    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Es publica la resolució del conseller executiu d'Hisenda i Funció Pública, per delegació del Consell Executiu, segons l'acord de 28 de setembre de 2022, BOIB núm. 128, d'1 d'octubre de 2022, de conformitat amb el que disposa l'article 45.1 b) de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;“ANTECEDENTS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Per resolució del conseller executiu d'Hisenda i Funció Pública de data 9 de desembre de 2022 BOIB núm. 163, de 15 de desembre de 2022, BOE núm. 305, de 21 de desembre de 2022), es va aprovar la convocatòria del procés selectiu pel sistema excepcional de concurs de mèrits per cobrir les places de personal laboral fix de les categories dels subgrups C1, C2 i grup E/AP derivada de l'oferta d'ocupació pública extraordinària de l'Institut de l'Esport Hípic de Mallorca per a l'any 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En aquesta resolució es varen convocar, entre d'altres, 6 places de Terminalista, corresponents al grup C2, personal laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Per acord del tribunal qualificador competent d'aquest procés selectiu d'estabilització, un cop concloses la revisió i baremació dels mèrits dels aspirants, en data 20 de febrer de 2025 es va publicar, en el tauler electrònic d'anuncis i en la seu electrònica del Consell Insular de Mallorca, l'Acord del Tribunal Qualificador d'estimació o desestimació de les al·legacions a la llista provisional de mèrits, resolució d'empats, aprovació de la llista definitiva de mèrits del procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal laboral fix del subgrups C2, de les categories de Secretari-ària de Presidència, Auxiliar gestió econòmica, Terminalista, Conductor-a i Coordinador-a de serveis, derivat de l'oferta d'ocupació pública extraordinària de l'Institut de l'Esport Hípic de Mallorca per l'any 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. &amp;nbsp;De conformitat amb el punt 8 de les bases específiques de la convocatòria, un cop assignats els llocs de treball oferts, el tribunal ha d'elevar al conseller executiu d'Hisenda i Funció Pública la proposta de persones aspirants que han superat el procés selectiu de concurs de mèrits per a l'ingrés com a com a personal laboral fix del subgrup C2, amb assignació de llocs de feina. Aquesta llista ha de contenir, com a màxim, tantes persones aprovades com el nombre de places convocades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. &amp;nbsp;En data 8 d'abril de 2025 el tribunal qualificador competent del procediment selectiu ha acordat elevar al conseller d'Hisenda i Funció Pública Acord del Tribunal Qualificador de la proposta de les persones aspirants que han superat el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal laboral fix del subgrup C2 de l'Institut de l'Esport Hípic de Mallorca, categoria/especialitat Terminalista, de nomenament com a laboral fix i de l'adjudicació de llocs de feina, d'acord amb el tràmit de manifestació d'ordre de preferències efectuat, per al seu nomenament com a personal laboral fix, la qual conté tantes persones aprovades com el nombre de places convocades. En el cas en què no s'hagués efectuat el tràmit per part de la persona aspirant, el lloc de treball ha estat assignat d'ofici.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. En data 10 d'abril de 2025, per &lt;/span&gt;Resolució del conseller d'Hisenda i Funció Pública, s'aprova la llista definitiva de persones aspirants que han superat el procés selectiu pel sistema excepcional de concurs de mèrits per a l'ingrés com a personal laboral fix del subgrup C2 i oferiment de llocs de treball de la categoria de Terminalista de l'Institut de l'Esport Hípic de Mallorca i d'assignació de llocs de feina per torn d'accés per a la seva contractació com a personal laboral fix.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7. &lt;/span&gt;En data 10 juny de 2025, per Resolució del Conseller executiu d'Hisenda i Funció Pública, l'aspirant Margarita del Mar Ribas Samaniego, amb opció per a l'ingrés com a personal laboral fix de la categoria de Terminalista, va ser declarada exclosa definitivament en la convocatòria corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. En data 12 de juny de 2025, el Tribunal Qualificador competent del procediment selectiu ha acordat elevar al conseller d'Hisenda i Funció Pública Acord del Tribunal Qualificador de modificació de proposta de les persones aspirants que han superat el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal laboral fix del subgrup C2 de l'Institut de l'Esport Hípic de Mallorca, categoria/especialitat Terminalista, de nomenament com a laboral fix i de l'adjudicació de llocs de feina, per motiu d'exclusió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;FONAMENTS DE DRET&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. L'article 91.1 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. L'article 68 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. La llei 20/2021 de 28 de desembre de mesures urgents per a la reducció de la temporalitat en la ocupació pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. La llei 4/2022, de 28 de juny de consells Insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. L'article 4 del Decret llei 6/2022, de 13 de juny, de noves mesures