![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fets</strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. L' 11 de setembre de 2021, en el BOIB núm.125, es va publicar la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable<strong> </strong>, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions públiques i el tercer sector, en el marc del Pla de Recuperació, Transformació i Resiliència europeu,<strong> </strong>mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021, modificada per la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 19 d'octubre de 2022 (BOIB núm.137, de 22 d'octubre de 2022).</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Les persones o entitats que figuren en l'annex d'aquesta Proposta varen presentar una sol·licitud de subvenció en el marc de la convocatòria.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Actualment, el pressupost de la categoria d'emmagatzematge que s'ha assignat a la Comunitat Autònoma de les Illes Balears (d'acord amb el que estableix l'annex V del Reial decret 477/2021, de 29 de juny, pel qual s'aprova la concessió directa a les comunitats autònomes i a les ciutats de Ceuta i Melilla d'ajuts per a l'execució de diversos programes d'incentius lligats a l'autoconsum i a l'emmagatzematge amb fonts d'energia renovable, així com a la implantació de sistemes tèrmics renovables en el sector residencial, en el marc del Pla de Recuperació, Transformació i Resiliència europeu) s'ha exhaurit i per tant no és possible atendre, d'acord amb l'ordre de prelació corresponent, la part d'emmagatzematge de les sol·licituds de les quals no es disposa de crèdit.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">4. En cas de disposició o ampliació de pressupost de la categoria d'emmagatzematge, la Direcció general d'Economia Circular, Transició Energètica i Canvi Climàtic crearà d'ofici un nou expedient sobre la categoria d'emmagatzematge amb data de la sol·licitud inicial i que es resoldrà d'acord amb que estableix l'apartat onzè de la convocatòria. El nou número d'expedient s'ha de notificar a les persones interessades mitjançant la seva publicació, en el <em>Butlletí Oficial de les Illes Balears</em> i a la pàgina web de la Direcció general d'Economia Circular, Transició Energètica i Canvi Climàtic (<em>http://energia.caib.cat</em>).</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Els tècnics de la d'Economia Circular, Transició Energètica i Canvi Climàtic han examinat les sol·licituds i han emès un informe favorable dels aspectes següents:</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Les persones o entitats sol·licitants, per la seva naturalesa, poden ser beneficiàries de subvencions.</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Les persones o entitats han adjuntat la documentació prevista en la convocatòria.</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Les persones o entitats sol·licitants estan al corrent de les obligacions amb la Seguretat Social i amb l'Administració tributària, tant l'estatal com l'autonòmica.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Els tècnics de la Direcció General d'Economia Circular, Transició Energètica i Canvi Climàtic, en aplicació del procediment de concessió que estableix l'apartat onzè de la Resolució esmentada, han informat favorablement sobre la concessió de les subvencions descrites en l'annex, les quals s'han calculat d'acord amb la Resolució de convocatòria d'aquests ajuts.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. A aquelles persones o entitats que varen presentar una sol·licitud de subvenció que superava la ràtio de capacitat d'emmagatzematge enfront de la potència pic de generació que dicta la convocatòria, se'ls proposa només la part corresponent a l'ajut relativa a la generació i no es considera elegible la instal·lació d'emmagatzematge.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Llei 38/2003, de 17 de novembre, general de subvencions.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Decret 75/2004, de 27 d'agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm. 122, de 2 de setembre de 2004).</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El Reial decret 477/2021, de 29 de juny, pel qual s'aprova la concessió directa a les comunitats autònomes i a les ciutats de Ceuta i Melilla d'ajuts per a l'execució de diversos programes d'incentius lligats a l'autoconsum i a l'emmagatzematge amb fonts d'energia renovable, així com a la implantació de sistemes tèrmics renovables en el sector residencial, en el marc del Pla de Recuperació, Transformació i Resiliència europeu.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021 per la qual s'aprova la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions públiques i el tercer sector, en el marc del Pla de Recuperació, Transformació i Resiliència europeu (BOIB núm. 125, d'11 de setembre de 2021).</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica per la qual es modifica i amplia el crèdit de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021 per la qual s'aprova la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions publiques i el tercer sector, en el marc del Pla de Recuperació, Transformació i Resiliència europeu NextGenerationEU <span style="color:black">(BOIB núm.137, de 22 d'octubre de 2022).</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. L'Ordre HFP/1030/2021, de 29 de setembre, per la qual es configura el sistema de gestió del Pla de Recuperació, Transformació i Resiliència, així com per l'Ordre HFP/1031/2021, de 29 de setembre, per la qual s'estableix el procediment i format de la informació a proporcionar per les entitats del sector públic per al seguiment del compliment de les fites i objectius i d'execució pressupostària i comptable de les mesures dels components del Pla de Recuperació, Transformació i Resiliència.</span></p>
