&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CONVENI DE COL·LABORACIÓ ENTRE EL CONSELL INSULAR DE FORMENTERA I L'ASSOCIACIÓ D'ARTISTES DE FORMENTERA PER L'ORGANITZACIÓ DE LA FIRA TARDOR D'ART 2025&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Formentera, 8 d'abril de 2025&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PARTS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'una banda, el Sr. Oscar Portas Juan, amb DNI núm. (...), president del Consell Insular de Formentera,&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;i amb domicili social a la plaça de la Constitució núm. 1 de Sant Francesc, Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'altra banda, la Sra. Maria Isabel Escandell Guasch, amb DNI núm. (...), presidenta de l'Associació d'Artistes de Formentera, en virtut del certificat de canvi de Junta Directiva de 20 d'abril de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACTUEN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'una banda, el Sr. Oscar Portas Juan, president del Consell Insular de Formentera, qui actua en nom i representació d'aquest, amb CIF núm. P0702400C i amb domicili social a la plaça de la Constitució núm. 1, de Sant Francesc, en virtut de l'Acte del Ple del Consell Insular de Formentera de 17 de juny de 2023, d'acord amb l'article 136 del Reglament Orgànic del Consell Insular de Formentera (ROC), els articles 34 i 41.3 de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, de la Llei orgànica 5/1985, de 19 de juny, de règim electoral general i l'article 21 de la Llei 4/2022, de 28 de juny, de consells insulars, assistida pel secretari de la corporació, Sr. Ángel Custodio Navarro Sánchez, de conformitat amb l'article 161 del citat ROC. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D'altra banda, la senyora Maria Isabel Escandell Guasch com a representant de l'Associació d'Artistes de Formentera, que actua en nom i representació d'aquesta, amb CIF G57488744 i amb domicili a Formentera, a Casa Rosado al Venda d'Es molí s'Estany núm. 2885, 07871 de Sant Ferran (Formentera), inscrita al Registre d'associacions de la Comunitat Autònoma amb el número 311000006059, en data 7 de març 2007 i al Registre d'Entitats Ciutadanes del Consell Insular de Formentera amb el número 9, en data 12 d'abril de 2007.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ambdues parts es reconeixen mútuament la capacitat legal suficient i necessària per a formalitzar aquest conveni i lliurement&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;EXPOSEN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Constitució Espanyola disposa, en l'article 44, que els poders públics promouran i tutelaran l'accés a la cultura, a la qual tots tenen dret.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Insular de Formentera (d'ara endavant, CIF) exerceix competències en matèria de cultura i patrimoni històric en virtut de la Llei 6/1994, de 13 de desembre, d'atribució de competències en matèria de patrimoni històric, promoció sociocultural, animació sociocultural, dipòsit legal de llibres i esports.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'article 70.6 de la Llei Orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'Autonomia de les Illes Balears, determina que el patrimoni monumental, cultural, històric, artístic, arquitectònic, arqueològic i paisatgístic són competència dels consells insulars en el seu àmbit territorial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'article 70.18 de la mateixa Llei que les següents matèries també són competència dels consells insulars: “Cultura. Activitats artístiques i culturals. Foment i difusió de la creació i la producció teatral, musical, cinematogràfica i audiovisual, literària, de dansa i arts combinades. Promoció i animació sociocultural.” &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'Associació d'Artistes de Formentera, constituïda a l'illa l'any 2002, d'acord amb el que recull l'article 2 dels seus estatuts, té les següents finalitats: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.- Promoure l'art a l'illa de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.- Promoure l'art de Formentera fora de l'illa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.- Promoure l'obra dels artistes associats. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'Associació d'Artistes de Formentera i el CIF tenen la intenció de col·laborar en aquestes activitats perquè la ciutadania de l'illa pugui gaudir d'esdeveniments diversos i participar-hi, en molts casos de forma activa, que contribueixen a donar a conèixer el patrimoni cultural de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En conseqüència i d'acord amb allò exposat anteriorment, es formalitza l'esmentada col·laboració entre el Consell Insular de Formentera i l'Associació d'Artistes de Formentera, mitjançant el present conveni de col·laboració, amb subjecció a les següents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CLÀUSULES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'objecte d'aquest conveni és regular una subvenció per procediment de concessió directa, tot establint els termes i les condicions de la col·laboració entre el CIF i l'Associació d'Artistes de Formentera, destinat únicament a l'organització i a la celebració de la Fira Tardor d'Art 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Actuacions subvencionables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'organització i la celebració de la Fira Tardor d'Art 2025 en qualsevol de les seues activitats, sempre i quan es limiti a la finalitat del que disposa l'article 2 dels seus estatus, i que serà responsabilitat de l'Associació d'Artistes de Formentera a través dels mecanismes adequats, amb la col·laboració del CIF, mitjançant la signatura del present Conveni de col·laboració, i sense perjudici que altres institucions i/o associacions hi puguin col·laborar. