&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. L' 11 de setembre de 2021, en el BOIB&amp;#xa0; núm.125, es va publicar la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable&lt;strong&gt; &lt;/strong&gt;, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions públiques i el tercer sector, en el marc del Pla de Recuperació, Transformació i Resiliència europeu,&lt;strong&gt; &lt;/strong&gt;mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021, modificada per la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 19 d'octubre de 2022 (BOIB núm.137, de 22 d'octubre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Les persones o entitats que figuren en l'annex d'aquesta Proposta varen obtenir una subvenció per a la implantació d'instal·lacions renovables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Les persones que figuren en l'annex d'aquesta Proposta varen presentar la documentació justificativa de les actuacions realitzades, en què s'acredita que l'import de l'actuació ha estat inferior al previst inicialment o s'ha reduït la instal·lació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. Els serveis tècnics competents han informat favorablement sobre el pagament de les subvencions descrites en l'annex, en què s'inclou una minoració de l'import proporcional a les modificacions realitzades, les quals s'han calculat d'acord amb la Resolució de convocatòria d'aquests ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. El 22 d'abril 2025, es va emetre una proposta de resolució de minoració&amp;#xa0; de l'import de subvenció del director general d'Energia i Canvi Climàtic (BOIB núm. 52, de 26 d'abril de 2025).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. En data 15 de maig de 2025 l'entitat CAN NOGUERA SL (expedient NEXTG123-181/2021), juntament amb l'empresa instal·ladora Soluciones Solares Ibicencas, van presentar un escrit d'al·legacions contra la proposta de resolució del director general d'Economia Circular, Transició Energètica i Canvi Climàtic en el que exposa:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;«(...)Que en la justificación presentada el 29/06/2023 se aportó una fotografía en la que pueden apreciarse claramente los raíles en el extremo derecho de la cubierta desamiantada, lo cual demuestra que la fotografía utilizada es de antes de realizar la modificación, pero que ya estaba preparandose el cambio, si bien no se notificó explícitamente ni se incluyó una imagen general actualizada posterior, por encontrarse claramente la solicitud de subvención realizada anteriormente al conocimiento de este nuevo criterio.&lt;em&gt; &lt;/em&gt;»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7. En data 2 de juny de 2025, una vegada revisada la documentació es va emetre un informe tècnic en el que s'informa favorablement a les al·legacions presentades per l'entitat CAN NOGUERA SL. Aquest informe conclou:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;«Que en l'expedient NEXTG123-181/2021 no aplica el límit de que el 50 per cent de potència instal·lada de generació ha de situar-se sobre la superfície amb retirada d'amiant i s'informa favorablement l'estimació de les al·legacions presentades per la persona o entitat CAN NOGUERA SL contra la proposta de minoració del director general d'Economia Circular, Transició Energètica i s'insta a prosseguir amb la correcció de la proposta de minoració publicada al BOIB Nº 52 de dia 26 d'abril de 2025.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;8. S'ha exhaurit el termini que es concedia per presentar al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. La Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. El Decret&amp;#xa0;75/2004, de 27 d'agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm.&amp;#xa0;122, de 2 de setembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

L'Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en matèria d'energia (BOIB núm. 72, de 24 de maig de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. El Reial decret&amp;#xa0;477/2021, de 29 de juny, pel qual s'aprova la concessió directa a les comunitats autònomes i a les ciutats de Ceuta i Melilla d'ajuts per a l'execució de diversos programes d'incentius lligats a l'autoconsum i a l'emmagatzematge amb fonts d'energia renovable, així com a la implantació de sistemes tèrmics renovables en el sector residencial, en el marc del Pla de Recuperació, Transformació i Resiliència europeu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021 per la qual s'aprova la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions públiques i el tercer sector, en el marc del Pla de Recuperació, Transformació i Resiliència europeu (BOIB núm.&amp;#xa0;125, d'11 de setembre de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;8. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica per la qual es modifica i amplia el crèdit de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021 per la qual s'aprova la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, i la incorporació d'emmagatzematge en instal·lacions d'autoconsum amb fonts d'energia ja existents, en el sector residencial, les administracions publiques i el tercer sector, en el marc del Pla de Recuperació, Transformació i Resiliència europeu NextGenerationEU (BOIB núm.137, de 22 d'octubre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;9. L'Ordre&amp;#xa0;HFP/1030/2021, de 29 de setembre, per la qual es configura el sistema de gestió del Pla de Recuperació, Transformació i Resiliència, així com per l'Ordre&amp;#xa0;HFP/1031/2021, de 29 de setembre, per la qual s'estableix el procediment i format de la informació a proporcionar per les entitats del sector públic per al seguiment del compliment de les fites i objectius i d'execució pressupostària i comptable de les mesures dels components del Pla de Recuperació, Transformació i Resiliència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;10. La Resolució del conseller d'Empresa, Ocupació i Energia per la qual es modifica la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021 per la qual s'aprova la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, en el sector de serveis i altres sectors productius de l'economia, i per a la incorporació d'emmagatzematge en instal·lacions d'autoconsum, amb fonts d'energia renovable, ja existents en el sector de serveis i altres sectors productius, en el marc del Pla de Recuperació, Transformació i Resiliència europeu «NextGenerationEU» (BOIB núm.41, de 26 de març de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Reconèixer l'obligació i proposar el pagament d'una subvenció als beneficiaris que figuren en l'annex, d'acord amb l'import que també s'hi indica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Autoritzar i disposar negativament la despesa a revocar parcialment dels beneficiaris indicats en l'annex, pels imports i pel motiu que també s'hi indiquen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Establir que els beneficiaris estan obligats a complir amb el que disposa l'apartat dissetè de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. Disposar que tota alteració de les condicions establertes per a la concessió de la subvenció, com també l'obtenció concurrent de subvencions o ajuts atorgats per altres administracions públiques o ens públics, nacionals o internacionals, dona lloc a la revisió parcial o total de la subvenció i, per tant, al reintegrament de la quantitat corresponent més els interessos de demora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs de reposició davant el conseller de Transició Energètica, Sectors Productius i Memòria Democràtica, en el termini d'1 mes comptador des de l'endemà d'haver-ne rebut la notificació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú i de les administracions públiques i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà d'haver rebut la notificació de la Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
