El 3 de juliol de 2021 es va publicar la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III)<em><strong><span style="background-color:null"> </span></strong></em>mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021, modificada per la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 3 d'agost de 2022 (BOIB núm. 103, de 6 d'agost de 2022).</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="background-color:null">2. El 25 de setembre de 2024 es va emetre la Resolució del conseller d'Empresa, Ocupació i Energia per la qual es concedeixen les subvencions en el marc de la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència Europeu finançat per la Unió Europea-NextGenerationEU (BOIB núm. 130, de 3 d'octubre de 2024). </span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="background-color:null">En aquesta Resolució es concedia una subvenció al Sr.Gonzalo Jesús Sánchez Ruiz, amb NIF ***3648**, (exp. MOVES III-2865/2021) per import de 4.500,00 euros, ajut establert per la categoria M1 sense desballestament, i s'autoritzava i disposava al seu favor aquesta despesa. </span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="background-color:null">3. El 19 de març de 2025 es va emetre la Resolució per la qual es modifica la Resolució del conseller d'Empresa, Ocupació i Energia de 25 de setembre de 2024 per la qual es concedeixen les subvencions en el marc de la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència Europeu finançat per la Unió Europea-NextGenerationEU, en la part que afecta a l'expedient MOVES III-2865/2021 (BOIB núm. 59, de 10 de maig de 2025).</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="background-color:null">4. Amb posterioritat, s'ha detectat un error material en el punt 6 dels fets de la Resolució esmentada en el punt anterior.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><strong><span style="background-color:null">Fonaments de dret</span></strong></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="background-color:null">1. L'article 56 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, disposa que la rectificació dels errors materials, aritmètics i de fet en actes i disposicions administratives correspon a l'òrgan que ha dictat l'acte o la disposició. Així mateix, la rectificació d'errors ha d'especificar, si escau, els efectes jurídics que se'n deriven i s'ha de notificar o publicar preceptivament quan faci referència a actes que han estat notificats o publicats.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="background-color:null">2. L'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix que les administracions públiques poden rectificar en qualsevol moment, d'ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="background-color:null">Per tot això, dict la següent</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="color:null"><span style="line-height:1"><strong><span style="background-color:null">Resolució</span></strong></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="background-color:null">1. Aprovar la rectificació de l'error material existent en la Resolució per la qual es modifica la Resolució del conseller d'Empresa, Ocupació i Energia de 25 de setembre de 2024 per la qual es concedeixen les subvencions en el marc de la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència Europeu finançat per la Unió Europea-NextGenerationEU, en la part que afecta a l'expedient MOVES III-2865/2021, en els termes següents:</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><strong><span style="background-color:null">On diu:</span></strong></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="background-color:null">6. El dia 28 de novembre de 2024, el Servei d'Energies Renovables i Eficiència Energètica va emetre un informe tècnic respecte a la subvenció atorgada a Gonzalo Jesús Sánchez Ruiz, segons el qual:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><em><span style="background-color:null">2.El punt 6.1 de la convocatòria estableix la quantia dels ajuts pel Programa d'incentius 1.</span></em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><em><span style="background-color:null">Adquisició de vehicles elèctrics
