    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;L'Estatut d'autonomia de les Illes Balears insta els poders públics de la Comunitat Autònoma a reconèixer l'activitat turística com a element econòmic estratègic. Així mateix, demana que el foment d'aquesta es porti a terme de manera respectuosa amb el medi ambient, el patrimoni cultural i el territori, com també amb una visió del creixement econòmic a mitjà i a llarg termini.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;A l'apartat 3 de l'article 70, també de l'Estatut d'autonomia, s'atribueix la promoció turística, en tant que competència pròpia, al Consell Insular de Menorca (CIM); per altra banda, la Fundació Foment del Turisme de Menorca (FFTM) va ser creada a iniciativa del Consell amb la finalitat, entre altres, de promocionar el turisme a Menorca i a l'exterior. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Des de la seva fundació, l'any 1932, el Foment del Turisme de Menorca s'havia dedicat a la defensa i promoció dels interessos turístics de Menorca. &lt;span style="color:#00000a"&gt;Acabada aquella etapa, els socis i l'equip de govern van decidir crear i dotar de 70 milers d'euros un premi que recordés la infatigable labor de l'entitat. El CIM va recollir el testimoni d'aquella proposta, passant a ser, un cop liquidada aquella entitat, el garant i responsable d'aquest guardó.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;La Junta Liquidadora de &lt;/span&gt;Foment del Turisme de Menorca &lt;span style="color:#00000a"&gt;va proposar al CIM la creació del Premi Joan Gomila Borràs de Turisme; aquesta iniciativa, i el &lt;/span&gt;compromís&lt;span style="color:#00000a"&gt; corresponent&lt;/span&gt;, van quedar expressament recollits &lt;span style="color:#00000a"&gt;en el conveni que, en data 29 de novembre de 2016, van signar el CIM i la junta esmentada. S'honorava així el primer president d'aquella entitat primigènia motor de la promoció turística i, de llavors ençà, en quatre ocasions han estat reconegudes diverses personalitats que, d'una manera o d'una altra, han mantingut viu l'esperit d'una promoció turística de qualitat per a la nostra illa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="background-color:#ffffff"&gt;L'interès públic d'aquest guardó, que convoca biennalment el CIM, és el reconeixement públic a l'esforç i la dedicació de&lt;span style="color:#00000a"&gt; &lt;/span&gt;les persones, professionals, empreses o entitats que hagin contribuït, o puguin fer-ho amb propostes de futur, a la millora de la indústria turística de Menorca sense oblidar la responsabilitat social i ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tot això, en exercici de les competències atribuïdes per la Llei 4/2022, de 28 de juny, de consells insulars, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Atesa la proposta del president del Consell Insular de Menorca;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Consell Executiu, per unanimitat i en votació ordinària, adopta el següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ACORD:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer.&lt;/strong&gt; Aprovar les bases reguladores annexades que regiran les convocatòries del «Premi Joan Gomila Borràs de Turisme». &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon.&lt;/strong&gt; Aprovar, simultàniament, la convocatòria de la V edició del «P&lt;span style="color:#00000a"&gt;remi Joan Gomila Borràs de Turisme» per a &lt;/span&gt;l'any 2025, que es regirà per les dites bases i d'acord amb les condicions següents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Objecte i finalitat del premi&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'objecte del Premi Joan Gomila Borràs de Turisme és el &lt;span style="color:#00000a"&gt;reconeixement públic a l'esforç i la dedicació de&lt;/span&gt;&lt;span style="color:#00000a"&gt; &lt;/span&gt;&lt;span style="color:#00000a"&gt;les persones, professionals, empreses o entitats que hagin contribuït, o puguin fer-ho amb propostes de futur, a la millora de la indústria turística de Menorca amb el propòsit de servir d'exemple per la seva responsabilitat social i ambiental&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segona. Característiques del premi&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. El Premi Joan Gomila Borràs de Turisme és biennal i està dotat amb 5.000 euros, provinents de la dotació atorgada per la comissió liquidadora del Foment del Turisme de Menorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Sempre que sigui possible, el distintiu s'ha d'atorgar el dia 3 d'agost de l'any corresponent, coincidint amb l'aniversari de la constitució del Foment de Turisme de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. La quantia podrà entregar-se de manera única a un guanyador, ser dividida entre els possibles mereixedors &lt;em&gt;ex aequo&lt;/em&gt; o declarar-se deserta i no entregar-se, si després d'estudiar i valorar les candidatures així ho considera el jurat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercera. Requisits per a l'obtenció del premi &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Poden ser guardonades amb el Premi Joan Gomila Borràs de Turisme les persones, físiques o jurídiques, empreses o entitats susceptibles de ser valorades per qualsevol dels següents aspectes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Trajectòries i dedicacions personals o empresarials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Projectes d'actuació que destaquin la innovació, l'emprenedoria o la competitivitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Iniciatives de promoció i comercialització del producte turístic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Aplicació de noves tecnologies que afegeixin valor al producte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Tesis, projectes o estudis relacionats amb l'activitat turística, sempre que siguin aportacions fetes, estudis i treballs conclosos i, potser, publicats. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Queden exclosos: treballs a futur o en execució, ajuts o patrocinis a la investigació o a l'edició de llibres i tesis, o similars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. En qualsevol cas, no poden ser-ne beneficiàries les persones o entitats en les quals concorri alguna de les prohibicions que estableix l'article 10 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quarta. Presentació de les sol·licituds&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Requisits i documentació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Qualsevol persona, física o jurídica, o entitat, degudament identificada, pot presentar candidatures que optin al premi, però ningú no es pot presentar per ell mateix. Ha de constar la identificació, exacta i precisa, de la persona o entitat proposada; això és, nom, llinatges i DNI, o bé, denominació fiscal, nom comercial i NIF.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- La candidatura es presentarà utilitzant el model habilitat a l'efecte o qualsevol altre que contingui la informació indicada a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Memòria descriptiva amb els mèrits (CV si es tracta d'una persona física) i la informació, justificativa i raonada, de la candidatura al premi. No es valoren avals de cap mena, ni els presentats per tercers ni els inclosos en una mateixa candidatura. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Si la proposta de la candidatura és a títol pòstum, s'ha de fer constar aquesta circumstància en la presentació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Les possibles candidatures dels diversos departaments del CIM s'han de presentar a la direcció insular de Promoció Turística i Fons Europeus, per registre d'entrada, fent servir el model habilitat, degudament signat firmat per la persona responsable de la candidatura, i acompanyat de la documentació indicada en aquest apartat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Termini de presentació: les candidatures i la resta de documentació transcrita a l'apartat anterior, es poden presentar a partir de l'endemà de la publicació de la convocatòria corresponent en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; (BOIB) i fins al dia que assenyali la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Formes de presentació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Per mitjans electrònics d'acord amb el que estableix l'art. 14.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (LPACAP), al registre electrònic del Consell Insular de Menorca (&lt;em&gt;www.cime.es&lt;/em&gt;) o a qualsevol altre registre electrònic dels establerts en l'article 16.4 de l'LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Facultativament, la poden presentar presencialment, d'acord amb el que estableix l'article 14.1 de l'LPACAP, les persones físiques, per preservar el dret de comunicar-se amb l'Administració pública també per mitjans no electrònics, mitjançant el registre electrònic del Consell Insular de Menorca (a la Seu del CIM de Maó i a les oficines administratives de Ciutadella) o a qualsevol altre registre i lloc dels establerts en l'article 16.4 de l'LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Si algun subjecte obligat a fer la presentació de candidatura per mitjans electrònics presenta el seu escrit presencialment, se'l requerirà perquè l'esmeni mitjançant la seva presentació electrònica. A aquest efecte, i d'acord amb el que estableix l'article 68.4 de l'LPACAP, es considerarà com a data de presentació de l'escrit aquella en què hagi tingut lloc l'esmena.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Totes les candidatures presentades dins el termini establert se sotmetran a l'examen de la instrucció que ha de comprovar el compliment dels requisits exigits i fer arribar les propostes admeses al jurat nomenat a l'efecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Si l'escrit de presentació de candidatura o la documentació fossin incorrectes o incompletes, la instrucció en requerirà la rectificació o el complement necessaris. Si en el termini de deu dies hàbils, comptats a partir de l'endemà de la notificació del requeriment, la persona interessada no fa la rectificació reclamada o no presenta la documentació requerida, s'entendrà que ha desistit de la seva petició de conformitat amb l'article 68 de l'LPACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cinquena. Jurat del premi&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Les candidatures al «Premi Joan Gomila Borràs de Turisme» seran valorades mitjançant el concurs d'un jurat integrat pels membres següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Tres persones del CIM elegides pel Departament de presidència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;b)&lt;/em&gt; Tres persones que triarà el Departament de presidència del CIM d'entre la llista de jurats proposats, en el seu dia, per la Comissió liquidadora del «Foment del Turisme de Menorca».