&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;El vicepresident en Matèria Agrària del FOGAIBA en data 1 d&amp;apos;abril de 2025, va signar la següent resolució,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. En data 26 de febrer de 2015, es va publicar en el BOIB núm. 29 l&amp;apos;Ordre del conseller d&amp;apos;Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s&amp;apos;estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. En data de 28 de febrer de 2015 es va publicar, al BOIB núm. 30, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s&amp;apos;aprova la convocatòria per a l&amp;apos;any 2015 de les ajudes destinades al foment de l&amp;apos;agricultura ecològica. Aquesta Resolució ha patit dues modificacions publicades en el BOIB núm. 87, d&amp;apos;11 de juny de 2015 i l&amp;apos;altra en el BOIB núm. 86, de 30 de juny de 2016.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. En data 4 d&amp;apos;octubre de 2016 es va publicar al BOIB núm. 126, la Resolució de concessió de les ajudes per al foment de l&amp;apos;agricultura ecològica, on es concedia la quantitat anual de 288,29 € al beneficiari José Reche García (expedient AECU 57/15) per al període 2015-2019. De la mateixa manera en el BOIB núm. 138 de l&amp;apos;1 de novembre de 2016, es va notificar la concessió de les ajudes per al foment de l&amp;apos;agricultura ecològica a Son Pujol, S.L. (expedient AECU 72/15), per un import anual de 3.641,30 € durant el període 2015-2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. En data 6 de febrer de 2020 es va publicar la resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s&amp;apos;aprova, mitjançant el procediment anticipat de despesa, la convocatòria, per a l&amp;apos;any 2020, de les ajudes per prorrogar els compromisos assumits per al foment de l&amp;apos;agricultura ecològica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. En data 21 de març de 2020 es publicà al BOE núm. 78 la Ordre APA / 269/2020, de 19 de març, per la qual s&amp;apos;amplia el termini de presentació de la sol·licitud única, per a l&amp;apos;any 2020, que estableix l&amp;apos;article 95 de Reial Decret 1075/2014, de 19 de desembre, sobre la aplicació a partir de 2015 dels pagaments directes a l&amp;apos;agricultura i a la ramaderia i altres règims d&amp;apos;ajuda, així com sobre la gestió icontrol dels pagaments directes i dels pagaments a el desenvolupament rural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. En data 12 de maig de 2020 i 15 de juny de 2020, José Reche García (expedient AECU 57/15) i Son Pujol, S.L. (expedient AECU 72/15), sol·liciten respectivament la convocatòria de les ajudes per prorrogar els compromisos assumits per al foment de l&amp;apos;agricultura ecològica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7. En data 11 de febrer de 2023 es va publicar, en el BOIB núm. 19, la Resolució de denegació de la pròrroga 2020 de les ajudes per al foment de l&amp;apos;agricultura ecològica per a l&amp;apos;any 2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;8. En data 9 de setembre de 2023, en el BOIB núm. 125, es revoca l&amp;apos;anteriorment esmentada Resolució de denegació de pròrroga per als interessats José Reche García (expedient AECU 57/15) i Son Pujol, S.L. (expedient AECU 72/15), ja que es comprova que sí compleixen parcialment amb el compromís de formació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;9. En data 27 d&amp;apos;agost de 2024 el vicepresident en matèria agrària del FOGAIBA va dictar Acord de revocació parcial de l&amp;apos;ajuda concedida al beneficiari José Reche García (expedient AECU 57/15), per Resolució de dia 21 d&amp;apos;octubre de 2016 per un import anual de 288,29 € (2015-2019) i reintegrar parcialment les anualitats 2015, 2016, 2017, 2018 i 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;10. En data 5 de febrer de 2025 el vicepresident en matèria agrària del FOGAIBA va dictar Acord de revocació parcial de l&amp;apos;ajuda concedida al beneficiari Son Pujol SL (expedient AECU 72/15), per Resolució de dia1 de novembre de 2016 per un import anual de 3.641,30 € durant el període 2015-2019 i reintegrar parcialment les anualitats 2015, 2016, 2017, 2018 i 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;11. Els òrgans gestors del Servei d&amp;apos;Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d&amp;apos;acord amb les normes reguladores d&amp;apos;aquesta ajuda. Degut a que l&amp;apos;incompliment del requisit de formació és un compromís avaluable, i segons disposa el quadre resum de sancions i exclusions per incompliments de compromisos avaluables de la Resolució de convocatòria del BOIB núm. 30 de 28 de febrer de 2015 i tal i com explica el punt 2 de l&amp;apos;annex II de la Resolució de convocatòria del BOIB núm. 16 del 6 de febrer de 2020: “Per al càlcul de la penalització, en cas de reiteració d&amp;apos;incompliments, s&amp;apos;agafarà tot el període 2015-2019 més l&amp;apos;any de la pròrroga”, la concessió de la pròrroga 2020 tendrà una penalització d&amp;apos;acord amb aquestes disposicions tal i com es detalla a l&amp;apos;annex I de la present Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;12. Tenint en compte que, a dia d&amp;apos;avui, existeix disponibilitat de crèdit, és possible resoldre aquests expedients sense afectar el que disposa l&amp;apos;apartat setè de la Resolució de la Convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;13. Atès tot això, i per tal d&amp;apos;esmenar les errades detectades, es proposa concedir la pròrroga per a l&amp;apos;ant 2020 de les ajudes destinades al&amp;nbsp; foment&amp;nbsp; de l&amp;apos;agricultura ecològica de l0any 2015 als beneficiaris José Reche García (expedient AECU 57/15) i Son Pujol, S.L. (expedient AECU 72/15) tal i com es detalla a l&amp;apos;annex I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 28 de febrer de 2015 per la qual s&amp;apos;aprova la convocatòria per a l&amp;apos;any 2015 de les ajudes destinades al foment de l&amp;apos;agricultura ecològica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l&amp;apos;Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l&amp;apos;Ordre de la consellera d&amp;apos;Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l&amp;apos;assumpció de l&amp;apos;execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l&amp;apos;article 1 que el FOGAIBA assumeix l&amp;apos;execució de la política de la Conselleria d&amp;apos;Agricultura i Pesca referent a l&amp;apos;aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l&amp;apos;1 de gener de 2006.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