<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Proposta de resolució</strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propòs al conseller <span style="color:black">d'Empresa, Ocupació i Energia</span> que dicti una resolució en els termes següents:</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Aprovar la concessió d'una subvenció per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions públiques i el tercer sector per un import total de 232.802,74 euros i 75 beneficiaris, pels components següents:</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Programa 4: sol·licituds pel component de generació (component 31), sense emmagatzematge.</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Programa 4: sol·licituds pels components de generació i emmagatzematge: únicament es concedeix la part de la categoria d'autoconsum renovable (component 31) i es denega la part de la categoria d'emmagatzematge (component 8 o component 31) per manca de crèdit d'aquests components.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En l'annex d'aquesta proposta figuren les dades de cada beneficiari sobre la concessió de la subvenció.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autoritzar i disposar la despesa de 232.802,74 euros als 75 beneficiaris que figuren en l'annex i pels imports que es detallen per cadascun d'ells, amb càrrec a la partida pressupostària indicada en l'annex dels pressuposts de la Comunitat Autònoma de les Illes Balears. Els fons per a la concessió de l'ajut procedeixen del Ministeri per a la Transició Ecològica i el Repte Demogràfic, del Pla de Recuperació, Transformació i Resiliència, i del Mecanisme de Recuperació i Resiliència Fons NextGenerationEU.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Disposar que les inversions objecte de la sol·licitud s'han de fer i justificar des del 30 de juny de 2021 fins al 31 de març de 2026.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Establir que el pagament i la justificació s'han de fer d'acord amb el que disposa l'apartat tretzè de la convocatòria de subvencions.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Per a les instal·lacions aïllades no connectades a la xarxa elèctrica, amb la documentació justificativa s'ha d'incorporar un document que acrediti la legalitat del lloc d'emplaçament.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Els beneficiaris estan obligats a complir amb el que disposa l'apartat dissetè de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Disposar que tota alteració de les condicions establertes per a la concessió de la subvenció, com també l'obtenció concurrent de subvencions o ajuts atorgats per altres administracions públiques o ens públics, nacionals o internacionals, dona lloc a la revisió parcial o total de la subvenció i, per tant, al reintegrament de la quantitat corresponent més els interessos de demora.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. D'acord amb l'article 10.t de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 19 d'octubre de 2022 per la qual es modifica i amplia el crèdit de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021, les persones o entitats beneficiàries han de garantir el ple compliment del principi de no causar un perjudici significatiu al medi ambient (DNSH per les seves sigles en anglès — Do no significant harm—) i l'etiquetatge climàtic i digital, i d'acord amb el que es preveu en el Pla de Recuperació, Transformació i Resiliència, aprovat pel Consell de Ministres el 27 d'abril de 2021 i pel Reglament (UE) núm. 2021/241 del Parlament Europeu i del Consell, de 12 de febrer de 2021, pel qual s'estableix el Mecanisme de recuperació i resiliència; com també d'allò requerit en la Decisió d'execució del Consell relativa a l'aprovació de l'avaluació del Pla de Recuperació i Resiliència d'Espanya.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Atès que la convocatòria de subvenciones es veu afectada per l'Ordre HFP/1030/2021, de 29 de setembre, per la qual es configura el sistema de gestió del Pla de Recuperació, Transformació i Resiliència, així com per l'Ordre HFP/1031/2021, de 29 de setembre, per la qual s'estableix el procediment i format de la informació a proporcionar per les entitats del sector públic per al seguiment del compliment de les fites i objectius i d'execució pressupostària i comptable de les mesures dels components del Pla de Recuperació, Transformació i Resiliència, és necessari que el beneficiari, a més a més dels documents establerts per a la justificació en l'apartat tretzè de la convocatòria, presenti els documents que s'adjunten com a annex II d'aquesta Proposta i que són els següents:</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>a) </em>Declaració responsable del compliment dels principis transversals establerts en PRTR i d'acord amb l'establert en l'article 8.1.<em>i)</em> de l'Ordre HFP/1030/2021. Adopció de mesures eficaces i proporcionades per evitar el frau, corrupció, conflicte d'interessos i doble finançament en l'àmbit de gestió d'aquests ajuts, segons el que es disposa en els acords i reglaments de la UE i en l'Ordre HFP/1030/2021.</span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>b)</em> Declaració d'acceptació de la cessió i tractament de dades entre Administracions Públiques en relació amb l'execució i actuacions del PRTR, de conformitat amb la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals, i amb l'Ordre HFP/1030/2021.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. D'acord amb l'article 12 de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 19 d'octubre de 2022 per la qual es modifica i amplia el crèdit de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021, el beneficiari té l'obligació de reconèixer l'origen i garantir la visibilitat del finançament de la Unió atès l'article 9.3.d de l'Ordre HFP/1030/2021.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra aquesta Proposta de resolució podeu al·legar el que considereu convenient en el termini màxim de deu dies hàbils comptadors des de l'endemà de la publicació en el <em>Butlletí Oficial de les Illes Balears</em>. En cas contrari, s'entendrà que estau conforme amb el contingut de la Proposta.</span></p>
