    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ple del Consell de Mallorca, en data 15 d'abril de 2025, aprovà inicialment l'expedient de modificació de la plantilla de la Corporació per a l'any 2025, que fou exposat al públic durant quinze dies hàbils, mitjançant anunci publicat en el Butlletí Oficial de les Illes Balears núm. &amp;nbsp;51, de 24 d'abril de 2025.&amp;nbsp; El text de l'acord pres és el següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;"La vigent plantilla del Consell de Mallorca, fou aprovada pel Ple en sessió extraordinària de dia 18 de desembre de 2024&lt;/span&gt;, publicada en el BOIB núm. 167, de 21 de desembre de 2024&lt;span style="color:black"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En data 19 de febrer de 2025, el Consell Executiu del Consell de Mallorca va adoptar acord de modificació de la Relació de Llocs de Treball (RLT) del Consell de Mallorca (exp. 1110736P), publicat al BOIB núm. 24, de 22 de febrer de 2025 i en data 5 de març de 2025, el Consell Executiu va adoptar acord de rectificació d'errades a l'acord de data 19 de febrer de 2025, publicat al BOIB núm. 30, de 8 de març de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Derivada d'aquesta modificació de la RLT, es troba en tràmit una modificació de la plantilla de personal, que va ser aprovada inicialment per acord plenari de data 13 de març de 2025, i actualment en termini d'exposició pública previ a la seva aprovació definitiva (Exp. 1203923Q). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En data 31 de març de 2025, el secretari tècnic del Departament d'Hisenda i Funció Pública ha formulat una sol·licitud de modificació de la plantilla de personal, derivada també de la modificació de la RLT del Consell de Mallorca aprovada pel Consell Executiu en data 19 de febrer de 2025, q&lt;span style="color:black"&gt;ue no pot ser ajornada a l'exercici pressupostari següent, atesa la necessitat de cobertura efectiva dels llocs de treball que s'hi especifiquen, que afecten al diferents departaments del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La proposta formulada pel secretari tècnic d'Hisenda i Funció Pública inclou el següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DEPARTAMENT DE CULTURA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Creació de noves places&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- 1 plaça de coordinador-a de la Direcció Insular de Cultura (codi F00060048), a l'escala d'administració general, subescala tècnica (A1).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Reconversió de places existents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- 1 plaça de coordinador-a econòmic-a i de règim intern de Cultura i Patrimoni (codi F00230007), a l'escala d'administració general, subescala tècnica (A1), procedent de la conversió del lloc de secretari-ària de coordinació administrativa (C2), de l'escala d'administració general, subescala auxiliar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DEPARTAMENT DE MEDI AMBIENT, MEDI RURAL I ESPORTS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Creació de noves places&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- 1 plaça de cap de servei de Gestió Econòmica i Serveis Generals de la Secretaria Tècnica (codi F00100295), a l'escala d'administració especial, subescala tècnica, classe superior, especialitat economista (A1).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DEPARTAMENT D'HISENDA I FUNCIÓ PÚBLICA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Creació de noves places&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Dues places de tècnic-a jurídic-a del Servei de Contractació de la Secretaria Tècnica (codi F00060053, exp. 1 i 2) i una plaça de cap de Servei Jurídic a l'Escola Mallorquina d'Administració Pública (EMAP) (Codi F00060054), a l'escala d'administració general, subescala tècnica (A1).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Una plaça d'administratiu d'administració general del Servei de Contractació de Secretaria Tècnica (codi F00080124), a l'escala d'administració general, subescala administrativa (C1)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Una plaça de tècnic-a de grau mitjà de selecció a l'Àrea de Selecció del Servei de Selecció i Proveïment de l'EMAP (codi F00110198) a l'escala d'administració especial, subescala tècnica, classe mitjana, especialitat selecció. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DEPARTAMENT DE TURISME&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Creació de noves places&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Una plaça de cap de servei de Control de l'Oferta no Registrada de la Direcció Insular de Turisme per a l'Oferta i la Qualitat (codi F00060049), a l'escala d'administració general, subescala tècnica (A1).