets, cartells o qualsevol altre material imprès, s'ha de fer constar, de manera expressa, el suport del Consell Insular Menorca en la realització de les activitats subvencionades (en cas d'actuacions que tenguin lloc després de la convocatòria).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13. Reintegrar els fons percebuts en els supòsits prevists a l'article 37 de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Revocació i reintegrament dels ajuts. Criteris de graduació de possibles incompliments&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el cas d'incompliment total o parcial de les obligacions dels beneficiaris d'aquests ajuts, s'ha d'iniciar l'expedient de revocació i consegüent reintegrament dels ajuts segons correspongui. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pel que fa a la revocació i el reintegrament dels ajuts, s'han d'aplicar els articles 43 i 44 del TRLS i la resta de normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el cas que no sigui procedent la revocació total de l'ajut concedit, es pot aplicar un percentatge de minoració en funció de la naturalesa de l'incompliment esmentat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest percentatge s'ha de fixar en l'informe previ de l'instructor i la notificació al beneficiari i s'haurà de valorar, en tot cas, el grau d'incompliment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'entitat beneficiària ha complert de manera significativa les obligacions, si de la documentació presentada es dedueix que ha tingut voluntat de compliment i que s'han aconseguit les finalitats de l'ajut, s'ha de dur a terme una revocació parcial de l'ajut i, consegüentment, la pèrdua al dret de cobrament parcial de l'ajut, d'acord amb l'aplicació del criteri de gradació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) En cas que s'hagi executat totalment el projecte però la documentació justificativa de la despesa subvencionable del pressupost presentés deficiències perquè és inadequada, perquè no s'ajusta als requisits de les bases o perquè no s'ha executat la totalitat del pressupost inicial subvencionable, l'import de revocació parcial de l'ajut ha de coincidir amb l'import de l'ajuda no justificada o justificada incorrectament. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) En cas que l'entitat beneficiària no justifiqui dins el termini establert l'import de la subvenció atorgada, s'aplica una penalització de l'1 % per cada dia de retard. Aquesta penalització es durà a terme de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'entitat beneficiària justifica un import igual o superior a l'ajut concedit, la penalització es calcula sobre l'import concedit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'entitat beneficiària justifica un import inferior l'ajut concedit, la penalització es calcula sobre l'import efectivament justificat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) En cas que l'entitat beneficiària no faci constar de manera expressa el suport del CIM, s'aplica una penalització del 5 %. Aquesta penalització s'ha de dur a terme de conformitat amb el que s'ha establert en l'apartat anterior. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el cas que s'hagin fet uns pagaments anticipats, la persona beneficiària haurà de reintegrar les quantitats rebudes que hagin esdevingut indegudes més l'interès de demora, el qual es comptarà des del pagament de la subvenció, total o parcial, fins a la data de resolució mitjançant la qual s'acordi el reintegrament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si l'import de la suma de l'ajut més la resta d'altres ajudes, subvencions, ingressos o fons propis que hagin finançat la realització del projecte supera el pressupost total d'execució d'aquest, l'import de la revocació parcial de la subvenció ha de ser igual a la quantitat que excedeixi del pressupost executat esmentat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les quantitats que s'hagin de reintegrar tenen la consideració d'ingressos de dret públic i els és aplicable la via de constrenyiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'obligació de reintegrament establerta en aquest article és independent de les sancions que, si escau, siguin exigibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;18. Infraccions i sancions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En el cas d'incórrer en aquesta convocatòria en una actuació que va ser informada com a incompliment molt greu en la convocatòria anterior, es considerarà que aquest fet constitueix una infracció administrativa en matèria de subvencions i serà d'aplicació el que estableix el títol IV de la Llei 38/2003, de 17 de novembre, general de subvencions, i en títol V del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. L'òrgan competent per imposar les sancions que es derivin d'infraccions de l'establert en aquestes bases i de la normativa aplicable en matèria de subvencions és el conseller executiu competent per raó de la matèria en el cas d'infraccions lleus i greus, i el Consell Executiu en cas d'infraccions molt greus, de conformitat amb l'establert a l'article 69 de la Llei 4/2022, de 28 de juny, de consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;19. Altres disposicions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Recursos administratius&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els acords del Consell Executiu pels quals s'aproven les bases i les convocatòries dels ajuts no exhaureixen la via administrativa i són susceptibles d'interposar-hi un recurs d'alçada davant el Ple del Consell Insular de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les resolucions dels consellers executius per les quals es concedeixen i deneguen els ajuts no exhaureixen la via administrativa i són recurribles en alçada davant el Consell Executiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Normativa general aplicable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En tot el que no es preveu expressament en aquestes bases, regeixen les disposicions que són aplicables al Consell Insular de Menorca en matèria de subvencions, especialment les contingudes en les normes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Decret legislatiu 2/2005, de 28 de novembre, pel qual s'aprova el Text refós de la Llei de subvencions de la Comunitat Autònoma de les Illes Balears (BOIB núm. 196 de 31 de desembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Reglament (CE) núm. 2472/2022 de la Comissió, de 14 de desembre de 2022, pel qual es declaren determinades categories d'ajuda en els sectors agrícola i forestal i en zones rurals compatibles en el mercat interior en aplicació dels articles 107 i 108 del Tractat de Funcionament de la Unió Europea, modificat pel Reglament UE 289/2019, de 19 de febrer, i pel Reglament 2008/2020, de 8 de desembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Decret 52/2013, de 29 de novembre, mitjançant el qual es regulen les agrupacions de defensa vegetal en l'àmbit de les Illes Balears i es crea el Registre Oficial d'Agrupacions de Defensa Vegetal de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Llei 4/2022, de 28 de juny, de consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquest acord – que no exhaureix la via administrativa – es pot interposar un recurs d'alçada davant la Comissió de Govern, per delegació del Ple del Consell Insular de Menorca (Acord de 31-7-2023, BOIB núm. 109 de 5-8-2023), en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'esmentat recurs s'entendrà desestimat, si no es notifica la resolució corresponent, quan hagin transcorregut tres mesos des de la seva interposició. Contra la desestimació del recurs d'alçada per silenci administratiu podreu interposar recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