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'Associació d'Artistes de Formentera es compromet a dur a terme les activitats objecte d'aquest conveni, fent constar la col·laboració del CIF amb la imatge corporativa corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Obligacions del Consell Insular de Formentera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tenint en compte el cost econòmic que suposa a l'Associació d'Artistes de Formentera la realització de l'activitat descrita, el CIF col·laborarà econòmicament amb l'activitat detallada a la clàusula 2 d'aquest Conveni amb l'aportació màxima de 15.000 euros, amb càrrec a la partida pressupostària 2025.334.480.00, dels pressupostos generals del Consell Insular de Formentera, per a l'any 2025, publicat al BOIB número 22, de 18 de febrer de 2025 (subvenció nominativa). Tot això resta condicionat, de manera taxativa, a l'existència de crèdit adequat i suficient per finançar les obligacions derivades d'aquest conveni en el pressupost de despesa de l'any en curs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El pagament de la quantia fixada es farà efectiu en dues parts. El 50% en el moment de la signatura del conveni, s'eximeix a l'Associació d'Artistes de Formentera de presentar cap tipus de garanties, segons s'estableix en l'article 34.4 de la Llei General de Subvencions i el 50% pendent es pagarà un cop presentada la justificació del 100% de la subvenció concedida, previ informe des de l'àrea de Cultura sobre el correcte desenvolupament de les accions objecte del conveni. La justificació del 100% de la subvenció concedida es farà abans del 31 de gener de 2026 i serà un requisit ineludible per optar a una propera subvenció amb el mateix objecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Obligacions de l'Associació d'Artistes de Formentera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En compliment del que disposa l'article 11 del decret legislatiu 2/2005, de 28 de desembre, text refós de la llei de subvencions de les Illes Balears, l'Associació d'Artistes de Formentera queda sotmesa, entre d'altres, a les obligacions següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dur a terme l'activitat o la inversió o adoptar el comportament que fomenta la concessió de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Presentar abans del 31 de gener de 2026, els documents acreditatius de la justificació de la subvenció. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sotmetre's a les actuacions de comprovació que duguin a terme els òrgans competents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell tindrà l'autoritat final per anul·lar o modificar qualsevol aspecte de l'esdeveniment en benefici de l'interès general, com a responsable i donador que és de la dita subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Notificar al Consell qualsevol modificació que es pretengui realitzar en el projecte inicialment presentat, en relació a les actuacions subvencionables. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Fer constar de forma clara en els cartells, convocatòries d'activitats i en tota la informació gràfica, escrita i sonora que es realitzi amb motiu de les activitats subvencionables, que l'activitat està subvencionada o patrocinada pel Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Deixar constància de la percepció i l'aplicació de la subvenció en els llibres de comptabilitat o en els llibres de registre que hagi de dur el beneficiari d'acord amb la legislació mercantil o fiscal que sigui aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Conservar els documents justificatius de l'aplicació dels fons percebuts mentre puguin ser objecte d'actuacions de comprovació i control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Reintegrar els fons percebuts en els supòsits previst en l'article 44 d'aquesta Llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Concordança amb altres subvencions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'Associació d'Artistes de Formentera haurà d'informar al Consell Insular de Formentera, a través de l'òrgan competent en la matèria, la subvenció o subvencions que rebi per a la mateixa finalitat. En aquesta comunicació farà constar els diners obtinguts, així com totes les condicions aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cap cas, la quantia total de les subvencions podrà superar el cost total de l'activitat, ja que si és així, la subvenció concedida per aquesta Corporació es reduirà de manera proporcional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Justificació de la subvenció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La data màxima de justificació per part de l'Associació d'Artistes de Formentera, serà el dia 31 de gener de 2026. Els fons percebuts s'hauran de destinar únicament a les actuacions i programes que es duguin a terme i tinguin com a finalitat la celebració de la Fira Tardor d'Art 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La documentació que s'haurà d'aportar és la següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Acreditació d'estar al corrent de pagament de totes les obligacions tributàries i davant de la seguretat social, o autorització en favor del CIF, perquè pugui sol·licitar els certificats necessaris davant el Ministeri d'Hisenda i el Departament d'Hisenda de la Comunitat Autònoma balear.