![CDATA[Resolució de la consellera de Presidència i Administracions Públiques per la qual s’acorda l’exclusió de les proves selectives per a l’ingrés, pel torn lliure, als cossos de l’Administració especial de la Comunitat Autònoma de les Illes Balears convocades per Resolució de 19 de desembre de 2022 de les persones aspirants que han obtingut la condició de funcionari de carrera]] 2025-04-10 2025-04-12 19496 120 ca CAIB CAIB 2025-04-12 260230 ca ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Fets</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. Mitjançant la Resolució de la consellera de Presidència, Funció Pública i Igualtat de 19 de desembre de 2022, es va aprovar la convocatòria, les bases, els exercicis i temari i el barem de mèrits de les proves selectives per a l'ingrés, pel torn lliure i pel torn de promoció interna vertical i pel torn de promoció interna creuada, inclosa la reserva per a persones amb discapacitat, per cobrir les places de personal funcionari a l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 165, de 20 de desembre de 2022).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. El punt 8.5 de les bases específiques de la convocatòria esmentada, estableix que si algun aspirant és nomenat personal funcionari de carrera del mateix cos, escala o especialitat a què opta, si escau, durant el transcurs d'aquest procés selectiu, o bé ja té aquesta condició, en serà exclòs, amb la corresponent devolució de taxes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. Mitjançant la Resolució de la consellera de Presidència i Administracions Públiques de 18 de juny de 2024, s'aproven les llistes definitives de persones admeses i excloses, amb expressió de la causa d'exclusió, de les proves selectives per a l'ingrés, pel torn lliure, als cossos facultatius de l'Administració especial de la Comunitat Autònoma de les Illes Balears, convocades per Resolució de 19 de desembre de 2022.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4. En data 14 de desembre de 2024, es va publicar en el BOIB núm. 164 la Resolució de la consellera de Presidència i Administracions Públiques per la qual es varen nomenar funcionaris de carrera del procés d'estabilització per concurs oposició del cos facultatiu tècnic, excepte l'especialitat d'enginyeria tècnica agrícola, de l'Administració especial de la Comunitat Autònoma de les Illes Balears i se'ls va adjudicar un lloc de feina.<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5. En data 31 de desembre de 2024, es va publicar en el BOIB núm. 172 la Resolució de la consellera de Presidència i Administracions Públiques per la qual es varen nomenar funcionaris de carrera del procés d'estabilització per concurs oposició del cos facultatiu superior de l'Administració especial de la Comunitat Autònoma de les Illes Balears i se'ls va adjudicar un lloc de feina.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Fonaments de dret</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. La Llei 3/2003, de 26 de març, de règim jurídic de l'administració de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. La Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4. El Decret 27/1994, d'11 de maig, pel qual s'aprova el Reglament d'ingrés del personal al servei de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5. El Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, i posteriors modificacions pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">6. Mitjançant les Resolucions esmentades en els números 4 i 5 dels fets d'aquesta Resolució, es varen nomenar funcionaris de carrera de l'Administració especial, les persones que figuren en l'annex d'aquesta Resolució per superar, respectivament, el corresponent procés selectiu, així mateix, varen ser adm<span style="background-color:#ffffff">eses en le</span>s proves selectives per a l'ingrés, pel torn lliure, als cossos de l'Administració especial de la Comunitat Autònoma de les Illes Balears convocades per Resolució de 19 de desembre de 2022, per la qual cosa, d'acord amb el punt 8.5 de les bases específiques de la convocatòria esmentada han de ser excloses d'aquest procés.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Per tot això, dict la següent</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Resolució</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. Excloure de manera definitiva les persones aspirants que figuren en l'annex d'aquesta Resolució de les proves selectives per a l'ingrés, pel torn lliure, als cossos de l'Administració especial de la Comunitat Autònoma de les Illes Balears (BOIB núm. 165, de 20 de desembre de 2022) d'acord amb el punt 8.5 de les bases específiques de la convocatòria esmentada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. Modificar, en els termes establerts en l'annex d'aquesta Resolució, les llistes definitives d'admesos i exclosos del procés esmentat, aprovades per Resolució <span style="background-color:#ffffff">de </span><span style="background-color:#ffffff">18 de juny de 2024.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. Iniciar els tràmits necessaris per a la devolució de taxes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Interposició de recursos</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="background-color:null">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar recurs potestatiu de reposició davant la consellera de Presidència i Administracions Públiques, en el termini d'un mes comptador a partir de l'endemà que s'hagi publicat la Resolució en el Butlletí Oficial de les Illes Balears, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