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Una plaça de cap de secció del Servei de d'Ordenació Turística de la Direcció Insular de Turisme per a l'Oferta i la Qualitat (codi F00060050), a l'escala d'administració general, subescala tècnica (A1).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Una plaça de cap de secció del Servei de Sancions de la Direcció Insular de Turisme per a l'Oferta i la Qualitat (codi F00060051), a l'escala d'administració general, subescala tècnica (A1).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Reconversió de places existents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;-Una plaça de cap de servei Promoció Turística de la Direcció Insular de Turisme per a la Demanda i l'Hospitalitat (codi F00220039), a l'escala d'administració especial, subescala tècnica, classe superior, especialitat informàtica (A1), procedent de la conversió del lloc de cap de secció de Promoció Turística de la Direcció Insular de Turisme per a la Demanda i la Hospitalitat, de l'escala d'administració especial, subescala tècnica, classe mitjana, sense especialitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Resulta necessària doncs, la tramitació d'una nova modificació de la plantilla de personal d'acord amb la modificació de la RLT aprovada, que no pot ser ajornada a l'exercici pressupostari següent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Atès allò que en relació a la plantilla de personal preveu l'article 90 de la Llei 7/1985 de 2 d'abril, reguladora de les bases de règim local, i l'article 17.1.w) de la Llei 4/2022, de 28 de juny, de consells insulars&lt;/span&gt;. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès que el pressupost vigent compta amb crèdit adequat i suficient per fer front a la despesa prevista a la proposta de modificació puntual de la plantilla, segons l'informe emès pel cap d'administració econòmica.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Atès allò que en relació al procediment per a l'aprovació de la modificació de la plantilla preveu l'article 112 de la Llei 7/1985 de 2 d'abril, reguladora de les bases de règim local, i l'article 169 del Reial decret legislatiu 2/2004 de 5 març, pel qual s'aprova el text refós de la Llei reguladora de les Hisendes Locals, en aplicació de l'article 126.3 del Reial decret legislatiu 781/1986 de 18 d'abril.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atesos els informes a la proposta emesos pel cap del Servei Tècnic de Recursos Humans, pel cap del Servei d'Administració Econòmica de la Direcció Insular de Funció Pública i amb la fiscalització de conformitat del Servei d'Intervenció General&amp;nbsp; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El conseller executiu d'Hisenda i Funció Pública del Consell Insular de Mallorca eleva al Ple la següent proposta d'acord, que ja incorpora la modificació de la plantilla aprovada inicialment pel ple del Consell de Mallorca en data 13 de març de 2025:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;Primer&lt;/strong&gt;. APROVAR inicialment la modificació de la vigent plantilla del Consell de Mallorca per a l'any 2025, amb efectes de l'endemà al de la publicació en el BOIB d'aquest acord, en els termes que es recullen a continuació. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Aquest acord aprovatori serà considerat com a definitiu si no es produeixen reclamacions en contra durant el termini d'exposició pública de 15 dies hàbils comptadors de l'endemà de la data d'inserció d'aquest anunci al Butlletí Oficial de les Illes Balears, d'acord amb el que disposa l'article 112.3 de la llei 7/85 de 2 d'abril, reguladora de les bases de règim local, i també a l'art. 169 del Text refós de la Llei reguladora de les Hisendes Locals. ”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Transcorregut el termini d'exposició pública sense que s'hagi presentat cap reclamació ni suggeriment, atesa la certificació emesa pel Secretari General del Consell de Mallorca en data 22 de maig de 2025, s'entén aprovat definitivament l'acord anterior, segons preveu l'article 112 de la Llei 7/1985, de 2 d'abril, reguladora de les bases de Règim Local, i l'article 169 del Reial Decret legislatiu 2/2004, de 5 de març, pel qual s'aprova el text refós de la Llei reguladora de les Hisendes Locals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra aquest acord d'aprovació definitiva, que exhaureix la via administrativa, els interessats legitimats a què es refereix l'article 171 del Reial Decret legislatiu 2/2004, de 5 de març, poden interposar el recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos, comptadors a partir del dia següent de la publicació d'aquest acord. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. No obstant l'anterior, podeu exercitar, si escau, qualsevol altre recurs que considereu pertinent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
