    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Junta de Govern de l'Ajuntament de Palma en sessió de dia 21 de maig va adoptar el següent acord: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“&lt;strong&gt;Antecedents &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Reglament d'Organització i Funcionament de la Mesa General de Negociació Conjunta de l'Ajuntament de Palma, va ser aprovat en Junta de Govern Local de data 13 d'octubre de 2016, (BOIB&amp;nbsp; núm. 94, d'1 d'agost de 2017) i modificat per Acord de la Junta de Govern de dia 26 de juliol de 2017.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. L'article 8 del Reglament regula les reunions ordinàries i estableix que la periodicitat de les reunions és d'una reunió al mes, preferentment el primer dijous de cada mes.&amp;nbsp;A més s'estableix que les organitzacions sindicals interessades a incloure assumptes en una reunió ordinària els han de presentar davant el Departament de Recursos Humans dins el termini màxim de les 14 h del &lt;em&gt;dijous&lt;/em&gt; anterior a la reunió. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. S'ha detectat una errada material en l'índex del Reglament, en incloure's l'article 13 que no forma part del reglament, la qual cosa comporta la numeració incorrecta dels articles posteriors.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Normativa&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;El Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'Estatut Bàsic de l'Empleat públic.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;Els articles 19 i 20 del Reglament d'organització i funcionament de la Mesa General de Negociació Conjunta de l'Ajuntament de Palma, aprovat en Junta de Govern Local de data 13 d'octubre de 2016, (BOIB&amp;nbsp; núm. 94, d'1 d'agost de 2017), quant a la modificació del Reglament.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;L'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques,&amp;nbsp; disposa que les Administracions públiques podran, així mateix, rectificar en qualsevol moment, d'ofici o a instancia dels interessats, les errades materials, de fet o aritmètics existents en els seus actes.&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Consideracions jurídiques&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'article 8 del Reglament regula les reunions ordinàries i estableix que la periodicitat de les reunions serà d'una reunió al mes, preferentment el &lt;em&gt;primer dijous &lt;/em&gt;de cada mes.&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstant això, la celebració de les reunions ordinàries no s'està duent a terme el primer dijous de cada mes amb motiu de problemes logístics de disponibilitat del lloc de celebració, així com a causa dels conflictes d'agenda de l'administració en coincidir amb l'assistència a altres reunions que es programen per al mateix dia de la setmana. Per aixó, es considera adient canviar el dia de celebració d'aquestes reunions al segon dimarts de cada mes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;D'acord amb l'establert a l'article 19 del Reglament la modificació del mateix ha de ser aprovada per la Mesa General de Negociació Conjunta amb el vot favorable dels representants de l'Ajuntament de Palma i de la majoria absoluta de la part sindical d'acord amb la seva representativitat.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;A més segons l'article 20 del reglament, la proposta de modificació del Reglament ha d'anar acompanyada dels motius que la justifiquin i de la redacció alternativa que es proposa.&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D'altra banda, s'ha detectat una errada material a l'índex del Reglament, que inclou l'article 13 que no forma part d'aquest. Motiu pel qual, es corregeix l'índex així com l'enumeració dels articles posteriors per a reflectir l'enumeració correcta, d'acord amb l'article 109.2 de la Llei 39/2015.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, d'acord amb el que disposa l'article 127.1.g) de la Llei 7/1985, de 2 d'abril, de bases de règim local, de conformitat amb la modificació atribuïda per la Llei 57/2003, de 16 de desembre de mesures per a la modernització de Govern local, segons les competències delegades pel Decret de batlia núm. 10678, de 10/09/2024 (BOIB núm. 125, de 24/09/2024) i l'acord de la Junta de Govern, de 05/07/2023 (BOIB núm. 95 de 11/07/2023) i les titularitats assignades pel Decret de batlia núm. 202400797, de 18/01/2024 (BOIB núm. 11, de 23/01/2024), i de conformitat amb la base 21.1b) de les Bases d'execució del pressupost general municipal vigent, propòs a la regidora de l'Àrea d'Hisenda, Funció Pública i Govern Interior que elevi a la Junta de Govern l'adopció del següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;strong&gt;ACORD&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primer.&lt;/strong&gt; Modificar l'article 8 del Reglament d'organització i funcionament de la Mesa General de Negociació Conjunta del personal funcionari i del personal laboral de l'Ajuntament de Palma, en el sentit de: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercer.&lt;/strong&gt; Procedir a la publicació del text definitiu del Reglament al BOIB, a la Intranet municipal&amp;nbsp; i al Portal de Transparència de l'Ajuntament.”&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra aquesta resolució, que exhaureix la via administrativa, es pot interposar recurs de reposició davant el mateix òrgan que l'ha dictada, d'acord amb el que disposa l'article 123 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques. El termini per interposar-lo és d'un mes comptat des de l'endemà de la publicació. En aquest cas no es podrà interposar recurs contenciós administratiu fins que s'hagi resolt el de reposició.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El recurs potestatiu de reposició s'ha de presentar al registre general d'aquest Ajuntament o a les dependències a què es refereix l'article 16.4 de la Llei 39/2015, d'1 d'octubre, abans esmentada, i es considerarà desestimat quan no s'hagi resolt ni notificat la resolució, en el termini d'un mes, comptat des de l'endemà de la seva interposició. En aquest cas queda expedita la via contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si no s'utilitza el recurs potestatiu de reposició, es pot interposar directament recurs contenciós administratiu, d'acord amb el que estableix l'article esmentat anteriorment, i els 45 i següents de la llei 29/98, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, davant el Jutjat Contenciós Administratiu, en el termini de dos mesos comptats des de l'endemà de la publicació. Això sense perjudici de qualsevol altre recurs o acció que es consideri convenient. &lt;/span&gt;&lt;/p&gt;
