    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Consell Executiu del Consell de Mallorca, en data 11 de juny de 2025, ha adoptat el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“&lt;strong&gt;1-Acord plenari de data 13 d'abril de 2023, amb correcció d'errades en data 11 de maig de 2023&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En data 13 d'abril de 2023 (correcció d'errades d'11 de maig de 2023), (BOIB núm. 62 de 13 de maig de 2023 i BOIB núm. 66 de 18 de maig de 2023), el Ple del Consell de Mallorca va adoptar acord de ratificació l'acord de la Mesa Sectorial de l'àrea operativa del Servei de Bombers de Mallorca, sobre el procediment de reclassificació de les categories de bomber –a conductor -a, caporal –a i operador –a de comunicacions i de modificació de la Relació de Llocs de Feina del personal del Servei de Bombers del Consell Insular de Mallorca, adoptat en sessió celebrada dia 5 d'abril de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Entre d'altres aspectes, pel que fa a l'increment de les retribucions vinculades a la modificació de la RLT, es va acordar:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“També derivat de l'esmentat Estudi, se modificarà el complement específic de manera següent:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;els llocs de bomber –a conductor –a passaran del CE 36 al 39&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;els llocs de bomber –a conductor –a GRM passaran del CE 39 al 41&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;els llocs de gestor –a d'emergències passaran del CE 40 al 36&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;els llocs de caporal –a de bombers –res passaran del CE 39 al 42&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;els llocs de caporal –a de bombers –res GRM passaran del CE 42 al 44 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;els llocs de sergent –a de prefectura passaran del CE 43 al 44 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;el lloc de suboficial –a passarà del CE 39 a 46.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;S'exceptuen els llocs de gestor-a d'emergències ocupats actualment, els quals romandran a extingir amb el complement específic 40.” &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2-Modificació de l'RLT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per a l'execució de l'acord plenari anterior, concretament respecte al lloc de treball de gestor-a d'emergències, en data 27 de març de 2024, el Consell Executiu va adoptar acord de modificació de l'RLT, que determina que aquest lloc roman a extingir amb les característiques actuals. Es tracta del lloc de treball amb codi F00130015 i compta amb 10 expansions. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cal indicar que, tot i establir que es tractava d'un lloc de treball a extingir, mitjançant el mateix acord del Consell Executiu de data 27 de març de 2024, no es va crear un nou lloc de treball amb les característiques establertes pel plenari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Així, les incorporacions de personal que es produeixin a les diferents expansions del nou lloc de treball, derivaran de la finalització de la cobertura a les expansions del lloc de treball a extingir. Aquestes incorporacions suposaran l'amortització simultània de la expansió corresponent del lloc de treball a extingir, així com el traspàs de la seva dotació pressupostària a l'expansió adient del nou lloc de treball que és objecte de cobertura.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per donar compliment doncs a l'acord plenari de data 13 d'abril de 2023, ja que per error la modificació de l'RLT no va incorporar la previsió continguda a l'acord plenari relativa a l'atribució del nivell de complement específic 36 als llocs de treball de gestor-a d'emergències, cal procedir a la rectificació d'errades de l'acord de modificació de l'RLT, de forma que incorpori la creació d'un nou lloc de treball amb les mateixes característiques que l'existent actualment (codi F00130015 que roman a extingir), amb excepció del nivell de complement específic, que serà 36. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les característiques del nou lloc de treball seran les següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformitat amb el que disposa l'article 109.2 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques “&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Les administracions públiques podran, així mateix, rectificar en qualsevol moment, d'ofici o a instància dels interessats, les errades materials, de fet o aritmètics existents en els seus actes”. &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Per tant, correspon al Consell Executiu del Consell Insular de Mallorca, l'adopció de l'acord de rectificació d'errades, per ser l'òrgan que va adoptar l'acord de modificació de l'RLT, segons al&lt;/span&gt;&lt;/span&gt;lò que s'estableix a l'article 28.1.e) de la Llei 4/2022, de 28 de juny de consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès l'anterior, el conseller executiu d'Hisenda i Funció Pública, en virtut de les atribucions conferides per l'acord de delegació del Consell Executiu de data 28 de setembre de 2022 (BOIB núm. 128, d'1 d'octubre de 2022), eleva al Consell Executiu del Consell de Mallorca per a la seva aprovació, el següent acord:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercer.&lt;/strong&gt; Les incorporacions de personal que es produeixin a les diferents expansions del nou lloc de treball, derivaran de la finalització de la cobertura a les expansions del lloc de treball a extingir. Aquestes incorporacions suposaran l'amortització simultània de la expansió corresponent del lloc de treball a extingir, així com el traspàs de la seva dotació pressupostària a l'expansió adient del nou lloc de treball que és objecte de cobertura.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quart.-&lt;/strong&gt;Autoritzar el conseller executiu d'Hisenda i Funció Pública per dur a terme l'aplicació individualitzada de les determinacions contingudes a la modificació aprovada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Cinquè.- &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;D&lt;/span&gt;&lt;/span&gt;isposar la publicació d'aquest acord en el &lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;i a la Seu Electrònica del Consell Insular de Mallorca.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquest acte, que no posa fi a la via administrativa, podeu interposar el recurs d'alçada davant la Comissió de Govern del Consell Insular de Mallorca, en el termini d'un mes, comptador a partir de l'endemà d'aquesta publicació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#fdfdfc"&gt;Contra la desestimació expressa d'aquest recurs d'alçada podeu interposar el recurs contenciós administratiu davant el Jutjat contenciós Administratiu de Palma que correspongui en el termini de dos mesos, comptadors a partir de l'endemà de rebre la notificació de la desestimació del dit recurs d'alçada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#fdfdfc"&gt;Si han transcorregut tres mesos des de la interposició del recurs d'alçada i no n'heu rebut la notificació de resolució expressa, s'entén desestimat per silenci i podeu interposar el recurs contenciós administratiu davant el Jutjat contenciós Administratiu de Palma que correspongui, sense limitació de temps.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#fdfdfc"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#fdfdfc"&gt;No obstant l'anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú. Tot això de conformitat amb la Llei 29/1998, de&amp;nbsp;13 de juliol, reguladora de la jurisdicció contenciosa administrativa, i la Llei 39/2015,&amp;nbsp;d'1 d'octubre de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