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Pressupost d'ingressos i despeses realitzades, en el que s'haurà d'incloure el compte justificatiu de despeses que de conformitat al que estableix l'article 72 del Reial Decret 887/2006, de 21 de juliol, pel que s'aprova el Reglament de la Llei 38/2003, General de Subvencions, contindrà la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una relació classificada de les despeses, amb identificació del creditor i del document acreditatiu de la despesa, la seva data d'emissió, el seu import i la seva data de pagament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les factures o documents de valor probatori equivalent en el tràfic jurídic mercantil o amb eficàcia administrativa incorporats en la relació a què es fa referència en el paràgraf anterior i la documentació acreditativa del pagament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una relació detallada d'altres ingressos o subvencions que hagin finançat actuacions del programa, amb indicació del seu import i la seva procedència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Una memòria indicativa de les activitats realitzades. S'hi adjuntarà un exemplar de les publicacions, els fullets o la propaganda que s'hagi realitzat per difondre l'activitat subvencionada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Reintegrament de la subvenció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'estableix l'obligació per part de l'Associació d'Artistes de Formentera de reintegrar els fons en el supòsit d'incompliment dels requisits i obligacions establertes per a la concessió i, en tot cas, en els supòsits regulats en l'article 44 del decret legislatiu 2/2005, de 28 de desembre, text refós de la llei de subvencions de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A més, el CIF es reserva el dret a disminuir proporcionalment la seua aportació, en el supòsit d'incompliment parcial del Conveni, o bé en el cas que les despeses justificades no arribin al total de les despeses pressupostades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Vigència&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest conveni entrarà en vigor el dia de la seva signatura, i finalitzarà la seva vigència el 31 de gener del 2026, tenint efectes retroactius des del dia 1 de desembre de 2024. Ambdues parts podran acordar la pròrroga expressa del conveni, adoptada amb les mateixes formalitats que la seua signatura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El conveni es resoldrà si es donen les següents causes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Incompliment de les obligacions per part de qualsevol de les parts signats, o d'ambdues.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La dissolució de l'associació que subscriu el Conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'anul·lació o la revocació de l'acte de concessió de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Impossibilitat material o legal de complir les obligacions que es deriven de l'objecte del conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Denúncia de qualsevol de les parts manifestada per escrit. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pel mutu acord de les parts, que s'ha de formalitzar per escrit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Procediment d'atorgament de la subvenció i naturalesa del present conveni&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El present conveni té naturalesa administrativa, i constitueix l' instrument a través del qual es canalitza una subvenció pel procediment de concessió directa previst en l'article 7.1.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; del decret legislatiu 2/2005, de 28 de desembre, text refòs de la llei de subvencions de les Illes Balears, i en l'article 22.2.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la Llei 38/2003, de 17 de novembre, general subvencions, perquè s'acrediten raons d'interès públic, social, econòmic o humanitari que dificulten la seva convocatòria pública, d'acord amb els informes que consten a l'Àrea de Cultura del Consell Insular de Formentera. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Normativa d'aplicació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el no previst en el conveni present caldrà ajustar-se al que disposen les bases d'execució del pressupost general del Consell Insular de Formentera per al 2025, a l'esmentada Llei de consells insulars, article 96.2 de i disposició addicional 9a sobre &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Normativa en matèria de subvencions&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;; al Decret legislatiu 2/2005, de 28 de desembre, text refós de la llei de subvencions de les Illes Balears, a la Llei 38/2003, de 17 de novembre, General de Subvencions i al Reial decret 887/2006, de 21 de juliol, pel que s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions, d'acord amb el que estableix l'article 8 de la Llei 38/2003, de 17 de novembre, general de subvencions, i els articles 10 i següents del seu Reglament, així com atès l'establert a l'article 6 i concordants del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions, aplicable a les Illes Balears. I, en qualsevol cas, el que diu la Llei 4/2022 de 28 de juny de consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el no previst en el present conveni, caldrà ajustar-se al que disposen les bases d'execució del pressupost general del Consell Insular de Formentera per al 2025, publicat al BOIB número 22, del 18 de febrer de 2025, al Decret legislatiu 2/2005, de 28 de desembre, text refós de la Llei de Subvencions de les Illes Balears, a la Llei 38/2003, de 17 de novembre, General de Subvencions i al Reial Decret 887/2006, de 21 de juliol, pel que s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, General de Subvencions, al Pla Estratègic de Subvencions 2024-2025, publicat al BOIB de data 13 de març de 2024, amb número edicte 13008-13024, i d'acord amb el que estableix l'article 8 de la Llei 38/2003, de 17 de novembre, general de subvencions, i els articles 10 i següents del seu Reglament, així com, atès l'establert a l'article 6 i concordants del Decret Legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de Subvencions, aplicable a les Illes Balears., així com l'article 96.2 i la disposició addicional novena de la llei 4/2022, de 28 de juny, de consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;I en prova de conformitat, ambdues parts signen aquest conveni per duplicat i a un sol efecte, en el lloc i la data esmentats a l'encapçalament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