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;c)&lt;/em&gt; Exercirà les funcions de secretariat, amb veu i sense vot, la persona que instrueixi l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. El jurat serà nomenat en la convocatòria corresponent, s'ha de convocar amb una antelació mínima de cinc dies i es considerarà vàlidament constituït amb l'assistència de dos terços dels membres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. El jurat, sobre la base de les candidatures presentades, ha de designar la persona o persones guanyadores del premi i es reserva el dret de repartir-lo entre els possibles mereixedors «ex aequo» o declarar-lo desert. Així mateix, s'ha d'estendre una acta en la qual s'han de fer constar les candidatures presentades i l'acord finalment adoptat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. Els membres del jurat podran demanar la informació complementària que considerin oportuna per valorar els mèrits dels candidats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5. El mateix jurat, si no s'hi ha presentat cap proposta, o quan les presentades no tenguin prou entitat, pot suggerir l'atorgament del premi a la persona o entitat que consideri amb mèrits suficients i destacables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6. Les deliberacions del jurat són secretes i totes les decisions s'han de prendre per majoria simple dels assistents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7. La resolució del jurat és inapel·lable, ha de tenir lloc, sempre que sigui possible, abans del dia 7 d'agost de l'any de la convocatòria i, en qualsevol cas, abans del 31 de desembre d'aquell mateix any. En el cas que no hi hagi resolució expressa s'entendran desestimades les candidatures presentades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;8. L'acord de concessió del distintiu que comunicarà la presidència del jurat s'ha de notificar a les persones interessades o, si escau, als seus familiars, per qualsevol mitjà admès en dret i s'ha de publicar en el BOIB i fer-ne difusió a&lt;/span&gt;&lt;span style="color:#00000a"&gt;l web corporatiu del CIM&lt;/span&gt;&lt;span style="color:#0000ff"&gt;.&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Sisena. Abonament del premi&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;1. El CIM pagarà el premi en un termini màxim de 60 dies des de la data del dictamen del jurat, sempre que les disponibilitats de tresoreria ho permetin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;2. La quantia del premi s'atorga en concepte d'import brut i se li aplicarà la retenció de l'IRPF que escaigui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;3. La persona, entitat o empresa guanyadora haurà de presentar al CIM el document de designació de compte bancari on s'hagi de fer efectiu el pagament, si aquest no consta a la base de dades de tresoreria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;4. El premi es lliurarà, en acte públic, el 15 de setembre, Dia Internacional de la Democràcia, de l'any de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Setena. Obligacions de la persona o entitat guanyadora&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;a&lt;/em&gt;) Comunicar al CIM l'acceptació del premi en els termes en què aquest es concedeixi. En qualsevol cas, el premi s'entendrà acceptat tàcitament un cop hagin transcorregut quinze dies hàbils d'ençà que s'hagi publicat la resolució del jurat en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;b&lt;/em&gt;) Aportar els justificants necessaris per comprovar les dades incloses en la sol·licitud de participació en aquest premi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;c&lt;/em&gt;) Autoritzar al CIM a què comprovi el compliment de les obligacions tributàries i amb la Seguretat Social o aportar els certificats corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;d&lt;/em&gt;) Assistir a l'esdeveniment d'entrega i recollir el premi, personalment o de manera delegada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Vuitena. Revocació i reintegrament del premi&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;Pel que fa a la revocació i reintegrament del premi, serà d'aplicació el que disposa la Llei 38/2003, de 17 de novembre, general de subvencions i la resta de normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Novena. Infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. El règim d'infraccions i sancions administratives aplicables depèn de l'establert en el títol IV de l'LGS i en el títol V del TRLS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. De conformitat amb l'establert a l'article 69 de la Llei 4/2022, de 28 de juny, de consells insulars, els òrgans competents per imposar les sancions en cas d'infringir aquestes bases o la normativa aplicable en matèria de subvencions, són: el/la conseller/a executiu/iva, si són lleus o greus; el Consell executiu per el cas de les de caràcter molt greu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Desena. Altres disposicions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;1. Recursos administratius: els acords del Consell executiu pels quals s'aproven les bases i les convocatòries no exhaureixen la via administrativa i són susceptibles de rebre recurs d'alçada davant el Ple del CIM. Altrament, l&lt;/span&gt;es resolucions dels consellers executius per les quals es concedeixen i deneguen els ajuts no exhaureixen la via administrativa i són recurribles en alçada davant el Consell executiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;2. Normativa general aplicable: en tot allò no previst expressament en aquestes bases regeixen les disposicions de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques i les que siguin aplicables al CIM en matèria de subvencions, especialment les contingudes en:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;- Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;- Decret legislatiu 2/2005, de 28 de novembre, pel qual s'aprova el Text refós de la Llei de subvencions de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#00000a"&gt;- Reglament de la Llei general de subvencions (Reial decret 887/2006, de 21 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra aquest acord – que no exhaureix la via administrativa – es pot interposar un recurs d'alçada davant la Comissió de Govern, per delegació del Ple del Consell Insular de Menorca (Acord de 31-7-2023, BOIB núm. 109 de 5-8-2023), en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'esmentat recurs s'entendrà desestimat, si no es notifica la resolució corresponent, quan hagin transcorregut tres mesos des de la seva interposició. Contra la desestimació del recurs d'alçada per silenci administratiu podreu interposar recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