urgents per reduir la temporalitat en l'ocupació pública de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7. Resolució del conseller executiu d'Hisenda i Funció Pública de data 9 de desembre de 2022 (BOIB núm. 163, de 15 de desembre de 2022, BOE núm. 305, de 21 de desembre de 2022), es va aprovar la convocatòria del procés selectiu pel sistema excepcional de concurs de mèrits per cobrir les places de personal laboral fix de les categories dels subgrups C1, C2 i grup E/AP derivada de l'oferta d'ocupació pública extraordinària de l'Institut de l'Esport Hípic de Mallorca per a l'any 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;1. APROVAR&lt;/strong&gt; la modificació de la llista definitiva de persones aspirants que han superat el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal laboral fix del subgrup C2, categoria/especialitat Terminalista de l'Institut de l'Esport Hípic de Mallorca, d'acord amb el que s'indica a l'Annex I d'aquesta resolució amb indicació de l'assignació dels llocs de treball corresponents. D'acord amb l'article 52.3 de la Llei 3/2007, en concordança amb l'article 61.8 del TREBEP, aquesta llista conté, com a màxim, tantes persones aprovades com el nombre de places convocades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. INFORMAR &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. Que de conformitat amb la base específica 8.1 de l'Annex II de la convocatòria, d'acord amb l'article 22.1 del Decret llei 6/2022 els llocs de prefectures orgàniques i llocs singularitzats s'han d'adjudicar en adscripció provisional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. Que l'adjudicació i adscripció definitiva dels llocs de feina a les persones aspirants esmentades queda condicionada a l'acreditació d'estar en possessió de tots els requisits específics per a l'ocupació del lloc de treball, que hauran de ser requerits, si escau per l'administració. En cas de no acreditar-los, l'adscripció del lloc de treball seria amb caràcter provisional. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. Que les persones aspirants que es relacionen a continuació NO han acreditat estar en possessió de tots els requisits per a l'adscripció al lloc de treball, per la qual cosa, d'acord amb l'establert a les bases específiques de la convocatòria, l'adjudicació del lloc de treball es farà en adscripció provisional. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Les persones aspirants s'han acollit a l'exempció d'acreditació del requisit d'acreditació de coneixements de llengua catalana segons la disposició addicional tretzena del Decret llei 6/2022, de 13 de juny amb la redacció modificada per la disposició final primera del Decret llei 5/2025 de 16 de maig i la base específica 4.2 de l'Annex II de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;De conformitat amb les bases de la convocatòria, aquestes persones restaran obligades, en el termini de quatre anys, comptadors a partir de la pressa de possessió com a personal funcionari de carrera, o la seva contractació com a personal laboral fix, a acreditar el nivell de coneixement de la llengua catalana exigit per a l'accés de la categoria/especialitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Si transcorregut el termini de quatre anys, no s'acredita el nivell de coneixements de la llengua catalana exigit per a l'accés, aquestes persones seran remogudes del lloc de treball per manca d'adequació a les funcions d'aquest, mitjançant un procediment contradictori i oïts els òrgans de representació del personal corresponent. La remoció suposa el cessament en el lloc de treball obtingut en el corresponent procés selectiu, i la pèrdua d'aquest lloc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Aquestes persones restaran obligades a participar en totes les convocatòries de proves de llengua catalana que durant aquest període convoquin la Direcció General de Política Lingüística i l'Escola Balear d'Administracions Públiques per obtenir el certificat de coneixements de llengua catalana corresponent al nivell exigit per a l'accés a la categoria/especialitat a la qual s'ha accedit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;3.&lt;/strong&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DECLARAR DESERTA&lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="color:black"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;una de les sis places de Terminalista&lt;strong&gt;, &lt;/strong&gt;&lt;/span&gt;donat que no hi ha més candidats a la llista.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4&lt;span style="color:black"&gt;. ORDENAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt; la publicació d'aquesta resolució i el seu annex en el tauler d'edictes i a la Seu electrònica del&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; Consell Insular de Mallorca, i en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;INTERPOSICIÓ DE RECURSOS &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra aquest acte, que no posa fi a la via administrativa, podeu interposar el recurs d'alçada en el termini d'un mes, comptador a partir de l'endemà de rebre aquesta notificació. El recurs es pot interposar formalment davant el Consell Executiu o davant la Comissió de Govern del Consell Insular de Mallorca, que és l'òrgan competent per resoldre'l.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
