&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 6 de maig de 2025, va signar la següent resolució,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En data 30 de gener de 2024 es va publicar, en el Butlletí Oficial de les Illes Balears (BOIB) núm. 15, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 25 de gener de 2024, per la qual s'aprova la convocatòria per a l'any 2024 de les ajudes destinades al pagament compensatori per a zones amb limitacions específiques a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;2. En data 18 de febrer de 2025 es va publicar, en el BOIB núm. 22, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 14 de febrer de 2024, per la qual s'incrementa el crèdit de la Resolució del president del FOGAIBA de 25 de gener de 2024 del paràgraf anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;3. En data 30 de gener de 2024 es va publicar, en el Butlletí Oficial de les Illes Balears (BOIB) núm. 15, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 25 de gener de 2024, per la qual s'aprova la convocatòria per a l'any 2024 de les ajudes destinades al pagament compensatori en zones de muntanya a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;4. De conformitat amb l'apartat sisè de les resolucions anteriors, modificades per Resolució del president del FOGAIBA de 2 de juliol de 2024 i publicada al BOIB núm. 88 de 4 de juliol, de determinats ajuts corresponents a les intervencions en forma de pagaments directes que preveu el Pla estratègic de la PAC (PEPAC) per a l'any 2024, el termini de presentació de sol·licituds de determinades intervencions al desenvolupament rural es va modificar. Aquest nou termini de presentació va acabar dia 15 de juny de 2024 i varen tenir entrada en el registre del FOGAIBA un total de 1298 sol·licituds d'ajuda de pagament compensatori per a zones amb limitacions específiques i un total de 252 sol·licituds d'ajuda de pagament compensatori en zones de muntanya a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;6. En data 29 de març de 2025 es va notificar, mitjançant la publicació al BOIB núm. 39, l'informe desfavorable i la proposta provisional de denegació de les ajudes, emesa pel Servei d'Ajudes al Desenvolupament Rural als interessats de l'Annex I, on es va concedir a les persones interessades un termini de 10 dies hàbils per a presentar les al·legacions escaients. Aquesta proposta de resolució provenia d'un requeriment de documentació anterior publicat al BOIB núm. 20 el 13 de febrer de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;7. Els interessats de l'Annex I no han aportat la documentació requerida, i s'ha constatat que no compleixen el punt 7 de l'apartat Tercer de la convocatòria, estar al corrent de les obligacions tribut`àries amb l'AEAT.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fonaments de dret&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;3. Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Ordre 10/2023 de la consellera d'Agricultura, Pesca i Alimentació, &lt;span style="background-color:#ffffff"&gt;de 6 &lt;/span&gt;d'abril de 2023, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc de les intervencions per al desenvolupament rural de les Illes Balears 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;5. La llei 3/2019, de 31 de gener, agrària de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;6. La llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;La resta de normativa de desenvolupament i aplicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;Per tot això dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Denegar les sol·licituds presentades pels interessats relacionats a l'Annex I adjunt, de les línies d'ajuda pagament compensatori per a zones amb limitacions específiques 2024 i pagament compensatori en zones de muntanya 2024, per no complir el/s requisit/s abans esmentats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Declarar conclòs el procediment i arxivar els expedients detallats a l'Annex I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Notificar la resolució als interessats de l'Annex I mitjançant la seva publicació en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Informar els interessats que els seus expedients es troben a la seva disposició i consulta al Servei d'Ajudes de Desenvolupament Rural del FOGAIBA (carrer de Reina Constança, núm.4 de Palma).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposició de recursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquesta resolució - que no exhaureix la via administrativa. Es pot interposar recurs d'alçada davant el conseller d'Agricultura, Pesca i Medi Natural, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears i els articles 121 i 122 de la Llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
