&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;En data de 30 de maig de 2025, mitjançant resolució 1380/2025, es va dictar la següent resolució que es fa pública als efectes corresponents&lt;strong&gt;:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;“En relació amb l'expedient per a l'adjudicació de llocs de treball a les persones aspirants que han superat el procés selectiu d'estabilització pel sistema de concurs-oposició de personal laboral fix del grup C1, categoria/especialitat (professor guitarra) de l'Ajuntament de Pollença, i d'acord amb els següents fets i fonaments:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;1.- Una vegada tramitat per part del Consell de Mallorca el procediment d'estabilització, mitjançant concurs-oposició, per a la contractació de professor de guitarra de l'Ajuntament de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;Considerant el BOIB núm. 63, de 20 de maig de 2025, que fa pública la resolució de la llista definitiva de persones aspirants pel sistema de concurs-oposició per a l'ingrés com a personal laboral fix, entre d'altres del professor de guitarra de l'Ajuntament de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;2.-En data de 21 de maig de 2025, mitjançant E-RE 4318/2025, l'aspirant ha acceptat el lloc ofert per l'Ajuntament de Pollença&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;Vista la proposta de resolució PR/2025/1324 de 23 / de maig / 2025 fiscalitzada favorablement amb data de 27 / de maig / 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;3.- En data de 28 de maig de 2025, mitjançant resolució d'alcaldia 1324/2025, es va resoldre, entre d'altres:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;“&lt;strong&gt;..&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;2.-CONTRACTAR, &lt;/strong&gt;com a personal laboral fix, amb la categoria/especialitat de professor de guitarra, a la persona aspirant que ha superat el procediment selectiu d'estabilització pel sistema de concurs-oposició per a la convocatòria d'aquestes places, d'acord amb el que s'indica a l'annex 1 d'aquesta resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;Vista la proposta de resolució PR/2025/1380 de 29/ de maig/ 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;strong&gt;RESOLUCIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;1.- Rectificar l'error material detectat, especificant al punt 2 de la resolució que el contracte és per curs escolar, així com a l'annex 1 i, en conseqüència:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.- &lt;strong&gt;ADJUDICAR&lt;/strong&gt; el lloc de treball de professor de guitarra, del subgrup C1, d'acord amb el que s'indica a l'annex 1 d'aquesta resolució, a la persona aspirant que ha superat el procés selectiu d'estabilització pel sistema de concurs-oposició. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;3.-CONTRACTAR, &lt;/strong&gt;com a personal laboral fix, amb la categoria/especialitat de professor de guitarra, per curs escolar, a la persona aspirant que ha superat el procediment selectiu d'estabilització pel sistema de concurs-oposició per a la convocatòria d'aquestes places, d'acord amb el que s'indica a l'annex 1 d'aquesta resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;strong&gt;4.-ORDENAR &lt;/strong&gt;la publicació de la present Resolució en el Butlletí Oficial de les Illes Balears, als efectes oportuns. La signatura del contracte del lloc adjudicat s'ha d'efectuar en el termini de 3 dies hàbils, comptat a partir de l'endemà de la publicació d'aquesta resolució en el Butlletí Oficial de les illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;Abans de la signatura del contracte del lloc adjudicat, la persona interessada ha de fer constar que no ocupa cap lloc de treball ni que fa cap activitat en el sector públic de les que es comprenen en l'article 1 de la Llei 53/1984, de 26 de desembre, d'incompatibilitats del personal al servei de les administracions públiques. Si du a terme cap activitat privada, incloses les de caràcter professional, ho ha de declarar en el termini de deu dies hàbils comptadors a partir de l'endemà de la presa de possessió, perquè l'òrgan competent acordi la declaració de compatibilitat o incompatibilitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="line-height:105%"&gt;Peu de recurs&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:125%"&gt;&lt;span style="line-height:125%"&gt;Contra aquesta resolució, que posa fi a la via administrativa, i de conformitat amb el que es disposa en els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, i 8, 45 i 46 de la Llei 29/1998, de 13 de juliol, es podrà interposar un dels següents recursos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Amb caràcter potestatiu, recurs de reposició davant el mateix òrgan que va dictar l'acte recorregut, en el termini d'un mes, a comptar des de l'endemà al de la recepció d'aquesta notificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La interposició del recurs, excepte en els casos en què una disposició estableixi el contrari, no suspendrà l'execució de l'acte impugnat, de conformitat amb el que es disposa en l'article 117 de la Llei 39/2015, d'1 d'octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Si transcorregués un mes des de l'endemà al de la interposició del recurs de reposició sense que aquest hagi estat resolt, podrà entendre que ha estat desestimat i interposar recurs contenciós administratiu davant el Jutjat contenciós&amp;nbsp; administratiu de Palma, en qualsevol moment, a comptar des de l'endemà al de la desestimació presumpta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Recurs contenciós administratiu davant el Jutjat contenciós administratiu de Palma, dins del termini de dos mesos comptats des de l'endemà al de la recepció d'aquesta&amp;nbsp; notificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En cas d'optar pel recurs potestatiu de reposició no es podrà interposar el recurs contenciós administratiu fins que aquell sigui resolt expressament o s'hagi produït la seva desestimació per silenci administratiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Tot això sense perjudici de qualsevol altre recurs o acció que estimi procedent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
